A class action settlement has been reached with Ticketmaster (“Ticketmaster”) and Live Nation Entertainment, Inc. (“Live Nation”) to settle a class action lawsuit in California Superior Court in Los Angeles (styled Curt Schlesinger and Peter Lo Re, on behalf of themselves and the Class vs. Ticketmaster) challenging Ticketmaster’s description and amount of charges to online customers for ticket delivery and for order processing fees, according to Live Nation’s Form 8-K filing with the SEC, Item 8.01 Other Events, Settlements of Consumer Class Action Litigation.
Pursuant to the terms of the proposed Live Nation & Ticketmaster ticket delivery and order processing fee class action lawsuit settlement, among other things, Ticketmaster will reportedly pay the fees of the claims administrator as well as the plaintiffs’ attorneys’ fees and certain costs that are approved by the Court and subject to a set maximum, and class members who meet certain conditions will be entitled to receive from Ticketmaster a cash payment and/or discounts off one or more future ticket purchases. The individual and aggregate values of each option under the class action settlement are reportedly subject to set maximums. Ticketmaster will also reportedly make certain changes to disclosures on its website under the proposed class action settlement.
