Landry’s Restaurant Class Action Settlement Of Gift Card Dormancy Fee Class Action Lawsuit.
A class action settlement has been reached in a class action lawsuit against Landry’s Restaurants, Inc. (“Landry’s Restaurants” or “Landry’s” or Defendant”) in the Superior Court of New Jersey (styled Delany v. Landry’s Restaurants, Inc., Class Action Case No. WRN-L-122-09) alleging, among other things, that Landry’s sold gift cards in New Jersey containing a dormancy fee and other provisions that allegedly violate the New Jersey Truth in Consumer Contract Warranty and Notice Act (N.J.S.A. 56:12-14) and the New Jersey Gift Card Act (N.J.S.A. 56:8-110), according to the Landry’s Restaurant gift card dormancy fee class action settlement notice.
The Landry’s Restaurant gift card dormancy fee class action lawsuit settlement class reportedly includes the following persons, unless otherwise excluded:
All New Jersey residents who purchased a Landry’s gift card at any time on or after April 4, 2006 through the date the Court enters an order of final approval of the Settlement Agreement (the “Class Period”) where the gift card contains a dormancy fee provision.
The proposed Landry’s Restaurant gift card dormancy fee class action settlement reportedly provides that Landry’s has already stopped selling and has agreed not to resume selling gift cards containing a dormancy fee provision. While it has already been reportedly doing so, Landry’s has also agreed to continue to honor the full value of unredeemed or the remaining value of partially redeemed Landry’s gift cards sold in New Jersey after April 4, 2006. In addition, eligble class members who purchased a gift card with a dormancy fee provision and who submit a completed and valid Claim Form no later than February 15, 2011, may be entitled to receive a gift certificate if the proposed settlement is granted final approval by the Court.
On March 4, 2011, a hearing will be held on the fairness of the proposed Landry’s Restaurant gift card dormancy fee class settlement before the Honorable Amy O’Connor, Judge of the Superior Court of New Jersey Law Division, Warren County, located at 413 Second Street, Belvidere, New Jersey 07823.
