Jay Wolfe Honda, Jay Wolfe Toyota, Jay Wolfe Acura, Acura of Springfield, & Jay Wolfe Toyota Scion Of West County Class Action Settlement Over Document Preparation Fees

If You Purchased or Leased a Vehicle From Jay Wolfe Honda, Jay Wolfe Toyota, Jay Wolfe Acura, Jay Wolfe Toyota Scion of West County or Acura of Springfield, and You Were Charged a Document Preparation or Similar Fee, Your Rights May Be Affected By a Class Action Settlement.

A class action settlement has been reached in five consolidated pending class action lawsuits against five Jay Wolfe auto dealerships, Jay Wolfe Imports LLC d/b/a Jay Wolfe Honda, JWTSL Company, LLC d/b/a Jay Wolfe Toyota, Jay Wolfe Imports Missouri Inc. d/b/a Jay Wolfe Acura, Jay Wolfe Imports of Springfield, Inc, d/b/a Acura of Springfield, and JWSTL Inc. d/b/a Jay Wolfe Toyota Scion of West County (“Defendants”), alleging that Jay Wolfe Honda, Jay Wolfe Toyota, Jay Wolfe Acura, Acura of Springfield, Jay Wolfe Toyota Scion Of West County violated Missouri Revised Statues, §408.010 et seq (the Missouri “Practicing Law Statute”) and Missouri Revised Statues § 407.010 et seq. (the “Merchandise Practices Act”) by charging a Document Preparation Fee (i.e., Doc Prep Fee, Document Processing Fee, Doc Processing Fee, Doc Fee, Document Fee, Processing Fees, Customer Service Processing Fees, Administrative Fees, Admin Fee, Customer Benefit Fee or a similarly named fee) for alleged unauthorized actions, according to the Jay Wolfe class action settlement notices.

The Jay Wolfe Honda, Jay Wolfe Toyota, Jay Wolfe Acura, Acura of Springfield, Jay Wolfe Toyota Scion Of West County document preparation fee class settlement reportedly resolves the following class action lawsuits:

  • Lindsay M. Tekampe v. Jay Wolfe Imports LLC d/b/a Jay Wolfe Honda filed in the Circuit Court of Jackson County Missouri, Case No. 0816CV-016159.
  • Vincent Frew v. JWTSL Company, LLC d/b/a Jay Wolfe Toyota pending in the Circuit Court of Jackson County Missouri, Case No. 0816-CV17104.
  • John Rubenstein v. Jay Wolfe Imports Missouri Inc. d/b/a Jay Wolfe Acura pending in the Circuit Court of Jackson County Missouri, Case No. 0916-CV36894
  • Bryant Robinson v. Jay Wolfe Imports of Springfield, Inc, d/b/a Acura of Springfield filed in the Circuit Court of Greene County Missouri, Case No. 0931-CV12396 and consolidated with Case No. 0816-CV16159 pending in the Circuit Court of Jackson County, Missouri.
  • Franz v. JWSTL Inc. d/b/a Jay Wolfe Toyota Scion of West County pending in the Circuit Court of Jackson County Missouri, Case No. 0816-CV39007.

If you purchased or leased a vehicle from Jay Wolfe Honda, Jay Wolfe Toyota, Jay Wolfe Acura, Jay Wolfe Toyota Scion of West County or Acura of Springfield, and were charged a document preparation fee, you may be entitled to a Gift Card under the terms of the proposed class action settlement.  The amount of the Gift Card may vary (i.e., $99.50 $149.50 $224.25) depending on where and when you purchased or leased a vehicle.

The Gift Card can reportedly be used the same as cash for any goods and/or services provided by the Jay Wolfe dealership where the claimant purchased or leased a vehicle and can be freely transferred and/or assigned (and up to three cards can be used together).

You may be eligible to receive the benefits of the class action settlement if you purchased or leased a vehicle from:

  • Jay Wolfe Honda between June 3, 2003 and July 30, 2009
  • Jay Wolfe Toyota between June 12, 2003 and July 30, 2009
  • Jay Wolfe Acura between November 30, 2004 and July 30, 2009
  • Acura of Springfield between August 14, 2004 and July 30, 2009
  • Jay Wolfe Toyota Scion of West County between January 2, 2004 and July 30, 2009

If the Settlement is approved by the Court after the Final Approval Hearing, if you have timely submitted a valid Claim by the deadline of May 31, 2010, and if the Claims Administrator has confirmed your eligibility to participate, you will reportedly be sent a Gift Card for the value of your share of the Settlement Fund distribution.

A Final Approval Hearing (“Final Fairness Hearing”) is scheduled to be held on June 16, 2010, at 1:30 p.m. in the Circuit Court of Jackson County before the Honorable Judge Ann Mesle, to determine whether the proposed Settlement is fair, reasonable, and adequate. The date is subject to change; any change will be posted on the settlement website at www.WolfeSettlement.com.

    We were not notified of the lawsuit, and only heard about it recently. When I asked about the lawsuit at the dealership while having service done, no one knew how to make contact with appropriate parties. They said to wait, because notifications usually come in waves. I need to know who to contact about this issue.

      Received my 2 letters in the mail for 149.50 each. Sucks considering I no longer live in Kansas City so not sure if the dealer will honor the coupons over the phone for accessories.

    I no longer own the car I purchased from Jay Wolfe Honda so I was going to buy some after market shock absorbers for another vehicle. I went to a parts store to find out what they would cost retail and found that the cost would be $99.96 plus tax. I took the information to the dealership and they told me that the shocks would cost me $150.00 which included tax. Assuming that tax would be about $10.00 they were marking them up about $10.00 for each shock. They were making $40.00 on the $99.50 settlement so the settlement only cost them $60.00. If I had work done at the dealership I sure that the work would have been marked up a like amount. I don’t know if this is what the judge intended but it really doesn’t seem fair to me.
