(“Apple”) and AT&T Mobility LLC (“AT&T”) (collectively “Defendants”) have reportedly agreed to a settlement of a class action lawsuit against Apple and AT&T in the United States District Court for the Northern District of California (styled as In re Apple and AT&T iPad Unlimited Data Plan Litigation, Case No. 5:10-cv-02553-RMW) alleging, among other things, that Apple and AT&T customers who bought or ordered Apple iPad 3Gs on or before June 7, 2010 were not provided with unlimited 3G data plans advertised by Apple and AT&T, according to the Apple and AT&T iPad Unlimited 3G Data Plan Class Action Settlement notice.
The Apple settlement class reportedly includes, unless otherwise excluded, all United States residents who bought or ordered an Apple iPad 3G in the United States on or before June 7, 2010. The AT&T settlement subclass reportedly includes, unless otherwise excluded, all persons in the United States who bought or ordered an Apple iPad 3G in the United States on or before June 7, 2010 and who didn’t sign-up for or buy an AT&T dataplan for the Apple iPad 3G.
Under the Apple and AT&T iPad Unlimited 3G Data Plan Class Action Lawsuit Settlement Apple will reportedly pay qualifying Apple Class Members $40, while AT&T will reportedly provide a Data Plan Benefit to AT&T Subclass Members allowing them to sign up for an AT&T 5GB iPad data plan at a discount of $20/month off the monthly rate (currently $50 per month, resulting in a monthly rate of $30 per month) for up to 1 year.
