Hydroxatone Risk Free Trial and/or Auto-Shipment Program (Preferred-Customer Beauty Program or Beauty Auto-Ship Program) Class Action Settlement – Sabol v. Hydroxatone

If you paid for and/or were charged for Hydroxatone-branded products such as Hydroxatone,Celtrixa, Hydrolyze, Declatone, Lashatone, Instant Effect, Luminique, Instant Wrinkle Filler, and Orexis and/or were charged shipping and processing fees for such products, in connection with a Risk-Free Trial and/or Auto-Shipment Program, you may be entitled to benefits under a class action settlement.

Hydroxatone LLC and Atlantic Coast Media Group LLC (“Hydroxatone or “Defendants”) have reportedly agreed to a proposed settlement of a class action lawsuit against them in the United States District Court for the District of New Jersey (captioned Susan Sabol, et al., v. Hydroxatone LLC and Atlantic Coast Media Group LLC, Civ. Act. No. 2:11-cv-0456-KM-MAH (D.N.J.)) alleging, among other things, that Hydroxatone and Atlantic Coast Media failed to adequately disclose terms of Risk Free Trials and Auto-Shipment Programs (Preferred-Customer Beauty Program or Beauty Auto-Ship Program), refused to refund customers who timely returned Hydroxatone products, failed to allow consumers to timely cancel Hydroxatone Preferred-Customer Beauty Auto-Shipment Program memberships, and failed to cease billing consumers for Hydroxatone products after they have cancelled their memberships, purportedly in breach of contract, in violation of the New Jersey Consumer Fraud Act, and unjust enrichment, according to the proposed Hydroxatone Customer Beauty Risk Free Trial Program and/or Beauty Auto-Shipment Program class action settlement notice.

Who Is Included In The Proposed Hydroxatone Customer Beauty Risk Free Trial Program and/or Beauty Auto-Shipment Program Class Action Settlement?

The proposed Hydroxatone Customer Beauty Risk Free Trial Program and/or Beauty Auto-Shipment Program settlement class reportedly includes all persons (unless otherwise excluded) residing in the United States who between January 1, 2005 and March 28, 2013 paid for and/or were charged for Hydroxatone-branded products, and/or were charged shipping and processing fees for such products, in connection with a Risk-Free Trial and/or Auto-Shipment Program, including but not limited to: Hydroxatone,Celtrixa, Hydrolyze, Declatone, Lashatone, Instant Effect, Luminique, Instant Wrinkle Filler, and Orexis.

What Settlement Benefits Does The Proposed Hydroxatone Customer Beauty Risk Free Trial Program and/or Beauty Auto-Shipment Program Class Action Settlement Provide?

Under the proposed Hydroxatone Customer Beauty Risk Free Trial Program and/or Beauty Auto-Shipment Program class action settlement, Defendants will provide a cash benefit (a $3 million common settlement fund) and a product benefit ($4 million worth of Hydroxatone-branded products).  Settlement class members must file claims online or by mail no later than August 15, 2013.

Under the settlement, Defendants also reportedly agree not to directly or indirectly engage in the specific acts or practices that were alleged to be deceptive or unlawful.
