Class Action Settlement Agreement Reached In Class Action Lawsuit Filed Against Honda Over Brakes On Honda Acura TSXs and Honda Accords.
Honda has agreed to settle a class lawsuit against it pending in the United States District Court for the Central District of California (styled Browne et al. v. American Honda Motor Co., Inc., Case No. CV 09-06750 MMM (DTBx)) alleging brake defects in the rear braking system of 750,000 late model Honda Accords (2008-2009 Honda Accords) and Honda Acura TSXs (certain 2010 Honda Acuras) relating to the time it takes the rear brake pads to wear out, according to a class action settlement news report.
The Honda & Acura Rear Brake Pad settlement class reportedly includes all residents of the United States, including the Commonwealth of Puerto Rico, U.S. Virgin Islands, and Guam, who are current or former owners or lessees of a Class Vehicle. Class Vehicles reportedly include the following Honda and Acura vehicles:
- 2008 Honda Accord;
- 2009 Honda Accord;
- 2009 Acura TSX; and
- a small number of 2010 Honda Accords and some Acura TSXs, listed by the last six digits of the VIN Numbers: 2010 Honda Accord VIN Numbers 000001, 000002, 000003, 000004, 000005, 000006, 000007, 000008 and 000009 and 2010 Acura TSX VIN numbers listed here.
The Honda brake class action settlement reportedly includes reimbursement by Honda to car owners who had their brake pads replaced and rotors resurfaced prior to settlement approval (in an amount of one half of the cost or a maximum of $125, whichever is less). In addition, Honda will reportedly provide Honda owners with a one-time payment of up to $150 to have new, redesigned brake pads installed. On April 15, Judge Margaret M. Morrow of the United States District Court for the Central District of California granted preliminary approval to the Honda brake class action settlement.
Update August 2, 2010:
On July 29, 2010, U.S. District Court Judge Margaret M. Morrow reportedly granted final approval of the settlement in the Honda and Acura Rear Brake Pad Class Action, with one change to the proposed settlement previously outlined in the original notice to the class. If otherwise eligible for reimbursement, class members who paid to replace their rear brake pads with non-Honda or non-Acura pads will now be eligible to claim reimbursement for 50% of their costs for one such repair, up to $125. The processing time for claims involving non-Honda or non-Acura pads may exceed 10 days. Unless other legal proceedings occur, the settlement will become effective on August 28, 2010 and claims processing will commence at that time. If further legal proceedings occur, the status of the settlement will be posted on the accordsettlement.com website.

hi, i have a 2010 acura tsx and i have the same problem with other acura owners with the rear brakes but, my vin number was not on the list.
Honda already agreed to replace all these pads at no cost – so why the lawsuit? Some dipshit lawyer wanted to make money. So now insted of just bringing my car in and have Honda take care of it, I have to file all these forms to get reimbursed.
If you believe Honda’s claim that the brake pad problem is fixed by the new replacement brake pad, why did I have to have the rear brake pads on my 2010 Accord manufactured in February 2010 replaced at 13,900 miles? Cost was over $200.00, no help from Honda.
