Hertz Class Action Settlement of PlatePass Toll Payment Service Fee & Administrative Charge Lawsuit

If you rented a vehicle from Hertz in the United States at any time between July 1, 2006 and March 31, 2010 and used the PlatePass® electronic toll payment service and paid PlatePass service fees or administrative fees, you may be entitled to a cash refund payment from the Hertz class action lawsuit settlement.

The Hertz Corporation (“Hertz”), American Traffic Solutions, Inc. (“ATS”) and PlatePass LLC (“PlatePass”) (collectively “Defendants”) have reportedly agreed to a proposed settlement of a class action lawsuit against them in the United States District Court for the District of New Jersey (styled Susan Doherty and Dwight Simonson v. The Hertz Corporation, et al., Case No. 1:10-CV-00359) alleging, among other things, that Defendants failed to properly disclose “service fees” or “administrative fees” and the correct amount of certain toll charges related to Hertz customers’ use of the PlatePass® electronic toll payment service (“PlatePass”), according to the proposed Hertz PlatePass Toll Payment Service Fee & Administrative Charge class action settlement notice.

Who Is Included In The Proposed Hertz Class Action Settlement?

The proposed Hertz PlatePass Toll Payment Service Fee & Administrative Charge settlement class reportedly includes, unless otherwise excluded, all natural persons in the United States who rented a vehicle from Hertz at any time between July 1, 2006 and March 31, 2010, and during that vehicle rental used the PlatePass electronic toll payment service and thereafter paid PlatePass-Related Charges incurred during that vehicle rental.

What Settlement Benefits Does The Proposed Hertz Class Action Settlement Provide?

Under the proposed Hertz class action settlement, defendants have agreed to create a Common Fund in the amount of eleven million four thousand dollars to provide refunds to eligible Class Members who submit valid claims.

Hertz settlement class members can recover, with respect to their first use of PlatePass while renting a vehicle from Hertz during the Class Period, sixty-seven percent (67%) of the PlatePass-Related Charges paid by that Class Member, such as service fees or administrative fees and any Toll Differentials, i.e., the difference between the toll incurred by the Class Member and the amount paid to the toll authority if the former was greater. For subsequent uses of PlatePass while renting a vehicle from Hertz during the Claims Period, the Class Member may recover a refund of thirty-eight percent (38%) of the PlatePass-Related Charges paid by that Class Member.
