A class action settlement in a class action lawsuit pending against Heartland Payment Systems, Inc. in the United States District Court for the Southern District of Texas (captioned In Re: Heartland Payment Systems Inc. Customer Data Security Breach Litigation, MDL Case No. 4:09-md-02046) alleging that Heartland Payment Systems allowed private financial information to be stolen in a computer system intrusion in 2008 into credit and debit cards processed by Heartland, in violation of the federal Fair Credit Reporting Act (“FCRA”) and state statutory and common law, has been preliminarily approved by Judge Lee H. Rosenthal, according to class action settlement news reports.

The Heartland Payment Systems data breach class action settlement reportedly provides, among other things, reimbursements for certain out-of-pocket expenses and lost time (up to $175, with no more than two valid claims allowed per household) to eligible people affected by the intrusion who timely submit valid claim forms. Settlement class members who had identity theft related charges as a result of the breach can claim up to $10,000 in reimbursement from the settlement fund.
Reimbursements will made from an “Actual Damages Fund” to be funded by Heartland in an initial amount of $1 million. If valid claims exceed $1 million, Heartland will add up to $1.4 million more to the Actual Damages Fund, for a total of $2.4 million. In addition, Heartland has reportedly taken steps to enhance the security of its computer system.
