Godiva Chocolatier, Inc. has reportedly agreed to a class action settlement of a class action lawsuit filed against it in the United States District Court for the Souther District of New York, styled as Hesse, et al. v. Godiva Chocolatier, Inc., Case No. 1:19-cv-00927-AJN, alleging, among other things, that Godiva Chocolate Products were advertised as being made in Belgium when they were not exclusively manufactured there, allegedly in violation of various laws. Defendant Godiva reportedly denies the allegations.
Who Is Included In The Godiva Chocolate Class Action Settlement?
The Godiva Chocolate class action settlement reportedly includes, unless otherwise excluded, the following settlement class:
All Persons who purchased any Godiva Chocolate Product in the United States during the Class Period [January 31, 2015 through October 26, 2021].
“Godiva Chocolate Products” include all chocolate products manufactured and sold by Godiva, or sold under the Godiva brand, which contain chocolate, including the following types of chocolate products:
- Godiva Chocolate Bars
- Godiva Chocolate-Covered Snacks (e.g., biscuits, pretzels, nuts, fruits, etc.)
- Godiva Individually Wrapped Chocolates (e.g., G cube, Domes, wrapped truffles, etc.)
- Godiva In-Store Items (e.g., truffles, assorted chocolates, etc.)
- Godiva Packaged Chocolates (e.g., truffle collection, assorted chocolates)
- Miscellaneous Godiva Chocolate Products (E.g., hot cocoa, baking mixes, melting chocolates, etc.)

What Settlement Benefits Does The Godiva Chocolate Class Action Lawsuit Settlement Provide?
Under the Godiva Chocolate lawsuit settlement, Class Members who submit timely and valid Claim Forms, with Proof of Purchase, can recover up to $25, depending on the number of eligible Godiva Chocolate Products purchased during the class period. Class Members who submit timely and valid Claim Forms, without Proof of Purchase, can recover up to $15, depending on the number of eligible Godiva Chocolate Products purchased during the class period. If the aggregate total monetary value of valid Claim Forms submitted by all Class Members exceeds $15,000,000, Settlement Benefit will be reduced pro rata.
Godiva Chocolate settlement claim forms can be submitted online or via mail by February 23, 2022.
