If You Purchased Gaspari Novedex XT, You May Be Entitled To Receive Compensation From A Class Action Settlement.
A class action settlement has been proposed in a class action lawsuit against Gaspari Nutrition, Inc. (“Gaspari Nutrition” or “Gaspari” or “Defendant”) pending in United States District Court for the Central District of California (styled James Keller, on behalf of himself and all others similarly situated, Plaintiff vs. Gaspari Nutrition, Inc., Defendants) Class Action Case No. CV11-06158-GAF (SHx)) alleging, among other things, that improper statements were contained on the label and in advertisements for a certain Gaspari product called “Novedex XT” and that such statements violate consumer protection laws and were fraudulent and seeking to recover damages, disgorgement of profits, injunctive relief, and attorneys’ fees and costs, according to the Gaspari Novedex XT Testosterone Booster Dietary Supplement class action lawsuit settlement notice.
If you purchased Novedex XT for personal consumption and not for re-sale during the period November 2, 2006 through October 3, 2011, you are reportedly a member of the Class. Defendant’s officers, directors, and employees, and any individual who received remuneration from the Defendant to act as an endorser of Novedex XT are excluded from the Class.
In the Gaspari Novedex XT Settlement, Gaspari agreed to fund a “Common Fund” settlement worth one million dollars ($1,000,000.00). This fund will be comprised of seven hundred fifty thousand dollars ($750,000.00), and two hundred fifty thousand dollars ($250,000.00) worth of Viridex XT at the Manufacturer’s Suggested Retail Price.
Each Gaspari Novedex XT Settlement Class Member who provides a valid receipt or credit card statement showing that they purchased Novedex XT will be sent a check in the amount of $20.00 for each bottle of Novedex XT purchased for personal consumption during the Class Period. For example, if you purchased three (3) bottles, you would be entitled to receive a Settlement check for $60.00.
Each Gaspari Novedex XT Settlement Class Member who does not have a valid receipt or credit card statement showing that they purchased Novedex XT, but who signs a sworn affirmation under penalty of perjury (i.e., sworn statement) set forth on the Claim Form, along with other requested information relating to the purchase of the product, via U.S. mail or through the Settlement website, saying that they purchased Novedex XT, will be sent a check in the amount of $10.00 for each bottle of Novedex XT purchased during the Class Period, up to a maximum of four (4) bottles. For example, if you purchased three (3) bottles, you would be entitled to receive a Settlement check for $30.00.
As an alternative to monetary compensation, Gaspari Novedex XT Settlement Class Members may elect to receive a bottle of Viridex XT, with the restriction that each Settlement Class Member who claims Viridex XT in lieu of monetary compensation first must agree in writing that he, she, or it will not sell, distribute, or otherwise transfer the product.
To ask for compensation, you must complete and submit a Claim Form along with the required supporting documentation, if you have it. The Claim Form describes what you must provide to prove your claim and receive compensation.
The Court will hold a Fairness Hearing at 9:30 a.m. (PDT) on March 19, 2012. to decide whether to give final approval to the class action settlement.
