If you purchased or leased a vehicle during the period of May 21, 2003 to August 27, 2009 from Friendly Ford, Inc. and you were charged certain fees, variously known as a “Document Preparation Fee,” “Doc Prep Fee,” “Document Processing Fee,” “Doc Processing Fee,” “Doc Fee,” “Document Fee,” “Processing Fees,” “Customer Service Processing Fees,” “Administrative Fees,” “Admin Fee,” “Customer Benefit Fee” or a similarly named fee, your rights may be affected by a class action settlement.

A class action settlement has been reached with Friendly Ford, Inc. (“Friendly Ford” or “Defendant”) in a class action lawsuit in the Circuit Court of Greene County, Missouri (styled Elite Irrigation Services, LLC v. Friendly Ford, Inc., Class Action Case No. 0831-CV06788) alleging, among other things, that Friendly Ford violated the Practicing Law Statute (Missouri Revised Statutes, § 408.010 et seq.) and the Merchandise Practices Act (Missouri Revised Statutes § 407.010 et seq.) by charging certain fees, known as “Document Preparation Fee,” “Doc Prep Fee,” “Document Processing Fee,” “Doc Processing Fee,” “Doc Fee,” “Document Fee,” “Processing Fees,” “Customer Service Processing Fees,” “Administrative Fees,” “Admin Fee,” “Customer Benefit Fee” or a similarly named fee, for alleged unauthorized actions, according to the Friendly Ford Document Preparation, Doc Prep, Administrative, Customer Benefit, or Processing Fee class action settlement notice.

The Settlement Class reportedly is defined as “All persons who paid a “document preparation fee” (denominated as a “Document Preparation Fee,” “Doc Prep Fee,” “Document Processing Fee,” “Doc Processing Fee” “Doc Fee,” “Document Fee,” “Processing Fees,” “Customer Service Processing Fees,” “Administrative Fees,” “Admin Fee,” “Customer Benefit Fee” or any fee similar in name to Defendant, Friendly Ford as part of a purchase or lease of an automobile from any dealership owned by Friendly Ford during the period of May 21, 2003 through August 27, 2009. The Settlement Class excludes (i) The Defendant and its officers, directors, shareholders, partners, employees, and owners; (ii) the Court presiding over any motion to approve the Settlement Agreement; and (iii) those persons who timely and validly request exclusion from the Settlement Class.

Pursuant to the proposed Settlement, Friendly Ford will pay a percentage of the fee that was charged, as follows:

(a) Friendly Ford agrees to provide a Gift Card worth 45% of the fee amount paid (for a card value of $30.38 to $43.88) to Class Members who purchased or leased a car between May 21, 2003 and May 20, 2006, who submit claims under the Settlement.

(b) Friendly Ford agrees to provide a Gift Card worth 55% of the fee amount paid (for a card value of $53.63 or $108.63) to Class Members who purchased or leased a car between May 21, 2006 and August 27, 2009, who submit claims under the Settlement.

A Final Approval Hearing (“Hearing”) will be held on July 6, 2011, at 1:30 p.m. in the Greene County Circuit Court before the Honorable Michael Cordonnier, to determine whether the proposed Settlement is fair, reasonable, and adequate.
