Fifth Third Bank Class Action Settlement Of Overdraft Fee Class Action Lawsuit

If you paid overdraft fees related to a Fifth Third debit card, check card and/or bank card, you could receive a cash payment from a class action settlement.

A class action settlement has been reached in a class action lawsuit pending against Fifth Third Bank (“Fifth Third Bank” or “Fifth Third” or “Defendant”) in the United States District Court for the Northern District of Illinois (styled Shannon Schulte, et al. v. Fifth Third Bank, Class Action Case No. 1:09-CV-06655) alleging, among other things, that Fifth Third Bank improperly assessed overdraft fees for insufficient funds on debit card purchases and/or ATM withdrawals by “re-sequencing” transactions in order to maximize the number of overdraft fees, according to the Fifth Third Bank overdraft fee class action settlement notice.

Fifth Third Bank overdraft fee class action lawsuit settlement class members reportedly include the following persons, unless otherwise excluded:

All persons in the United States who hold or held a Fifth Third Account and who at any time during the Class Period (i.e., from October 21, 2004, through July 1, 2010) incurred at least one Overdraft Fee (i.e., an insufficient funds fee, overdraft fee, returned item fee, daily overdraft fee, overlimit fee, or other similar fee, incurred as a result of the “re-sequencing” of a Fifth Third Debit Card Transaction in non-chronological order that was not previously reversed, refunded or returned) associated with at least one Fifth Third Debit Card Transaction (i.e., a transaction done with or relating to a Fifth Third Debit Card, e.g., a debit card, check card or any other bank card used for debit purchases bearing the Fifth Third logo or brand.)

The proposed Fifth Third Bank overdraft fee class action settlement reportedly provides that Fifth Third will pay $9,500,000 to a Settlement Fund to make payments to eligible Settlement Class Members as well as to pay: (a) attorneys’ fees, costs, and expenses; (b) incentive payments; and (c) third party costs to provide notice and to administer the settlement. Payments will reportedly be made to Fifth Third Bank Settlement Class Members who submit valid Claim Forms no later than May 2, 2011.

Under the Fifth Third Bank overdraft fee class action settlement, Fifth Third Bank will also reportedly implement the following modifications to its business practices:

(1) Fifth Third Debit Card Transactions will not be charged to a customer’s Fifth Third Account from highest amount to lowest amount. Rather, Fifth Third has agreed that it will process all such charges in chronological order. This means that Fifth Third Debit Card Transactions will be processed in the order that they are presented to Fifth Third for payment, regardless of amount.
(2) All customer service representatives in Fifth Third’s call centers will be trained on issues related to Overdraft Fees and other overdraft issues. These customer service representatives will have the ability and authority to waive any overdraft fee for good cause (“good cause” may include an automatic waiver of one (1) overdraft fee per year, plus those resulting from errors in account reporting and other hardship situations such as hospitalization or illness causing an inability to examine account balances (medical documentation may be required for such claims)).

Fifth Third Bank overdraft fee settlement class members who wish to exclude themselves or opt out of the Fifth Third Bank overdraft fee settlement must reportedly submit a request for exclusion by February 23, 2011.

The Court is scheduled to hold a settlement Fairness Hearing at 10:30 a.m. on March 16, 2011, at the United States District Court for the Northern District of Illinois, Court Room No. 1919, 219 South Dearborn Street, Chicago, Illinois, 60604 to consider whether the proposed Fifth Third Bank overdraft fee class action settlement is fair, reasonable, and adequate.

    The reason we are not getting any of the money is because they paid it out to to the attorney’s and the person who filed the lawsuit, along with everyone who had to deal with this lawsuit.

    Wow, really Sterling? There was a $9.5M award of which the attorneys are getting $3M and the lead Plaintiffs are getting $1000 each.
    At last count they had 100,000 claims, not all of which will be valid, that will divide the remaining $6.5M.

    I received the initial notice and eagerly followed through because I have had my share of what I believed were unfair overdraft fees.
    I spoke to a gentleman on the phone several months ago because I had not heard anymore re the suite.
    Will someone PLEASE help me with this follow through.
    I just had another issue with 5/3,. They have something called “Easy Access” which is the ability to advance yourself money, they take it off the top of your auto deposit. I have $700.00 tied up, and was JUST told that I cannot get it because of some “probation period” I will have to wait to see if I am able to get that back, if not I have no money for rent. I am on SSDI, that is 1/2 of my monthly income.!!!
    Will someone please help me re the suite, I want to change banks but am tied up with this other situation.

    When I learned that I had over 500.00 in overdraft fees I was so shocked. I had my payroll check and decided to go else where to get it cashed because I did not want the bank to take it. I had bills to pay and I knew something was not right. No one would cash my check. It was as if the bank had influnce everywhere I tried. I ended up at 5/3 . By the time they were finished I had a few bucks left and I could not pay my bills or buy food and I told them of the hardship it was causing.All I got was a smile and I’m sorry. I can truthfully say that if the employee at the bank had held a gun to my head and robbed me I would not have felt any different. It is a shame and disgrace.I am so sorry for everyone who suffered and worse . Will we get our money?who can we put faith in ?

    I am very anxious to receive my “fair” portion of the settlement; I’m sure it will be a membership to the “Jelly-of-the-Month” club.
    The important thing is the ATTORNEYS get their obscene amount of money.

    Like always cooperate America makes money off of the poor who truly suffered. My wife and I were driven to homelessness yet make sure the attorneys get their money . It should be against the law or at least let all of us theft have been screwed in this and many more class action suits file suit on those who prosper from the underclass that actually were hurt . Why don’t public defenders that we elect handle these cases so the true plaintiffs are awarded not those who are just getting richer and richer it is sickening people who prey on the poor have no feelings and I hope each and everyone is stricken with ……….. Well we all know what I mean. A special place is waiting them all I hope they all enjoy the pain and suffering they actually make worse by letting everybody see they screwed us worse than initially suffer

    Well my check got mailed to the wrong address and Ive done everything i was suppose to.. Now everytime i talk to someone about my check all they say is its being processed if you dont get it in two weeks give us a call back… I AMOST WENTT JAIL FOR COLD CHECKS… I WANT MY MONEY!!
