Farallon, Red Bicyclette, Redwood Creek, Rex Goliath, Talus, Turning Leaf or Woodbridge by Robert Mondavi Brand French Pinot Noir Wine Class Action Lawsuit Settlement

If you bought Farallon, Red Bicyclette, Redwood Creek, Rex Goliath, Talus, Turning Leaf or Woodbridge by Robert Mondavi brand French Pinot Noir wines, you could get a payment from a class action settlement.

A class action settlement has been reached in a class action lawsuit against E&J Gallo Winery, Constellation Brands, Inc., Constellation Wines U.S., Inc. (collectively, “Defendants”) in the Superior Court of California, Los Angeles County (entitled Zeller v. E. & J. Gallo Winery, et al., and Constellation Brands, Inc., et al., No. BC432711) alleging, among other things, that Defendants mislabeled certain French Pinot Noir wine that allegedly contained less of the pinot noir varietal than required in order to be labeled “pinot noir” when it was sold to consumers in the United States, according to the Farallon, Red Bicyclette, Redwood Creek, Rex Goliath, Talus, Turning Leaf or Woodbridge by Robert Mondavi Brand French Pinot Noir Wine class action settlement notice.

You are reportedly a class member in this settlement if you purchased one of the following wines in the United States before December 2, 2011 with a label that identifies the wine as pinot noir from France, Pays d’Herault, or Languedoc-Roussillon:

  • Farallon Pinot Noir 2006
  • Red Bicyclette Pinot Noir 2005
  • Redwood Creek Pinot Noir 2005-2007
  • Rex Goliath Pinot Noir 2005-2008
  • Talus Pinot Noir 2005-2007
  • Turning Leaf Pinot Noir 2006
  • Woodbridge by Robert Mondavi Pinot Noir 2005-2008

except that you cannot be in the class if you are part of the Court, or are one of the lawyers or settlement administrators in the case, or are a person or entity (such as a bar, restaurant, retail store, or distributor) who purchased any of the wines for resale.

Under the proposed Farallon, Red Bicyclette, Redwood Creek, Rex Goliath, Talus, Turning Leaf or Woodbridge by Robert Mondavi Brand French Pinot Noir Wine class action settlement, settlement class members who submit timely and valid evidence of a purchase of the wines at issue, may become entitled to claim reimbursement of the price actually paid for that wine (not including taxes). Settlement class members who do not have adequate evidence of purchases, may still become entitled to claim reimbursement, but only at the rate of $3.50 per bottle purchased up to a collective total of $10.50. This $10.50 maximum would apply to all purchases of any combination of qualifying French vintages of Group 1 Wines (Farallon Pinot Noir 2006, Rex Goliath Pinot Noir 2005-2008, Talus Pinot Noir 2005-2007, Woodbridge by Robert Mondavi Pinot Noir 2005-2008), and it would also apply separately to all purchases of any combination of qualifying French vintages of Group 2 Wines (Red Bicyclette Pinot Noir 2005, Redwood Creek Pinot Noir 2005-2007, Turning Leaf Pinot Noir 2006).   If you are a settlement class member, you can get payment by making an approved claim by May 24, 2012.

The Court will reportedly hold a hearing on April 23, 2012, at 1:30 p.m. to consider granting final approval to the settlement.

    Dear Sir ,are the other rex goliath wines safe to drink or which ones other than moscato
    wine are safe ,please give me a list of their other wines that are safe. thanks
