Court Preliminarily Approves Settlement of Stewart v. Ericsson Class Action Lawsuit Over Aircom Implemenation Manager Employee Overtime Pay.
An overtime pay class action settlement of a lawsuit against Ericsson Communications, Inc. Aircom International, Inc. d/b/a Aircom Contractor Services, and Dixie De La Rosa (collectively “Ericsson” or “Defendants”) has reportedly been given preliminary court approval. The class action law suit, styled Stewart v. Ericsson Communications, Inc., Case No. CV 12-6272-PJH, was filed in the United States District Court for the Northern District of California and reportedly alleges claims under, among other things, California wage and hour laws and regulations.
The Ericsson Aircom wage and hour settlement class reportedly includes, unless otherwise excluded, all current or former employees who are or have been employed by AIRCOM, International Inc. in the position of implemenation managers and/or substantially similiar positions, in California at any time from the four years prior to the filing of the class action through the date of preliminary approval of the Ericsson Aircom settlement.
The Ericsson Aircom overtime pay settlement reportedly provides that Ericsson will pay $400,000 into a Settlement Fund to fund the Settlement. Ericsson Aircom settlement class members who submit valid claims reportedly will be paid under the settlement based on the number of work weeks actually worked for Defendants in California during the specified time period.
