Elite Model Management Corporation (“Elite Model” or “Defendant”) has reportedly agreed to a proposed settlement of an employment class action lawsuit against Elite Model Management in the United States District Court for the Southern District of New York (styled as Dajia Davenport v. Elite Model Management Corp, Case No. 1:13-cv-01061 (S.D. NY) alleging, among other things, that Elite Model misclassifed employees as interns to allegedly avoid paying wages and overtime pay to these workers, purportedly in violation of Fair Labor Standards Act (“FLSA”) and the New York Labor Law, according to various news reports.
The Elite Model Unpaid Internship settlement class reportedly includes certain individuals who served as unpaid interns for Elite Model Management Corporation or any of its subsidiaries.
The Elite Model Unpaid Internship class action settlement reportedly provides for a settlement fund of $450,000. Elite interns who wish to join the class action can reportedly opt in to recover approximately $175 for each week interned, with a reported minimum of approximately $700 for 4-week internships. The settlement was preliminary approved by Judge Alison J. Nathan. A final settlement hearing is scheduled for May.
