A class action settlement has been reached in a class action lawsuit against Defendants Provide Commerce, Inc. (“Provide Commerce”) and Regent Group, Inc. d/b/a Encore Marketing International (“Defendants”) in the United States District Court for the Southern District of California (styled In re EasySaver Rewards Litigation, Case No. 3:09-cv-02094-AJB (WVG)), alleging, among other things, that persons were enrolled in various Membership Programs and charged membership fees without their knowledge or consent and did not receive confirmation of their enrollment, according to the EasySaver Rewards, RedEnvelope Rewards, and Preferred Buyers Pass Membership Program Class Action Settlement Notice.
EasySaver Rewards, RedEnvelope Rewards, & Preferred Buyers Pass Membership Program settlement class members reportedly include all persons who, between August 19, 2005 and June 26, 2012, placed an order with a website operated by Provide Commerce, Inc. and were enrolled by Regent Group Inc. dba Encore Marketing International, Inc. in the EasySaver Rewards, RedEnvelope Rewards, or Preferred Buyers Pass Membership Programs. Under the settlement, the Provide Commerce, Inc. websites reportedly include ProFlowers.com, RedEnvelope.com, CherryMoonFarms.com, SecretSpoon.com, and Berries.com also known as Shari’s Berries.
As part of the proposed EasySaver Rewards, RedEnvelope Rewards, & Preferred Buyers Pass Membership Program Settlement, all Class Members will automatically be sent by email a $20 credit valid for a future on-line purchase of merchandise at ProFlowers.com, RedEnvelope.com, Berries.com, and CherryMoonFarms.com. Under the settlement, Defendants will also collectively pay a total of $12.5 million to be used to pay fees and costs, including claims administration fees and costs, Class Counsel’s fees and costs, and Named Plaintiffs’ enhancement awards for serving as class representatives.
A Class Action approval hearing has been scheduled for January 25, 2013, at 1:30 p.m. before the Honorable Anthony J. Battaglia in Courtroom 12 of the U.S. District Court for the Southern District of California, 940 Front Street, San Diego, California 92101-8900.

We were unknowing enrolled in this program in May of 2009 – because the original charge did not occur on the same date as the Pro Flowers purchase, I never linked them together and assumed it was an App charge for my husband’s phone – it wasn’t until Nov 2011 that I figured out what this was and all they would refund was 2 months worth of charges! Total ridiculous! I have learned my lesson that if I’m not sure what the charge is for, to at least “google” it and see if I can figure it out!
