If, at any time from December 4, 2006 through September 17, 2009, you received, at any EagleRider location, a paper receipt of any kind for the rental of a motorcycle from EagleRider or any of its affiliates or franchisees, a class action settlement may affect your rights.
A class action settlement has been reached in a class action lawsuit against EagleRider, Inc. (“EagleRider” or “Defendant”) in the United States District Court for the Northern District of Illinois (styled Yoav Yaakoby v. EagleRider, Inc., Class Action Case No. 1:09-cv-05772) alleging, among other things, that EagleRider violated the Fair and Accurate Credit Transactions Act, 15 U.S.C. § 1681c(g), (“FACTA”) by providing electronically printed receipts for customers who rented a motorcycle with a credit or debit card and which receipt displayed more than the last five digits of the customer’s credit or debit card account number, or the credit or debit card expiration date, according to the EagleRider FACTA Credit & Debit Card Receipt Truncation class action lawsuit settlement website.
EagleRider FACTA Credit & Debit Card Receipt Truncation settlement class members reportedly include, unless otherwise excluded, all persons who, from December 4, 2006 through September 17, 2009, received, at any EagleRider location, a paper receipt of any kind for the rental of a motorcycle from EagleRider or any of its affiliates or franchisees.
Under the proposed EagleRider FACTA Credit & Debit Card Receipt Truncation class action settlement, EagleRider will reportedly provide the following settlement benefits to each Settlement Class who submits a valid Claim Form will be entitled to a one-time grant of one of the following Benefit Options A or B or C:
Benefit Option A. If a Settlement Class Member submits a Qualifying Claim Form and selects Benefit Option A, he or she will be entitled to receive a single, one-time motorcycle rental discount, to be reflected in a secure coupon issued for a single use at EagleRider locations. The discount will consist of 15% off rack rate time and mileage charges for single day rental, or a 4th consecutive day free rental immediately after a 3-day rental at rack rate time and mileage. Benefit Option A will be fully transferrable to “First Responders” (defined as current or veteran police, fire, emergency, or military personnel with appropriate identification to establish that fact). Benefit Option A will be valid for a one-year period after issuance, subject to the availability of motorcycles at a particular EagleRider location, and cannot be combined with any other discount or offer.

Benefit Option B. If a Settlement Class Member submits a Qualifying Claim Form and selects Benefit Option B, he or she will be entitled to receive a single, one-time motorcycle purchase discount, to be reflected in a secure coupon issued for a single use. The discount will consist of $100 off the purchase price of a used motorcycle from JC Bromac, FOB EagleRider corporate locations in Los Angeles, California, San Francisco, California or Fort Lauderdale, Florida, subject to JC Bromac’s then-current standard terms and conditions. Benefit Option B will be fully transferrable to “First Responders” (defined as current or veteran police, fire, emergency, or military personnel with appropriate identification to establish that fact). Benefit Option B will be valid for a one-year period from issuance, subject to the availability of motorcycles at a particular location, and to a maximum of 500 motorcycles for the class as a whole, and cannot be combined with any other discount or offer.

Benefit Option C. If a Settlement Class Member submits a Qualifying Claim Form and selects Benefit Option C, he or she will be entitled to receive one (1) free EagleRider Cloth Patch. Benefit Option C will be available for a one-year period, subject to availability and a maximum of 10,000 patches for the class as a whole, and cannot be combined with any other discount or offer.
A class action settlement Fairness Hearing is scheduled for 10:00 a.m. on September 1, 2011 before the Honorable Nan R. Nolan, Courtroom 1858, at the U.S. District Court for the Northern District of Illinois, Eastern Division, Everett McKinley Dirksen United States Courthouse, 219 South Dearborn Street, Chicago, Illinois 60604 at which time the Court will reportedly consider whether the EagleRider settlement is fair, reasonable, and adequate to the Class, and also consider Class Counsel’s request for an award of attorneys’ fees and expenses.
