Drizly, LLC (formerly known as Drizly, Inc.) and The Drizly Group, Inc. (collectively “Drizly”) have reportedly agreed to a class action settlement of a data breach lawsuit filed in the United States District Court for the District of Massachusetts, styled Barr v. Drizly, LLC, Case No. 1:20-cv-11492 (D. Mass.), alleging, among other things, that Drizly, a company which operates an online ecommerce platform that facilitates the delivery of alcoholic beverages from local retailers, failed to implement reasonable data security measures to protect consumers’ personally identifiable information and, as a result of a data intrusion security incident that Drizly made public on July 28, 2020, in which an unauthorized party accessed certain personally identifiable information of Drizly’s customers (the “Data Breach”), Plaintiffs and Class Members experienced or have been exposed to fraud and identity theft, and have otherwise been injured.
The Drizly class action lawsuit reportedly asserts claims for negligence, negligence per se, breach of implied contract, unjust enrichment, and various consumer protection claims under the laws of Massachusetts, New York, Arizona, and California. Drizly has reportedly denied that it violated any law and disputes Plaintiffs’ allegations.
Who Is Included In The Drizly Data Breach Class Action Settlement?
The Drizly Data Breach class action settlement reportedly includes, unless otherwise excluded, the following settlement class:
All Persons in the United States whose customer data was compromised in the data intrusion security incident that Drizly made public on July 28, 2020, in which an unauthorized party accessed certain personally identifiable information of Drizly’s customers (“Data Breach”).
What Settlement Benefits Does The Drizly Class Action Lawsuit Settlement Provide?
Under the Drizly class action lawsuit settlement, Drizly has agreed to pay no less than $1,050,000 and no more than $3,150,000 in cash and provide up to $447,750 in credits against Drizly’s service fee for orders placed through its platform for the benefit of the proposed Settlement Class.
Drizly settlement class members who submit a timely and valid Claim Form will reportedly receive an individual cash payment in the amount of $14.00 (which may increased or decreased proportionally depending on the number of claims that are approved). Claim forms must be submitted online or received via mail by July 28, 2021.
Drizly settlement Class Members will also reportedly receive a $1.99 credit against Drizly’s service fee for orders placed through its platform (which may be decreased proportionally depending on the number of claims that are approved).
Under the settlement, Drizly also reportedly agreed to adopt or maintain certain data security measures for a period of no less than two years.
