Dollar General Corporation, Dolgencorp, LLC, and DG Retail, LLC (“Dollar General”) have reportedly agreed to a class action settlement of a lawsuit filed against them in the the United States District Court for the Western District of Missouri, styled In re: Dollar General Corp. Motor Oil Marketing and Sales Practices Litig., Master Case No. 16-02709-MD-W-GAF, MDL No. 2709.
The Dollar General motor oil class action lawsuit reportedly alleged, among other things, that Dollar General’s DG Auto motor oil sold between 2010 and 2017 was considered obsolete (i.e., that it was unsuitable, harmful, and ineffective as a motor oil for automotive engines made after 1988 in the case of DG Auto SAE 10W-30 and 10W-40 and after 1930 in the case of DG Auto SAE 30) and that plaintiffs were allegedly misled by Dollar General’s labeling and placement of the DG Auto motor oil in the store which caused them to buy the DG Auto motor oil believing it was suitable for use in their automobiles. Dollar General reportedly denied these claims.
Who Is Included In Dollar General Motor Oil Class Action Settlement?
The DG motor oil class action settlement reportedly includes, unless otherwise excluded, the following as settlement class members:
All Persons in the United States who, between September 1, 2010 and December 31, 2017, for personal use and not for resale, purchased Defendants’ DG-branded motor oil, DG SAE 10W-30 (SF specification) and/or DG SAE 10W-40 (SF specification) for use in vehicles manufactured after 1988, and/or DG SAE 30 (SA specification) for use in vehicles manufactured after 1930.
What Settlement Benefits Does The Dollar General Class Action Lawsuit Settlement Provide?
The Dollar General class action settlement reportedly provides, among other things, that Dollar General will pay a maximum of $28.5 million dollars in the aggregate and on a claims made basis to Settlement Class members who submit valid claim forms for Refund Benefits and Property Damage Benefit claims.
Settlement class members can seek partial or full refund benefits: (1) Settlement Class Members who purchased the DG Auto motor oil Products but do not have Proof of Purchase may submit a Claim Form for Partial Refund Benefits of $1.68 per quart of DG Auto motor oil purchased up to 10 quarts (a total of up to $16.80); or (2) Settlement Class Members who purchased the DG Auto motor oil Products and have Proof of Purchase may submit a Claim Form for Full Refund Benefits of the actual amount paid for the DG Auto motor oil purchased.
Settlement class members can also seek reimbursement for property damage incurred as a result of using the DG Auto motor oil in a motor vehicle built after 1988 if 10W-30 or 10W-40 specification motor oil was used or after 1930 if SAE 30 motor oil was used. The cash amount of the property damage benefits depends on whether the claimant submits an affidavit from an ASE-certified mechanic.
Refund Benefits Claim Forms must be submitted or mailed no later than June 8, 2021, while Property Damage Benefits Claim Forms must be submitted or mailed by August 23, 2021.
In addition, Dollar General has reportedly agreed to stop selling obsolete motor oil under its DG Auto label and to add additional oversight to the quality and labeling and packaging requirements for its automotive products.
