Discover Financial, Saturday Holdings & United Marketing Group UMG Discount Membership Program Class Action Lawsuit Settlement

If you were enrolled in certain discount membership programs between January 1, 2005 and June 14, 2011, you may be part of a class action settlement.

A class action settlement has been reached in a class action lawsuit against Discover Financial Services, Inc., DFS Services LLC, Discover Bank (hereinafter, “Discover” or “Discover Financial”), (b) Saturday Holdings, Inc., LegalClub.com, Inc., Legal Club of America Corporation, Brett A. Merl (hereinafter, “SHI” or “Saturday Holdings”), and (c) United Marketing Group, LLC (hereinafter, “UMG”) (collectively, “Defendants”) pending in the United States District Court for the Northern District of Illinois (styled Mc-K Sales, Inc., and Cantina 1134, LLC v. Discover Financial Services, Inc., et al., Class Action Case No. 10-cv-2964) alleging, among other things, that plaintiffs were improperly enrolled in, and charged for, certain membership programs with United Marketing Group UMG (e.g., Merchant Technical Solutions, Business Advisor, and Tech Experts plans)  and/or Saturday Holdings SHI (e.g., Merchant’s Discount Health Plan, Merchant Services Protection Plan, and the Business Technical Care Plan) and billed for these membership programs either through their Discover network merchant accounts or their bank accounts, according to the Discover Financial, Saturday Holdings & United Marketing Group UMG Discount Membership Program class action settlement notice.

The class covered by the Discover Financial, Saturday Holdings & United Marketing Group UMG Discount Membership Program settlement is reportedly defined as follows:

 all businesses that were enrolled in a Membership Program (as defined below) between January 1, 2005 and June 14, 2011 (the “Settlement Class”). As used herein, a “Membership Program” means (i) the Merchant Technical Solutions, Business Advisor, and Tech Experts plans offered by UMG to both Discover and other business merchants, and (ii) the Merchant Service Protection Plan, the Business Technical Care Plan, and the Merchant’s Discount Health Plan offered by SHI to Discover merchants (the “Settlement Class”)..

The Discover Financial, Saturday Holdings & United Marketing Group UMG Discount Membership Program class action settlement reportedly provides that Defendants will pay a maximum of $6 million ($6,000,000) for (i) valid claims submitted by Settlement Class members, (ii) notice to the Settlement Class, (iii) administrative costs of the settlement, (iv) Settlement Class Counsel’s attorneys’ fees and costs not to exceed $900,000, and (v) incentive awards to the Plaintiffs for their effort in bringing the Litigation in an amount not to exceed $2,500 for each plaintiff.

Settlement Class members are reportedly entitled to submit one of two types of claim forms, but not both:

1. Settlement Class members that complete and submit a timely and valid claim declaring under penalty of perjury that neither they nor an employee/agent ever authorized enrollment in Membership Programs for which they were charged, can receive $15 for each such Membership Program, up to total maximum recovery of $45.

2. Settlement Class members that complete and submit a more detailed, timely, and valid claim, also signed under penalty of perjury, demonstrating that neither they nor an employee/agent ever authorized enrollment in Membership Programs for which they were charged may recover the amount of monthly membership fees, net of any prior refunds, up to a maximum of $150 for each such Membership Program, up to a total maximum recovery of $450. If any one of the Defendants disagrees that a claim should be paid, it will be submitted to a third-party neutral for a final ruling. In resolving a disputed claim, the third-party neutral may in his or her discretion consider the claim and any evidence, documents, or recordings submitted by the claimant or any of the Parties.

    These people are nothing but thieves. If they still have anything but their pulses by the time you’re done with them, you have not done enough to them. Nobody scams you and then responds to a complaint by saying “we have our own lawyers, you know”. Nobody responds to the Better Business Bureau when you’re accusing them of stealing 1,100 dollars from you that “the amount is question is only 1,063 dollars, and thus the plaintiff is lying”. Bust them and bust them hard.

    They are still at it. The employees at MDHP and Discover are complicit at ripping off their fellow Americans.

    The call they played for me was not complete. Clearly fraudulent (aside from the fact the very concept is only technically legal and intentionally misleading).

    I’ll be dropping the Discover Card acceptance because of this.
