Discover Class Action Settlement of Steinfeld v. Discover Financial Services TCPA Lawsuit Over Autodialed and Prerecorded Calls and Text Messages To Cell Phones

If you received a non-emergency telephone call or text message from Discover Financial Services, Discover Bank, The Student Load Corporation or Discover Home Loans that was made using an automatic telephone dialing system or an artificial or prerecorded voice without your prior express consent, you may be eligible to receive a payment from the Steinfeld v. Discover TCPA Class Action Settlement.

Discover Financial Services, DFS Services LLC and Discover Bank (collectively “Discover” or “Defendants”) have reportedly agreed to a proposed settlement of a class action lawsuit against Defendants in the U.S. District Court for the Northern District of California (styled as Andrew Steinfeld v. Discover Financial Services, et al. Case No. 3:12-cv-01118-JSW) alleging, among other things, that Discover Financial Services, Discover Bank, The Student Loan Corporation and Discover Home Loans made calls to cell telephones using an automatic telephone dialing system or an artificial or prerecorded voice without the prior express consent of the called parties, purportedly in violation of the Telephone Consumer Protection Act (“TCPA”), 47 U.S.C. § 227, according to the Steinfeld v. Discover TCPA class action settlement notice.

The Steinfeld v. Discover TCPA settlement class reportedly includes, unless otherwise excluded, all  persons to whom Discover Financial Services, Discover Bank, The Student Load Corporation or Discover Home Loans placed a non-emergency telephone call to their cellular telephone using an automatic telephone dialing system and/or an artificial or prerecorded voice between November 30, 2007 and September 10, 2013.

Discover has reportedly agreed to the creation of an $8.7 million settlement fund from which class members can file claims to recover payments (estimated to be between $20 and $40).  Class members can file claims online at steinfeldtcpasettlement.com

    3:12-cv-01118-JSW. they have called my home so many times that I cannot count. It sounds like someone may be trying to get a call through Mars or somewhere out of space. very annoying when they call early andlate at night! Thank you!

    I dont know how many times they called with different phone numbers, I quit answering my phone because I didnt recognize the phone numbers

    they call my cell day and night i dont know where they got my pcell number they even put a rcoded message.Itgot me very depressed i even take depressants meds overthis .itold them and send a disbled letter to them because im disabled for life now that the disablity told me to tell them you are disabled they cant be botheing or harring you its illgal

    Although I asked several times not to be called, the calls continued. I received so many calls that eventually, I refused to answer my phone when I saw that they were calling.

    I was a victim of do not calls from them years ago as well…do these banks think they can just use their power and harrass people over and over when its convienent for them?
    I would love to claim some funds back…put me on that list…

    They would call me all the time. I had even tried putting them on do not call list. But it didn’t work they still called.

    I HAVE A “DO NOT ANSWER” ON MY CELL PHONE AND I DO NOT ANSWER WHEN THAT NUMBER COMES UP. PUT ME ON THE LIST.

    My wife and I have received so many calls that unless we recognize the call as a local number or one of our doctors we don’t answer even though some of the calls we have missed have been important. It has been almosst enough to make one have a nervous breakdown.

    My number was unlisted and they still called. Their collection practices were also way below the waistline causing me so much aggrevation I sought legal advise to help stop them.

    I asked repeatedly not to be called and finally I just do not answer calls unless I know the number. Also a person cannot get into your phone call number – it just keeps repeating.

    My number has always been unlisted and they will continue to have these automatic machine call my number all times of the day and also night. Total harassment! I told them I was going to contact BBB

    Though i can understand everyone’s frustration with the harassing calls, i wonder what y’all would think if you were to receive a postcard from Discover offering to settle your debt at 40 cents on the dollar? Well i did, only i didn’t have all the money available, so they told me i could make monthly payments. well, after a couple of months, i got the $$ and i called them to find out the exact balance, and they made as if there never was a deal in the first place! All calls to supervisors went for naught, but THEY have no problem turning this in to collections…
