If You Purchased or Used a DevaCurl Haircare Product Between February 8, 2008 and August 29, 2021, You May Be Entitled to a Payment from a DevaCurl Class Action Settlement.
Deva Concepts, LLC (“Deva”) has reportedly agreed to a class action settlement of a lawsuit filed against it in the United States District Court for the Southern District of New York, styled In re Deva Concepts Products Liability Litigation, Class Action Case No. 1:20-cv-1234, alleging, among other things, that Deva designed, manufactured and sold DevaCurl Haircare Products which allegedly caused certain users to suffer personal injury including hair loss, hair damage or scalp irritation and that certain statements made in connection with the marketing of the DevaCurl Products were allegedly false and misleading.
Deva reportedly denies these allegations and contends that there is no link between hair damage and DevaCurl, and that it did not make any untrue or misleading statements.
Who Is Included In The DevaCurl Class Action Settlement?
The DevaCurl class action settlement reportedly includes, unless otherwise excluded, the following settlement class:
All persons who purchased and/or used any of the Products in the United States between February 8, 2008 and such date that is thirty (30) days after the Preliminary Approval Date [i.e., August 29, 2021].

What Settlement Benefits Does The DevaCurl Haircare Class Action Lawsuit Settlement Provide?
Under the DevaCurl haircare class action lawsuit settlement, Deva has agreed to create a non-reversionary Settlement Fund of $5,200,000 which will be used to pay valid claims, as well as for the costs of notice and administration of the Settlement, Service Awards to the Named Plaintiffs and Attorneys’ Fees and Costs.
$750,000 of the DevaCurl Settlement Fund will reportedly be set aside to pay Tier 1 Claims (a claim for a one-time payment of up to $20 as compensation for claims of personal injury after using the Products and/or for any claim related to the labeling or advertising of the DevaCurl Products, including, without limitation, for alleged failure to warn of potential harm regarding the DevaCurl Products).
The remainder of the DevaCurl Settlement Fund, after payment of costs of notice and administration, Service Awards, Attorneys’ Fees and Costs and Tier 1 Claims, will reportedly be used to pay Tier 2 (Adverse Reaction) Claims (a claim against the Common Fund for significant personal injury including hair loss, balding, and significant scalp irritation as an alleged result of using the DevaCurl Products and reimbursement of actual and documented amounts spent to redress alleged injuries, designed to compensate the Claimant for any alleged injuries sustained, up to a maximum of $18,000 per Claimant for personal injuries and up to a maximum of $1,000 for provable expenses).
In order to receive payments, DevaCurl class members must submit claim forms online or via mail by November 21, 2021.
Under the DevaCurl Settlement, Deva also has reportedly agreed to implement certain label changes to the DevaCurl Products.
