Dell Class Action Settlement Of Class Action Lawsuit Over Dell Inspiron 1150, 5100, and 5160 Notebook Computer Cooling System, Power Supply System & Motherboards

If You Own Or Have Owned A  Dell Inspiron 1150, 5100, or 5160 Notebook Computer, Your Rights May Be Affected By A Class Action Settlement.

A class action settlement has been reached in a class action lawsuit against Dell Inc. (“Dell” or “Defendant”) in the United States District Court for the Western District of Washington (captioned Carideo et al. v. Dell, Inc., Civil Action Case No. 06-cv-1772), alleging, among other things, that Dell acted deceptively in designing, manufacturing, marketing, selling, and servicing the Dell Inspiron 1150, 5100, and 5160 computers because Dell allegedly sold them knowing they contained three common defects that could cause the computers to prematurely fail, including allegedly: (1) inadequate cooling systems (2) a power supply system that prematurely fails when used as intended and (3) motherboards that prematurely fail when used as intended, according the Dell Inspiron 1150, 5100, and 5160 class action settlement notice.

The Dell Inspiron 1150, 5100, and 5160 settlement class reportedly includes the following persons, unless otherwise excluded:

All individuals and entities in the United States who own or have owned a Dell Inspiron 1150, 5100, or 5160 notebook computer.

Under the Dell Inspiron 1150, 5100, and 5160 class action settlement, Dell will reportedly provide a refund to customers who paid for certain Reimbursable Repairs to Inspiron laptop model numbers 1150, 5100, or 5160.

A “Reimbursable Repair” under the settlement reportedly includes any of the following repairs or replacements done by Dell or one of Dell’s Authorized Service Providers (“ASPs”), Banctec or QualxServ, for which the customer paid Dell out-of pocket:

(a) Those addressing clogged vents and/or restricted airflow, including fan repair and/or replacement;
(b) Heat sink replacements;
(c) AC adapter replacements;
(d) Motherboard replacements addressing power failure, shutdown, failure to boot, and/or freezing situations; and
(e) Battery replacements addressing failure to take/hold a charge.

The amount of settlement payments will be based on which model laptop the settlement class member owns or owned, whether the repair was a Reimbursable Repair performed by Dell or an ASP (Banctec or QualxServ), and when the repair took place.

The Court is scheduled to hold a settlement Fairness Hearing at 1:30 p.m. on December 17, 2010 at the United States Courthouse, 700 Stewart Street, Lobby Level, Seattle, Washington 98101 to consider whether the Settlement is fair, reasonable, and adequate.
