A class action settlement has been reached in a class action lawsuit pending against CCA Industries, Inc. (“CCA” or “Defendant”) in the Los Angeles County Superior Court in California (styled Denise Wally, on behalf of herself and all others similarly situated, Plaintiff, vs. CCA Industries, Inc, Defendant, Case No. BC422833), alleging, among other things, that improper statements were contained on the label and in advertisements for a certain CCA product called “Mega-T Ultra” and that such statements violated California consumer protections laws, according to the CCA Industries Mega-T Ultra class action settlement notice.
The CCA Industries Mega-T Ultra class action lawsuit complaint sought damages, disgorgement of CCA’s profits, injunctive relief, and attorneys’ fees and costs.
The CCA Industries Mega-T class action lawsuit settlement reportedly includes as settlement class members all persons who purchased any of the following Mega-T products for personal use during the period September 29, 2005 through June 9, 2010, who are not otherwise excluded: Mega-T Ultra, Mega-T Plus, Mega-T Effervescent, Mega-T Green Tea Dietary Supplement and/or Mega-T Dietary Supplement.
The CCA Industries Mega-T Ultra, Mega-T Plus, Mega-T Effervescent, Mega-T Green Tea Dietary Supplement and/or Mega-T Dietary Supplement class action settlement reportedly provides for substantial changes to the Mega-T label and advertisements and CCA has agreed to fund a “Common Fund” monetary settlement of two million five hundred thousand dollars
($2,500,000.00). All monetary compensation paid to each Settlement Class Member (including an enhancement paid to the Representative Plaintiffs), all costs associated with providing Notice of the settlement, all attorneys’ fees and costs paid to Class Counsel, and the costs associated with administering the Settlement Agreement will reportedly be paid from the Common Fund.
According to the CCA Industries Mega-T class action settlement notice,
If you have a valid receipt or credit card statement:
Each Settlement Class Member who provides a valid receipt or credit card statement showing that they purchased a Mega-T Product will be sent a check in the amount of $10.00 for each Mega-T Product purchased for personal consumption during the Class Period. For example, if you purchased three (3) bottles, you would be entitled to receive a Settlement check for $30.00.
If you do not have a valid receipt or credit card statement:
Each Settlement Class Member who does not have a valid receipt or credit card statement showing that they purchased a Mega-T Product, but who provides a written Declaration, along with other requested information relating to the purchase of the product, via U.S. mail or through the Settlement website, saying that they purchased a Mega-T Product, will be sent a check in the amount of $10.00 for each Product purchased during the Class Period, up to a maximum of six (6) bottles. For example, if you purchased four (4) bottles, you would
be entitled to receive a Settlement check for $40.00.
If the aggregate value of Valid Claims submitted by Settlement Class Members exceeds the amount remaining in the Common Fund after payment of all fees, costs, and expenses, then the amount of reimbursement per bottle reportedly will be adjusted downward pro-rata on a per bottle basis.
If the aggregate value of Valid Claims submitted by Settlement Class Members is less than the amount remaining in the Common Fund after after payment of all fees, costs, and expenses, then, at the Parties’ option in conjunction with consultation with the Court and the Settlement Administrator, the amount of reimbursement per bottle may reportedly be adjusted upward prorata on a per bottle basis up to $20.00 per bottle.
The Court is scheduled to hold a settlement Fairness Hearing at 10:30 a.m. (PDT) on Monday, September 20, 2010, at Superior Court, Los Angeles County, Central Civil West Courthouse, 600 S. Commonwealth Ave., Dept. 309 Los Angeles, CA 90005 to consider, among other things, whether the class action settlement is fair, reasonable, and adequate.

Tried Mega-T Green Tea Dietary Supplement a coulpe of times and to no avail. Which they would have stated the FDA had not made this available and had not shown the results to back it up.
I am very disappointed in myself for not pursuing this product future but I have been taking this product (Mega green-t) for 11 years. Never realized that my condition for about the past 3 years could have been caused by this product. The dizziness, anxiety, heart flutters and loss of sleep have been unreal. It has effected me so that I have problems driving sometimes.I stopped this product last year and felt worse so I started back, still not knowing the harm. I have stopped this product now for 2 months. It has gotten worse but trying to deal with it. I have had CT’s done, hearing test, blood work you name it .
