If you purchased a Carfax Vehicle History Report directly from Carfax, Inc. (“Carfax”) in California, North Carolina, Ohio, Oklahoma, Tennessee, or Texas, you may receive benefits from a class action settlement.
A consumer class action settlement has been reached in a class action lawsuit against Carfax, Inc. (“Carfax” or “Defendant”) in the Oklahoma District Court in Cleveland County (styled Davis v. Carfax, Inc., Class Action Case No. CJ-04-1316L), alleging, among other things, that Carfax and a related company violated consumer protection laws by not properly disclosing terms and conditions for, and limitations of, Carfax Vehicle History Reports, according to a Carfax Vehicle History Report class action settlement notice.
Carfax Vehicle History Report settlement class members reportedly includes customers who purchased a Vehicle History Report directly from Carfax in the United States:
- In Ohio, Oklahoma, Tennessee, or Texas, at any time from October 1, 1998 through December 31, 2007
- In North Carolina, at any time from May 1, 2001 through December 31, 2007
- In California, at any time from February 17, 2002 through December 31, 2007
Under the Carfax Vehicle History Report settlement, Carfax has reportedly agreed to make changes in its disclosures and contracting process with all customers, including Class Members. In addition, each Class Member who remains in the Carfax Vehicle History Report settlement can claim a Settlement Voucher and either use it or transfer it to someone else. A Settlement Voucher can be redeemed for free Carfax Vehicle History reports, or the original recipient of a Settlement Voucher can convert it into $3 in cash. Conversion requests will be handled on a first-come, first-served basis and will be capped at $650,000 in total for Class Members (and, if the Court awards any Settlement Vouchers to counsel for the Class as part of an award of attorneys’ fees, costs, and expenses, for that counsel).
To obtain a Carfax Vehicle History Report Settlement Voucher, you must fill out a Claim Form (which you can get at www.daviscarsettlement.com or by writing to Davis v. Carfax, Inc., c/o GCG, P.O. Box 35026, Seattle, WA 98124-1026) and submit it by February 21, 2013.
The Court will hold a hearing at the courthouse at 200 South Peters Avenue, Norman, Oklahoma on February 21, 2013 at 9.00am to decide whether to approve the Carfax Vehicle History Report settlement and approve any request for attorneys’ fees and incentive awards.
