A class action settlement has been reached in a class action lawsuit against Cadbury Holdings Ltd., Cadbury plc, and Cadbury Adams Canada, Inc. (“Cadbury” or “Defendant”) pending in the United States District Court for the Middle District of Pennsylvania (styled In Re: Chocolate Confectionary Antitrust Litigation, Class Action Case MDL No. 1935) alleging, among other things, that defendants engaged in an unlawful conspiracy to fix, raise, maintain or stabilize the prices of chocolate candy (i.e., chocolate bars and other chocolate confectionery products made by any defendant and packaged to be sold at retail) in violation of federal and state antitrust laws, according to Cadbury Chocolate Candy antitrust class action settlement news reports.
The Cadbury Chocolate Candy Antitrust Class Action Settlement reportedly provides for payment by Cadbury of $250,000 to certain indirect end user plaintiffs and $1,312,500 to certain direct purchaser plaintiffs. Under the Cadbury Chocolate Candy Antitrust class action settlement, Cadbury has also reportedly agreed to provide certain cooperation with the remainder of the litigation against the other non-settling defendants.
