British Airways & Virgin Atlantic Airways long-haul passenger fare fuel surcharge class action lawsuit settlement class members reportedly include the following persons, unless otherwise excluded:
All persons who purchased at least one coupon for long-haul passenger air travel from British Airways for travel on a flight operated by British Airways or from Virgin Atlantic for travel on a flight operated by Virgin Atlantic and the purchase for long-haul travel (a) was in the United States or in the United Kingdom (b) occurred between August 11, 2004 and March 23, 2006, and (c) included a long-haul fuel surcharge that was not refunded.

The British Airways & Virgin Atlantic Airways long-haul passenger fare fuel surcharge class action settlement reportedly provides that British Airways & Virgin Atlantic Airways will refund up to $59,007,273 to members of the U.S. Settlement Classes who submit valid claim forms, with any unclaimed refunds being paid to a charity and will also reportedly refund up to £73,531,076 to U.K. Settlement class Members who submit valid claim forms reportedly will be paid 33.3% of the passenger fuel surcharge they paid on qualifying coupons, which refund payments will range between $7 and $34 per passenger per round-trip ticket purchased in the U.S., and between £4 and £20 per passenger per round-trip ticket purchased in the U.K.
To be eligible to receive a payment, settlement class members reportedly must either: 1) submit their claim online on the Settlement Administrator’s website at www.airpassengerrefund.com on or before December 31, 2012, or 2) complete the a paper claim form and mail it so that it is postmarked by December 31, 2012.
