Briggs and Stratton Class Action Settlement Announced

Class Action Settlement Agreement Announced In Class Action Lawsuit Against Briggs and Stratton Corporation

Briggs & Stratton has entered into a class action settlement stipulation that, if approved by the court, will resolve over 65 class-action lawsuits filed nationwide against Briggs & Stratton and other engine and lawnmower manufacturers alleging, among other things, misleading power labeling on its lawnmower engines, according to a class action settlement news report.

Briggs & Stratton and other settling defendants will reportedly establish a class action  settlement fund totaling $51 million in cash, as well as certain injunctive relief concerning the power labeling of engines for the next ten years and Briggs & Stratton will offer a one year extension of its current warranty for all class members filing a claim.

The Briggs and Stratton class action settlement stipulation has reportedly been submitted to Judge Adelman of the United States District Court for the Eastern District of Wisconsin for preliminary class action settlement approval in In Re: Lawnmower Engine Horsepower Marketing and Sales Practices Litigation, Case No. 2:08-md-01999.

I purchased equipment that was manufactured by Briggs & Stratton. It is the Vanguard 29 HP engine. After 1.5 years of daily problems with the unit and spending thousands of dollars on repairs that were really the fault of defective heads, counsel for Briggs & Stratton stated having 100 engines with the same problem is not a big deal and he could care less if a class action suit was filed. What he didn’t say is that at this time it is not known whether hundreds or thousands of this 29 horsepower Vanguard engine are on the market and whether or not the owners of this equipment have experienced the same problems. What I do know is by their in-actions, they are causing me to close my doors. I have already spoken with counsel and they are preparing a demand letter. If Briggs & Stratton fails to make me whole, I will be filing a lawsuit with several other people and once it hits the newspapers or through discovery, a possible class action suit will be filed. How the Courts allow companies like this to continue to stay in business is beyond me.

I purchased a riding lawnmower that was covered under the class action lawsuit. I have two neighbors who have riding lawnmowers under the action. Neither of us has received any word, and we provided the necessary information to qualify.

I also have a 23HP B&S Vanguard enging It is four years old and has
169.9 Hrs on it. It started blowing oil out of the air breather . I turned it off and took it to my dealer who told me the enging was gone. No warranty

I have been running Briggs 16hp and 18hp commercial engines for 25 years now.In the last few years i have had nothing but bad luck with these motors. These engines have a 2 year warranty.I have one 18 hp vanguard that is only 2 months old and had to have it overhauled due to oil leaks .In the past 2 years i have had several catastrophic engine failures from these motors that are sold by Briggs and Stratton.Briggs is having a overheating problem with their engines and need to own up to this fact.I am tired of wasting my time and money with a company that fails to stand behind the product that they themselves guarantee.
