A class action settlement has been reached in a class action lawsuit against Bell Sports, Inc. (“Bell Sports” or “Defendant”) pending in the Superior Court for the County of San Diego, California (styled Jeffrey M. Card v. Bell Sports, Inc., Class Action Case No. 37-2010-00083292-CU-BT-CTL), alleging, among other things, that Bell Sports violated California law by improperly labeling and selling Taxi and CoPilot Limo brand children’s bicycle seat products with a “MADE IN USA” country of origin designation when doing so was prohibited by statute, according to the Bell Sports Taxi & CoPilot Limo Brand Children’s Bicycle Seat Made In The USA class action settlement notice.
The Bell Sports Taxi & CoPilot Limo Brand Children’s Bicycle Seat Made In The USA Settlement Class is defined as all persons who purchased a Bell Sports, Inc. Taxi or Limo product in California in during the period from January 7, 2006 to March 1, 2012 that bore a “MADE IN USA” or “MADE IN THE USA” country of origin designation.
The proposed Bell Sports Taxi & CoPilot Limo Brand Children’s Bicycle Seat Made In The USA settlement reportedly provides: (i) payment of either $10.00 or $13.00, subject to certain terms and limitations, to every Class Member who does not opt out of the settlement and returns a valid Claim Form, (ii) a permanent injunction against Bell Sports, Inc.; and (iii) an agreement by Bell Sports to pay all costs related to sending the class action settlement notice and of receiving, processing and paying class members’ claims under the settlement. Bell Sports, Inc. also agreed to donate $100,000.00 of new bicycle helmet products (with minimal retail value of $40 per helmet) that shall be given to a charitable organization that promotes, as part of its beneficial charter, the prevention of brain injuries or providing athletic equipment to disadvantaged young people.
Only Class Members who submit a Claim Form postmarked no later than August 10, 2012 will be eligible to participate in the Bell Sports Taxi & CoPilot Limo Brand Children’s Bicycle Seat Made In The USA settlement.
The Court will hold a Final Approval Hearing to consider: (a) whether the tentative Bell Sports Taxi & CoPilot Limo Brand Children’s Bicycle Seat Made In The USA settlement is fair, reasonable, adequate, and in the best interests of the plaintiff class, and (b) whether Plaintiff and his attorneys have fully, fairly and adequately represented the plaintiff class in the action and in negotiating the settlement. The Final Approval Hearing is presently scheduled for August 31, 2012 at 8:30 a.m. in Department 65 of the Superior Court of California for the County of San Diego, Hall of Justice, 330 W. Broadway, San Diego CA 92101.
