(“Defendant”) has reportedly agreed to a settlement of a class action lawsuit filed against itin the United States District Court for the Northern District of Illinois, styled as Evans et al. v. Church & Dwight Co., Inc., Class Action Case No. 1:22-cv-06301 , alleging, among other things, that certain Batiste dry shampoo products marketed by Church & Dwight, Co., Inc. allegedly contained unsafe levels of benzene.

Who Is Included In The Batiste Dry Shampoo Benzene Class Action Settlement?
The Batiste Dry Shampoo Benzene class action settlement reportedly includes, unless otherwise excluded, the following settlement class:
All persons and entities in the United States who, prior to May 30, 2023, purchased one or more of the Bare™ Products or Batiste™ Products for personal, family, or household use and not for resale.
Eligible products under the settlement include: Batiste dry shampoo products marketed by C&D and Batiste’s Bare and Clean & Light Bare dry shampoo products marketed by C&D.
What Settlement Benefits Does The Batiste Dry Shampoo Class Action Settlement Provide?
Under the Batiste settlement, Church & Dwight has agreed to pay $2,500,000.00 into a Cash Settlement Fund that will be used to make Cash Payments to Settlement Class Members who purchased Bare Products, as well as to pay Court-awarded attorneys’ fees and litigation costs to Class Counsel, Service Awards to the Class Representatives, and all Settlement Administration Costs. C&D has also agreed to provide Product Vouchers worth a total of $600,000.00 to Settlement Class Members who purchased Batiste Products (other than BareTM Products).
How Much Money Will Class Members Receive Under the Batiste Dry Shampoo Class Action Settlement?
Batiste shampoo settlement class members who file valid claims may receive the following benefits:
- Cash Payment (with Proof of Purchase): If Proof of Purchase is included, the Cash Payment will be for the full purchase price for as many Bare Products purchased and identified on the Claim Form.
- Cash Payment (without Proof of Purchase): Settlement Class Members who purchased Bare Products, but do not have Proof of Purchase, will be entitled to $2.00 for each Bare Product purchased, for a maximum of five products claimed.
- Product Voucher: Settlement Class Members who purchased Batiste Products, other than Bare Products, and submit a Valid Claim, will receive a Product Voucher for $2.00, per product, for a maximum of five products claimed.
There may be a pro rata increase or reduction to each Settlement Class Member’s amount of their Cash Payment, depending upon the total amount of dollars calculated for Valid Claims in comparison to the Net Cash Settlement Fund. There may also be a pro rata increase or reduction to each Settlement Class Member’s amount of their Product Voucher, depending upon the total amount of dollars calculated for Valid Claims in comparison to the $600,000.00 Voucher Settlement Program.
Some Settlement Class Members may be entitled to a Cash Payment and a Product Voucher if the
Valid Claim is for both benefits.
How Do Batiste Dry Shampoo Settlement Class Members File a Claim To Get a Settlement Payment?
In order to receive a payment under the Batiste dry shampoo settlement, class members must file a claim by the claims deadline.
Batiste shampoo settlement class members may file a claim by submitting a claim online or by printing out and mailing a paper claim form to the Claims Administrator. Class members may also contact the Settlement Administrator to request a Claim Form by telephone, mail or email.
What Is The Deadline To File A Claim in The Batiste Dry Shampoo Benzene Settlement?
Batiste shampoo settlement claim forms must be postmarked or submitted online by November 15, 2023.
When Will Claimants Get Paid Under the Batiste Dry Shampoo Benzene Settlement?
Settlement payments will not be made until after the proposed Settlement is finally approved by the Court, and after appeals (if any) are resolved.
The Court scheduled a Final Approval Hearing on October 16, 2023 to determine whether to give final approval to the Settlement.
