Persons Who Paid for or Received Insurance from AvMed, Inc. at Any Time Through December of 2009 May Be Entitled To Benefits From The Curry v. AvMed Data Theft Privacy Class Action Settlement.
AvMed, Inc. (“AvMed” or “Defendant”) has reportedly agreed to a proposed settlement of a privacy class action lawsuit against AvMed in the U.S. District Court for the Southern District of Florida (styled as Curry v. AvMed, Inc., Case No. 10-cv-24513) alleging, among other things, that AvMed failed to adequately secure and encrypt laptops containing the sensitive personal information (i.e., Names, Addresses Phone numbers, Social Security numbers, Medical History Prescription Records, Medical Diagnoses and Medical Treatment History) of AvMed customers that were stolen while in AvMed’s custody, according to the AvMed Data Theft Privacy class action settlement notice.
The AvMed Data Theft Privacy settlement class reportedly includes two classes. The AvMed premium overpayment class includes, unless otherwise excluded, all current and former AvMed customers who, prior to December 2009, paid AvMed for insurance, and whose Sensitive Personal Information was contained on the laptops stolen during the December 2009 Incident. The AvMed Identity Theft Settlement Class includes, unless otherwise excluded, all current and former AvMed customers whose Sensitive Personal Information was contained on the laptops stolen during the December 2009 Incident, and who suffered Identity Theft and incurred unreimbursed losses as a result.
Pursuant to the AvMed Data Theft Privacy Class Action Lawsuit Settlement, AvMed has agreed to create a settlement fund of $3 million and has implemented certain policies and procedures regarding the security of its members information and data. Premium Overpayment Settlement Class member can claim up to $10 for each year or partial year for which they paid for insurance from AvMed, Inc. (up to a maximum of $30). AvMed Identity Theft Settlement Class members reportedly can file claims (supported by documentated proof) to recover reimbursements for actual unrecovered losses resulting from Identity Theft.
