AT&T DSL Digital Subscriber Line Modem Rebate Class Action Lawsuit Settlement

If you purchased a digital subscriber line (“DSL”) modem from AT&T with a mail-in rebate offer between December 5, 2003 and December 20, 2010, you could be entitled to benefits under a class action settlement.

A class action settlement has been reached in a class action lawsuit pending against AT&T Services, Inc., SBC Internet Services, Inc., AT&T Intellectual Property Management, Inc., AT&T Intellectual Property Marketing, Inc. (collectively “AT&T”) and Moduslink Corporation (all collectively “Defendants”) in the Superior Court for the State of California for the City and County of San Francisco (styled Kendall Gewalt v. AT&T Services, Inc., SBC Internet Services, Inc., Moduslink Corporation, AT&T Intellectual Property Management, Inc., AT&T Intellectual Property Marketing, Inc., Class Action Case No. CGC-07-469792) alleging, among other things, that AT&T and its vendor, ModusLink, deceptively advertised and failed to honor their promises to rebate the price of modems that were purchased by customers in conjunction with DSL service in the State of California from AT&T, according to the AT&T DSL Modem Rebate class action settlement notice.

The AT&T DSL modem rebate class action lawsuit settlement class reportedly includes the following persons, unless otherwise excluded:

All purchasers of a digital subscriber line (“DSL”) modem from AT&T during the period December 5, 2003 to December 20, 2010 for use with their DSL service in the State of California who submitted a rebate claim in connection with their purchase of the DSL modem, and were not paid a rebate within twelve (12) weeks of submission of their rebate claim.

The proposed AT&T DSL Digital Subscriber Line Modem Rebate class action settlement reportedly provides that if settlement class members timely submit Claim Forms and the Claims Administrator determines that they have a valid claim, they will reportedly receive either:

(a) a check equal to the cost paid for the modem plus 10% if they mailed the rebate claim form to AT&T and did not receive the rebate or an equivalent credit; or
(b) a check equal to 10% of the cost paid for the modem if they did not receive the rebate or credit from AT&T within twelve (12) weeks of submitting their rebate claim.

The Court will reportedly hold a Final Approval Hearing on April 8, 2011 at 1:30 p.m. at the Superior Court for the County of San Francisco, located at Department 304, 400 McAllister Street, San Francisco, California 94102 to consider, among other things, whether the AT&T DSL modem rebate class action settlement is fair, reasonable, and adequate.

    Not only did I not get a rebate, but the speed I was billed for was not provided, and when i canceled the account i was not allowed to return the equipment without authorization number and they would not provide the authorization number and now they are billing me for the equipment that they will not let me return. What in the WORLD is wrong with the World. This will go on my credit and there is not a thing i can do.
    Surely I can not be the only person who has experienced this little catch 22.
