Ameriquest Mortgage Lending Practices Litigation MDL Class Action Settlement

A class action settlement has been reached in a class action lawsuit pending against Ameriquest Mortgage Company; AMC Mortgage Services, Inc. (f/k/a Bedford Home Loans, Inc.); Town & Country Credit Corporation; Olympus Mortgage Company (n/k/a Bedford Home Loans, Inc.); and Argent Mortgage Company, LLC. (collectively “Ameriquest”) in the United States District Court for the Northern District of Illinois (styled In Re Ameriquest Mortgage Co. Mortgage Lending Practices Litigation, MDL Case No. 1715, Lead Case No. 05-cv-07097) alleging that Ameriquest engaged in improper mortgage lending and mortgage loan servicing activities in connection with residential mortgage loans originated or serviced by defendants, in violation of federal and state laws, including the Truth in Lending Act (“TILA”), breach of contract, unjust enrichment, and state Consumer Protection and Deceptive Trade Practices Acts, according to the Ameriquest Mortgage  Lending Practices Litigation MDL Class Action Settlement Notice.

Ameriquest Class Action Settlement Update:

The Ameriquest Settlement is subject to final court approval.  According to the Ameriquest Mortgage MDL class action settlement website, as of April 16, 2010 the Court was reportedly still considering several issues related to final approval of the settlement.

    trying to keep AHMSI from foreclosing, been attempting a mod since october. Twenty six months behind and still here. Not sure why Douch bag bank hasnt foreclosed yet. Hope this settlement pays decent, involved in three of the five areas of the suit.

    I was part of the 2004 classaction in California I received aproaxamently 60 some dollars. I am still dealing with these people do to transfers while this was pending in court. Went to Litton Loan servicing to Ocwen at present, as soon as the Law is closing in on these people they transfer trying to keep these morgages.

    The violations keep coming and no one seems to know what to do about this problem.

    1. I was charged excessive brokers fees
    2. charged intrest from signing
    3 Money taking from my equity from reparing the house.
    4. I was to be borrowing 49500. My loan was for over 53000
    I paid close to 3000 in cash. Making this loan for 49500.00 around 56000 that is an added on cost of 6500 dolars for a 49500 loan.
    5, there was a 2 year clusse if I refinanced this loan that would not go below 9.25 percent a penelity.
    6 I was never given the total estamed cost of this loan plus intrest.
    7. never given a copy of this loan at closing, and from January to March Argent held my loan and then told me I had to pay Ameraquest starting April I was not given a chance to refinance just told I had to pay Ameraquest in April. I have this document. By June Iam being told to pay Litton Loan Servicing, I was not behind as seen on my credit reports. This was less tan 2 months later. Litton suposedly held my morgage from June 2004 to Around June of 2011 after I had sent them a letter under the Constitution asking for there right to collect this debt. I received a faulsefied document from them and stopped paying them. I had
    gotten a payment from the California court system about the class action Law suite. In late 2010 settlement.

    Nothing was done with my court records to remove Argent for there Fradulent activity making this a Fradulent Loan.
    Recently Owean has placed information on my morgage after the Federal trade commision informed them as well as all 3 credit bureaurs that this was not a collectable debt.

    I was told to seek help from the free attorneys since the recession I was only making 15000 per year and low income. The atorney refused to do anything for me the same with Comsumer protection here in Pa.

    We have a law protecting wich argent had in with there agrement not to place any insurance but that I chose. I filed nurmouse complaints about Litton Loans and they would not do anything, My insurance was paid and had not lapsed, This was done and an escrow acount was made up and I was charged 600. more than once.
    They paid taxes before they were do to get a foot hold on my property. This was a high intrest loan there are laws governing this also wich no one seems to inforce.

    Litton Loans also did not post payments to morgage account. I paid all of them through Western union. Payments that were registered were not for payments paid. and posted as many as 3 days later.

    I also aplied for a loan modification and was refused, I have heard through internet that no one was given a loan modification from Litton Loans.

    I am also aware that Litton Loans at one point owned a Credit reporting company, and they were using that to force foreclosures by placing insurance and paying taxed not posting payments, and posting payment s late.

    When a loan is deamed fraudlunt why are they not removing this from court houses in wich the loan was ariginated. This is a 40.00 fee and no one has done this.

    I am now trying yet again to get an attorney to do something for me, with the little money I have. I have seen 3 diffrent ones with no help no one wants to deal with the people do to the cost.

    comsumer protection Federal Trade commision, Federal consumer finance as well as the California District court in the class action suit have done nothing to correct this.
