Alltel Class Action Settlement Of FACTA Credit Card Receipt Truncation Class Action Lawsuit

If you received an electronically printed receipt from Alltel in a credit-card or debit-card transaction occurring at an Alltel retail store location between December 4, 2006 and December 10, 2007, or in a credit-card or debit-card transaction involving the purchase of Alltel’s “Phone in a Box” product between December 4, 2006 and March 12, 2008, your rights may be affected by a class action settlement.

A class action settlement has been reached in a class action lawsuit pending against Alltel Communications, LLC (“Alltel Communications” or “Alltel” or “Defendant”) in the United States District Court for the Western District of Pennsylvania (styled Bell v. Alltel Communications, LLC, Class Action Case No. 08-cv-00648) alleging, among other things, that Alltel violated certain requirements imposed by the Fair and Accurate Credit Transactions Act (“FACTA”) by allegedly printing the expiration date of credit and debit cards on receipts during transactions occurring at an Alltel retail store or involving the purchase of Alltel’s “Phone in a Box” product, according to the Alltel FACTA credit card receipt truncation class action settlement notice.

Alltel FACTA class action lawsuit settlement class members reportedly include the following persons, unless otherwise excluded:

All persons who received electronically printed receipts from Alltel at the point of sale or transaction, in a transaction occurring at an Alltel retail store location between December 4, 2006 and December 10, 2007 or in a transaction involving the purchase of Alltel’s “Phone in a Box” product between December 4, 2006 and March 12, 2008, wherein the receipt displayed 1) more than the last five digits of the person’s credit card or debit card number and/or 2) the expiration date of the person’s credit card or debit card.

Alltel FACTA credit card receipt truncation settlement class Members who send in a valid Settlement Claim Certification Form will reportedly be entitled to receive one of the following for each qualifying transaction:

1) A VOUCHER FOR UP TO $5.00 TOWARDS THE PURCHASE OF A WIRELESS TELEPHONE ACCESSORY (EXCLUDING CELL PHONES) OR 2) 100 MINUTES OF FREE WIRELINE LONG-DISTANCE SERVICE.

The voucher is reportedly non-transferable and can be redeemed at any Verizon Wireless retail store within 12 months of activation. The free minutes can reportedly be used on all major carriers within 12 months of activation.

The District Court is scheduled to hold a class action settlement Fairness Hearing on February 16, 2011, at the Court, 700 Grant Street, Pittsburgh, Pennsylvania 15219 to consider, among other things, whether the Alltel FACTA settlement is fair, reasonable and adequate, to decide whether to approve the Alltel FACTA settlement, and to decide the amount of attorneys’ fees and costs to be paid to Class Counsel.
