Adams v. AllianceOne TCPA Telephone Call Class Action Lawsuit Settlement

If You Received a Cellphone or Pager Call from AllianceOne Using An Automatic Telephone Dialing System Between February 8, 2004 and November 30, 2010, Your Legal Rights Could Be Affected by an AllianceOne TCPA Class Action Settlement.

A class action settlement has been reached in a class action lawsuit against AllianceOne Receivables Management (“AllianceOne” or “Defendant”) pending in the United States District Court Southern District of California (styled Christina M. Adams, et al., vs. AllianceOne Receivables Management, Inc., Class Action Case No. 08-CV-0248 JAH WVG), alleging, among other things, that Defendant violated the Telephone Consumer Protection Act (the “TCPA”) by making telephone calls to the Class Members, with an autodialer, or by the use of a prerecorded voice message, and called them without their prior express consent to receive such calls, according to the Adams v. AllianceOne TCPA class action settlement notice.

The AllianceOne TCPA Telephone Call Settlement Class reportedly includes:

All persons within the United States to whom any telephone calls were made by AllianceOne or any of the other Released Parties between February 8, 2004 and November 30, 2010 to such person’s cellular telephone, paging service, specialized mobile radio service, other radio common carrier service or any service for which the called party is charged for the call, through the use of any automatic telephone dialing system which has the capacity to store or produce numbers (whether or not such capacity was used), including, without limitation, an automated dialing machine dialer, auto-dialer or predictive dialer, or an artificial or prerecorded voice, without such person’s prior express consent.

Excluded from the AllianceOne TCPA Telephone Call settlement Class are all officers, directors, and employees of AllianceOne, together with those individuals’ immediate family members, and their respective legal representatives, heirs, successors, and assigns; the officers, directors and employees of any parent, subsidiary or affiliate of AllianceOne, together with those individuals’ immediate family members; Counsel for AllianceOne and Class Counsel and their immediate family members; and those individuals identified by the List of Excluded Numbers.

A Settlement Fund of $9,000,000 is reportedly being established in the AllianceOne TCPA Telephone Call Class Action settlement. This amount will be used to pay any Administrative Expenses, Court-approved attorneys’ fees and costs, Class Representatives’ Awards, and other expenses. The amount left after paying those lawsuit-related expenses, the Remainder Amount, will be allocated to Class Members that file approved claims according to a Class Member’s pro rata share, not to exceed $40.00 per approved Class Member.

If you are an AllianceOne TCPA Telephone Call settlement Class Member, you must file a claim by August 6, 2012 to receive a settlement award.  There are reportedly three ways to submit a claim under the settlement:

1) You can submit a claim electronically.
2) You can file your claim over the telephone. If you submit a claim by telephone, your conversation will be recorded and you will be required to state under penalty of perjury that the information you have submitted is accurate. If you would like to submit a claim by phone, please call (888) 213-7648.
3) You can print out a claim form and mail it to the address indicated on the form.

    I filled out the paper work for this lawsuit. I called the number and got a recording after finding out the case had been settled, the number is a recording, that says checks had been mailed beginning Feb. 25—My question is “Where is my check?” I followed all instructions and it is May 16 now and I have not received my $40.00. I read on their website other people had gotten theirs as early as March. I would appreciate a e-mail explaining. Thank You
