A class action settlement has been reached in a class action lawsuit against American Home Shield Corporation (“American Home Shield” or “AHS” or “Defendant”) pending in the United States District Court for the Northern District of Alabama, Southern Division (styled Thomas S. Abney and Jennifer Abney v. American Home Shield Corporation, Case No. 09-CV-1018-RDP) alleging, among other things, that American Home Shield AHS, who is engaged in the business of selling, issuing and administering certain consumer service contracts, commonly known as residential service contracts, home protection contracts, home service contracts and/or home warranty contracts, throughout the United States, violated Section 8 of RESPA, 12 U.S.C. § 2607, through its compensation of real estate brokers in connection with the sale of AHS Home Service Contracts, according to the Abney v. American Home Shield Class Action Settlement notice.
For purposes of settlement only, the Court has reportedly certified a class consisting of all persons in the United States who, between May 27, 2008 and March 4, 2011, who purchased a Home Service Contract from AHS (a) with respect to which AHS paid Broker Compensation and (b) where the Home Service Contract was purchased in connection with the purchase or sale of a home in a real estate transaction subject to RESPA. Excluded from the Class are Defendant, its parents, subsidiaries, affiliates, officers, directors and employees; any judge, mediator or arbitrator who has jurisdiction over or will serve in connection with this matter now or in the future, and any member of the family or staff of any such judge, mediator or arbitrator.
Under the proposed settlement, American Home Shield AHS will reportedly make a cash payment to each Claimant who the Claims Administrator, Garden City Group, Inc., determines meets the requirements set forth in the Settlement Agreement for receiving Settlement Compensation, as agreed by Defendant’s Counsel and Named Plaintiffs’ Counsel or as confirmed by the Court, in an amount equaling the Settlement Compensation for the Home Service Contract paid for by such Claimant. The Settlement Compensation for a particular Home Service Contract will be calculated as (a) 2/3 of the actual amount paid by AHS as Broker Compensation with respect to the purchase of a particular Home Service Contract by a Qualifying Claimant, times (b) a percentage equal to (i) the dollar amount a Qualifying Claimant paid for the Home Service Contract that is the subject of such Qualifying Claimant’s Claim for Settlement Compensation, as reflected on the HUD-1 Settlement Statement submitted with the Qualifying Claimant’s Claim for Settlement Compensation, divided by (ii) the total purchase price of the Home Service Contract that is the subject of the Qualifying Claimant’s Claim for Settlement Compensation, as reflected on the HUD-1 Settlement Statement submitted with the Qualifying Claimant’s Claim for Settlement Compensation. If the actual amount AHS paid as Broker Compensation with respect to the purchase of a particular Home Service Contract by a Qualifying Claimant is unknown or cannot be determined without an unreasonable expenditure of time and/or resources, then part (a) of the Settlement Compensation calculation set forth above will be $45.14. In no case shall the amount of Settlement Compensation for any particular Home Service Contract exceed $60.00.

What happened to the original AHS class action that included people from pre-2008 whose claims for first-year “maintenance” issues were rejected even though the system or component was supposed to be covered? It got folded into some other class action. Did it end up combined with this one so those of us with earlier claims lost out?
had problems with some of the companys they send out.
The plan didn’t cover,what was in the plan it said it would
cover older homes.But after you get it, they did not do what what the plan said.
I submitted all documents but was denied or forwarded to another class action by card. Lost card so what do I do now?
I submitted the claim forms timely and received a letter requesting additional information ( some of which I had originally included). I sent the requested info and made a follow-up call to verify that the documents had been received. Was told that the documents had not been received. Again resent the documents, this time by certified mail.
Called to verify receipt of documents and was told that he documents had been received prior and were recorded. However, I am still waiting payment. When I call I have to leave a message and am still waiting for the return call. Has anyone else had his problem?

I received a letter in the mail stating I do not qualify. I’m not sure why I wouldn’t qualify because I purchased a house, and they added on a 1-year American Home Shield contract.
