24 Hour Fitness Health Club Membership Cancellation and Electronic Funds Transfer EFT Class Action Settlement

If You Were Charged Dues Between October 2, 2002 And February 28, 2010 For A Monthly Membership At 24 Hour Fitness On Or After The Day 24 Hour Fitness Received A Notice Of Cancellation For The Membership, You May Be Entitled To Benefits From A Proposed Class Action Settlement.

A class action settlement has been reached with 24 Hour Fitness USA, Inc. in a class action lawsuit filed against 24 Hour Fitness in the U.S. District Court for the Central District of California (styled Daniel Friedman et al. v. 24 Hour Fitness USA, Inc., Case No. CV 06-06282 AHM) claiming that 24 Hour Fitness’ practice of charging for a monthly gym membership by electronic fund transfer EFT after 24 Hour Fitness received a notice of cancellation for the membership violated the Racketeer Influenced and Corrupt Organizations Act (“RICO”), the Electronic Fund Transfer Act (“EFTA”) and state consumer protection laws, according to the 24 Hour Fitness Class Action Settlement Notice.

The 24 Hour Fitness health club membership cancellation and electronic funds transfer EFT class action settlement reportedly provides, among other things, that 24 Hour Fitness will:

  • provide either a payment of Twenty Dollars ($20) or a Three Month Club Access Certificate (entitling Settlement Class Members to use any 24 Hour Fitness Club For three consecutive months (valued At $149.99 To $199.99) for every Claim Form submitted by a 24 Hour Fitness Settlement Class Member;
  • make incentive award payments to each of the named Class Representative Plaintiffs who brought the 24 Hour Fitness class action litigation;
  • pay the total cost for administering 24 Hour Fitness class action settlement;
  • pay Class Counsel’s attorneys’ fees and costs (such payment does not reduce any payment to the  24 Hour Fitness Settlement Class Members);
  • stop collecting dues charges for monthly dues after 24 Hour Fitness receives a request for cancellation or termination of a monthly membership.

    I missplaced the paper work for the settlement and would like to take advantage of the 3 month free membership offered in the settlement. I recieved the notice in the mail but cannot find it. I call the 24 hour fittness location and they said there was a special number that was on the paperwork. They did not have the number so they say.

    I thought you didn’t have to return the paperwork for the membership pass … if I remember correctly, it said you only had to turn in the claim card if you wanted the $20. Let me know if I am wrong.

    I don’t even know where my claim letter is, but I DID NOT mail it back because I wanted the 3months pass so i hope I don’t need to have my claim form in order to still receive or use my 3months pass ….

    I want the 3 month pass but have yet to receive it! It said to NOT return the form if you want to get the pass. The deadline to return the card for a $20 payout was June 18, 2010. Where’s my pass?

    They’re still in court all over this…go to the website, it tells you what they’re doing, the three month cards are still TBD.

    I sent my check in for $20 and am being swept under the rug, typically. After I got out of the Army in 2001 I joined 24-Hour twice within 5 years. (Once, then cancel, then again a year later). Everyone lied…. from the salesmen to the girl at the memebership/finances dept. who ASSURED me before hanging up that my account would not be charged anymore like it was “mistakingly” the first time. My monthly dues were overcharged sporadically with an “oops” response everytime it was brought up… and then both times I was charged an additional month (again, that I was assured would not happen) after leaving the place. It doesn’t surprise me they don’t honor the terms of this settlement. This behavior with this is such a pattern.

      The court has not determined when the settlements will be issued. It has nothing to do with 24 hour fitness. You are not supposed to contact them about it. go to http://www.friedmanclassaction.com/ to get educated about this lawsuit and when you should get your refund or pass.

      Most of all, no one should be sending them $20!

    I got my card yesterday. I don’t remember if I got charged after canceling or not – should I assume that getting a card means that I was? Will I need to verify it at all?

    I also received my 3 month membership certificate today. I was charged an extra month after cancelling but I believe 24 Hr eventually refunded the charge – however this was back in 2006 or so. I didn’t save any of the paperwork. Do I still get to redeem the certificate?

    I made a complaint about my overcharge by phone, I think they kinda “fix it” (their way of course), this happens over 1 yr ago… I haven’t received anything… in fact I just noticed this by reading one of my friends facebook’s postings…. should I call my local 24hrs??? Thank you!!

    I also received my 3 month membership certificate. I can’t remember if I was charged an extra month after cancelling. This was about 5 or 6 years ago and I didn’t save any of the paperwork. Can I still redeem the certificate?

    I also do not remember if I was overcharged when I cancelled my membership. I got my 3 month free pass couple of days ago. I went to my 24Hr club with that and got a 3 month free pass. They asked for PhotoID only, no other proof required.

    I was contacted by a postcard mailing that had the class action suit info on it.
    I have since activated my pass with no hassle. The gym rep said they’ve gotten a few. I was expecting pressure to join up again, but no mention of it. How out of character,eh?

    Hi, I never received my free membership card in the mail… I have the original letter they sent me about the lawsuit, and I never returned the part to get the $20….
    But I definitely never received my free membership card… are they still in the process of sending them out? Is there someone I can call?

    This is really important to me, because 24 cheated me out of 2 months since I moved and they wouldn’t let me cancel my membership (even though I called one month in advance like they said…)
    So please help me out!

    Went in the following day at the Fairfield,CA 24HR Fitness to activate my certificate and was told it was already used that I needed a new certificate #. Called and got a new certificate a couple months later, went in the gym to activate it and was told it was already used AGAIN!! I called to complain if this was a joke and waisting my time…. they said someone will call me back; no call back so I called 2 weeks later and was told someone will call me….it’s been a month now and still no call!!

    Does anyone know about the hours that you can utilize this pass? I tried to go in at 6am this morning and she told me that I was a guest, and could only come during “guest hours”… please advise.

      That kind of response is what leads to another lawsuit. :^)

      This pass is like a get out of jail free card. It allows access to ANY 24 hour fitness club from “Active” to “Ultra Sport” . Next time you go into the club at 6am to workout and are told “Pass is limited to Guest hours only” show them where your paper work/agreement says ACCESS PASS –Valid at any 24hr Fitness Club, then ask where are the exclusions that she mentioned and ask to talk with the club manager, if a no-go ask for the Regional Managers contact info….

    i received my certificates (2) in the mail during a time when i was moving and misplaced them. Just this last weekend my apt flooded forcing to move once again. During the move, i found the certificates. I took them to my 24hr fitness where i am still a current member, but was told it had expired. The sales rep advised me to try to call the corporate office to see if i would still be able to use them. Does anyone know a # i can call or what route i should take. This would help me out a ton since i have 2 certificates…one for me and one for my wife! Thats a total of $180 i could save over 3 months!

    i have yet to recieve my 3 month pass. i did get charged for canceling and it was never refunded which is fine but i did exactly what the paper told me do which is nothing if i wanted the 3 months free & i have yet to see anything. any info??

    I just located my vocher to redeam 3 month pass, and was just told it has expired. The 24 fitness didn’t offer any resolution to, so I don’t know if I have just lost out. Please assit if you can. thanks Natalie N

    I believe their fraudulent practices continue today. The twist they’ve added is that you never get an e-mail confirming the cancellation and when you call them they say “you never cancelled.” Best to [a] send them a registered letter, [b] dispute every monthly cc charge, [c] or cancel the card. Don’t wait to do this …. I’m out $270 so far.
