Verizon Wireless Cell Phone Customer File Class Action Lawsuit Complaint Against Verizon Wireless Over Alleged Unauthorized Charges For “Get It Now” “Get It Now Downloads” and “Data Usage Charges” On Monthly Bills.

A class action lawsuit has been filed against Cellco Partnership d/b/a Verizon Wireless (“Verizon Wireless” or “Verizon”) in the United States District Court for the District of New Jersey (styled Sarah Groggin v. Cellco Partnership d/b/a Verizon Wireless) alleging, among other things, that Verizon improperly charged cell phone customers for unidentified and recurring “Get It Now” “Get It Now Downloads” and/or “Data Usage Charges” on monthly billing statements, according to a Verizon Wireless “Get It Now Download” charge class action lawsuit news report.

The Verizon Wireless “Get It Now Download” charge class action lawsuit complaint reportedly alleges, among other things, violations of the Federal Communications Act, Truth in Billing Act, New Jersey Consumer Fraud Act, unjust enrichment and declaratory relief.

    I have been charged for data downloads (Get It Now Downloads) that were never made. My non-smartphone cell phone was destroyed in late Feb. 2011 and I have not replaced it and yet I continue to be charged for data downloads. For two months now I have received and paid for data downloads on a non-existant cell phone. I could not have “accidently ” downloaded anything because there is no phone! Please help!

      We are 5 months into having to go into our Verizon store and argue for a return of this charge every month. Each month we get a different answer as to why the charge continues to occur and why it keeps being billed again and again. I can see why there is a lawsuit – very frustrating! We also never purchased this in the first place. Two Verizon employees could not even find it anywhere on the phone the first time we were charged.

    Every month my verison bill is padded and every month I have to call and argue to get my bill right. What part of unlimited didn’t I get? I hope these guys have to pay and that all the customers check there bill closely every month. I want my money back. They don’t get customer services either.

    Verizonwireless was already fined by FCC back in 2010 for unauthorized charges related to their Getitnow download. I just discovered that I have been charged $13.47 monthly for the past 9 months for things we never purchased, not even inadvertently. These items were added to our bill since April 2012, and I didn’t get a detailed paper bill and always did autopay in the past. After I called, Verizonwireless was willing to refund me up to six months but the supervisor was not willing to come to the phone. I also just learned that a class action suit has been filed since Feb. 2011. I cannot believe that the company has been scamming its customers on such a wide scale and is still doing it after the FCC fine in 2010 and the class action suit in 2011. I think the company should get a stiffer penalty.
