A securities fraud class action lawsuit has been filed against Mediacom Communications Corp. (“Mediacom Communications” or “Mediacom”) and its board of directors (collectively “Defendants”) in the United States District Court for the Southern District of New York (styled Pease v. Commisso, Class Action Case No.: 10-cv-9263) on behalf of a class consisting of current stockholders of Mediacom (symbol: MCCC), alleging that Mediacom and its board of directors violated federal securities fraud laws, including Section 14(a) of the Securities Exchange Act of 1934 and corresponding Rule 14a-9, in connection with the planned acquisition of Mediacom by Rocco Commisso, according to Mediacom securities fraud class action lawsuit news reports.

RE: Mediacom Service Complaints
On this date 2/16/2023, I Started a service call complaint at 8:15 PM and lasted to 9:10 PM regarding poor download speeds below the contact speed of 300 Mbps. I tested my service with Mediacom speed test two times with a result of 269 Mbps speed when I paid for 300 Mbps. I was told that the speed can drop off by 30% and still be acceptable to my service in which the tested 269 Mbps speed was within the company’s service speed. This extremely below service which I pay for has continued for many months. I have had Medicom tech servicemen out three times before this issue and they continually found different issues as to why my speed is below the speed I pay for under my contract speed. During this call, I requested to speak to a supervisor but I never was allowed to speak to a supervisor. While speaking with the customer service agent I was offered a two-week credit and offered to send a technician out tomorrow. This offer was made by a supervisor that never spoke to me directly but thru the agent, I was speaking with. While still I was talking to the agent I retested my download speed again and it jumped up to 369 Mbps showing that they manipulated my speed back over the 300 Mbps. Interesting that Mediacom advertises and reflect that they provide 20% speed over the contact speed of 300 Mbps in their FCC agreement document. Nowhere did I see in a signed Mediacom contract that Mediacom has the right to provide speed under the purchase and paid for a speed of 300 Mbps.
I request an investigation into this speed manipulation speed during various times during the day. Also, I would like to see whether there is a current class action lawsuit filing covering this issue. If so, how can I add my name to that suit?
