Antitrust Class Action Lawsuit Filed AgainstJohnson & Johnson and Omnicare Over Alleged Conspiracy to Monopolize Drug Supplies to Nursing Homes
A class action lawsuit was filed against Johnson & Johnson and Omnicare in the United States District Court for the Northern District of California (San Fransisco) (Case No. 10-1414 EDL) alleging that Johnson & Johnson conspired with Omnicare, a pharmaceutical consultant and dispensary, to monopolize drug supplies to nursing homes and violate Medicaid laws, according to a class action news report.
The Johnson & Johnson and Omnicare antitrust class action complaint reportedly alleges that approximately 1.4 million seniors were overcharged for drug prescriptions, had extra drugs administered unnecessarily and were unlawfully switched to Johnson & Johnson drugs as part of a conspiracy to increase revenue. The Johnson & Johnson and Omnicare class action lawsuit reportedly seeks restitution, disgorgement, imposition of a trust and punitive damages.

My mother has been in Clare Bridge of Manlius, a facility for Alzheimers and Dementia care. After living there for about 3 months, the facility suddenly informed me that I needed to pay a “Non-Stnd Pkgd Meds” fee of $175 per month because I get my mother’s meds from Express Scripts and not from “Their pharmacy”. When I question the factthat the facility has no pharmacy, they indicated that I would be charged no fee if I purchased my mother’s meds through Omnicare.
