Bikers File Class Action Lawsuit Against HondaOver Alleged Defective Piston Rings And Burning Engine Oil.

A class action lawsuit was filed against American Honda Motor Company, Inc. in the United States District Court for the Central District of California (captioned Paul H. Schumer v. American Honda Motor Company, Inc., Case No. 10-cv-3639-GAF-JEMx) alleging that that the piston rings in certain 2008 and 2009 Honda CBR 1000 RR motorcycles are defective, resulting in the engines burning an excessive and undisclosed amount of oil such that the motorcycles may fail during their useful lifetime, exposing riders to safety risks and repair and replacement expenses, and requiring consumers to purchase more oil than would be required absent the alleged defect, according to class action lawsuit news reports.

The Honda CBR 1000 RR motorcycle class action lawsuit is brought on behalf of a class of all current and former owners and lessees of model year 2008 and 2009 Honda CBR 1000 RR motorcycles originally equipped with the 999cc DOHC liquid-cooled inline four cylinder engine purchased or leased in the United States.

The Honda CBR 1000 RR motorcycle class action complaint reportedly asserts claims for, among other things, violation of the California Unfair Competition Law UCL (Business and Professions Code 17200), the Consumers Legal Remedies Act CLRA (Civil Code 1750), the Song Beverly Consumer Warranty Act (Civil Code 1790) and common law claims for breach of express warranty and unjust enrichment.

    Honda claims 1 quart of oil per 1000 miles is acceptable.I am curious to know what the Califirnia State Board of Emissions would think of all of this burning oil pouring out of CBR exhaust pipes.That does not seem like it would be acceptable for our strict emissions laws in California.Why would a production vehicle consume and expell oil at that rate?The crankcase only holds 3 quarts.

    i have a 2008 cbr 1000 rr and my bike also burns about 2 quarts every 1000 miles. this is horrible and unexceptable. i live for honda and stand for honda but after this im not to sure anymore.

    I burn a little over a half quart about every 400 miles or so. I have had the bike at the dealer about 3 times to document the oil consumption since 3-2008.

    needless to say, mine burns oil like crazy. 1 qt for about 500 miles. Dealer quoted me about $3000 to fix it out of my own pocket. Honda should be seriously punished for this!! Not only it is dangerous to all riders but also bad to our environment.

    My bike is burning a 1.5 qt in 800 miles. It is in the shop now. Honda had the shop perform an oil consumption test and I am now waiting to hear from Honda. The service guy stated that the Honda guys called him and said they are currently showing it to all the Honda techs. Apparently they’ve never heard of this happening. If it doesn’t get fixed for free I’m never buying Honda again. Sad because I love their bikes.

    Changed the oil in the bike today rode it to the dealership and had them document that it was topped off with oil. I’m going to do a 450 mile ride tomorrow and run the sh*t out of the bike like I normally do and stop by the dealership to have them check the oil. Dealer wanted me to bring it back after 1,000 miles and not to check the oil, told them I would like for them to sign a contract that if my motor seizes they’ll give me a new bike. LOL Told them I’ll bring it by after 500 miles should go thru a quart in that time.

      Bonjour à tous.Moi aussi j’ai une honda 1000cbrr 2008 qui a 15000km et probleme de consommation d’huile.Au début du mois de janvier le magasin honda a pris en garantie ma moto .Le travail consiste à déposer le moteur et remplacer les segments .Il faut 8 heures de travail .Honda France a assuré la garantie .Le probleme est bien connu par honda .Mais pour ces motos il n’y a pas eu de rappels,je vous invites à vous battres aupres de votre importateur et votre vendeur.Le probleme des segments serait du à une mauvaise fabrication.Bonne chance .Alain de France

    I have not gone as far yet to be filing a law suit, but at 15,000km i have notice a large consumption of oil in my 2008 CBR1000RR. I took a trip during the summer and in a 4,000km i used 3 liters of oil on the trip. My buddies can see and smell the oil burning from my bike. Sadly my riding season is over now to try using the honda oil in it again as requested by the dealership. But i am looking forward to gathering as much information that i can to arm myself.

    I got the results back from Honda and they said that 1.5 quarts is acceptable. I am going to keep persuing this until I find out how to get them to fix it. Can we use the Lemon law in this case? This will be the last Honda I buy, and I will also encourge friends to stay away. BMW here I come.

    I just got denied by Honda America corp. also. Mine burns over a quart every thousand mile. They said the dealership ran the test their test and does not show signs of defects. I find it ridiculous that their test is a video of the bike being revved freely. I’m sure that’s a good way to measure how much oil consumption is going on. I told Honda rep that doesn’t simulate practical application of the bike. I didn’t buy the bike so I could sit there and rev it. I want to ride it.

    Honda doesn’t want to budge and want to ruin their reputation with their product and their customer service. The bike is under EXTENDED WARRANTY; still they don’t want to honor it. This is the kind of service Honda treats its paying customers. This is my second Honda motorcycle and second issue with them. Looks like they are developing a pattern for a piss poor product and don’t even want to own up to it. I’ll be going back to another brand from now on.

    My 2008 CBR1000RR was not only burning oil, the fuel vent tube under tank, the weld was faulty and causing gas to leak onto engine. American Honda denied there was a problem and after their techs inspected it, did all kinds of tests, were unable to find a leak. It was quite obvious I proved to the owner of the dealership there was a leak, he clearly saw it was leaking but told me Honda told him it was not leaking so regardless if he also didn’t agree with their decision there was nothing he could do. Definitely will never buy Honda product again but Kawasaki is even worse. I do not recommend a Kawasaki as the engineering is even worse than honda. When doing an oil change on most Kawasaki’s, not uncommon for low oil pressure warning light to stay on for several minutes! Also, spacers on ZX10’s are off so front forks end up being bent inwards, causing handling issues like bike pulling to the right, fork seals and bushings to wear out prematurely. Will kawasaki offer a fix? Absolutely not.

      I have the 08 CBR 1000 and I used about 3 qts of oil within 1000 miles. This is the first 1000 I have owned but I do not think it’s suppose to burn that much oil. I have talked to the dealerships here in GA and they claim they dont know anything about the 08-09 CBR 1000 burning oil. LOL yeah right thats what they been told to say I guess huh….

    i have an 08 cbr 1000 as well. i add 75 -85 ml a DAY. unacceptable. honda has never had a consumption problem before from what i have read and been told, and for yall to tell us that ”this is normal, to burn a liter in 1000 miles” i would like my money back, or a new bike please. i love this bike but this is unacceptable.

    I own a cbr 1000 rr 2008 53,000 miles with oil burning issues. When I bought it new they said that was within normal limits after 53,000 miles the engine is now on the brink. I,m now looking at buying a different bike. Huge amounts of black smoke continue and now I think it has fouled up the plugs from the oil leaking into the cylinder, burning and then out of the exhaust causing black smoke.

    I will also add that now a 170 mile trip back and forth to work. I will put in at least 350ml of oil( talk about consumption.) Go green because now I don’t have to do oil changes it just evaporates magically, no more wasting time disposing of oil at the recycling center.. It just goes back into the environment. Go Honda ….. Now I just need a magic oil filter that will last..

    I just bought a 2009 CBR 1000 and am finding out about this oil burning issue and class action lawsuit now. I am not sure as of yet if mine is burning oil or not. If it does, how do I get involved in this lawsuit?

    I have a 2008 CBR1000RR with 1700 miles. I haven’t experienced any loss of oil at all. I only make short trips on my bike, usually between 5 to 25 miles at a time, never more than 50. I’ve rarely ever gotten on the gas, never done any stunts etc. No modifications to the bike other than crash guards.

    2009 Repsol. Burns about 1 quart every 1,000 miles or so. Never had a bike, or any vehicle burn so much. Even my little KLX250 Enduro doesn’t burn any oil.

    Have had Honda as some sort of bike since 8 years old but this is just sad and to say its normal is really ….well…. I’d be too ashamed to say something that stupid.

    this is a old post just only have 4000 miles on my bike and it’s been in and out of the shop blowing black smoke and leaking oil paid for new rings and seals and it’s soon it all over again both time broke bike in slow never went over 6 g just looking for some help or to help with the law suit this has to be taken care of my bike has pretty much in the shop more then i rode it some please lead me in the right direction

    My 08′ CBR1000 burns a quart every 1000 miles. Both the Dealer and Honda say it’s normal and refused to repair the engine/piston rings or give me a brand new engine. I would never purchase another Honda again after this. I have 24,000 miles on the bike as i ride it every day. I followed the break in procedure with Honda oil according to their manual and then switched to Castrol Full Synthetic. I was told by the dealer that a tech bulletin came out saying that only full synth should be used after the break in period. Has anyone ever tried switching back to non synth see what happens? Don’t know what to believe now. I think after this year i will purchase a new bike, but not a Honda.

    So get this, I just bought my 2008 Honda CBR 1000rr last year in Jan 2010. I only had a change to ride it for 600miles, took it into the dealer for the initial maintence and than off to Afghanistan for a year deployment. I come back and do all the regular tune-ups on the bike to ride and put 1k miles on it and find out that the bike burns about 1.5qts of oil in just over 1k miles. The hel*…and my warranty just got up. Though, Honda is allowing me to take it into a location to have it looked at but so far they haven’t said anything about payment… It’s been over two months and my bike still isn’t out of the shop. Thanks Honda! There goes my riding season and back to Afghanistan next year…

    Sorry everyone to hear about your issues. I only wish Honda would just allow me to buy an extended warranty so I feel “safe” if/when I get my bike back (hopefully sometime this year).

    Im sory, but im a certified honda mechanic and these bikes should not burn any oil….. my last 6 honda motorcycles didn’t burn any why is this one allowed??? Its all bullshit folks. My 08 1000 died goin 100 mph on backroads, because in all the years i have owned hondas i have never had to check the oil every 1000 miles, BECAUSE ITS A HONDA…..???? Dissapointed in honda, and i really hope something happens with this lawsuit..

    Just bought a 2010 cbr1000rr June 14th. 920 miles after the first service I burned half a qt of oil. Honda says of course a quart every 1000 is normal. DON’T buy a honda if you use your bike for commuting. You will be putting oil in your bike more than gas.

    I have 2008 cbr1000 and my bike was smoking when I 1st got it and about a yr before my warranty went out I took it to them to fix it and they said they didn’t know what the problem was well a month later it got worse had about 5500 miles on it well I called Honda corp and they told me to take it back to the dealer ship and they fixed it for free under goodwill they said and replaced the rings and had a bent vavle well got it back and 1000 miles later spun a bearing welp called corp again they fixed that took them bout 2 months each time they fixed it got that back and had 2 diff oil leaks they fixed the oil leaks and now with in 2weeks took it back bc it’s still smoking and using lots of oil 2500 miles used 3 quarts and oil light came on took it back and told them and there trying to say it’s my riding and so they did a service on it and told me to bring it back after 500 miles and let them look at it it’s been to the shop 6 times so now I’m getting a lawyer and doin lemon law and will never own a honda ever again I liked Honda until this point

    Mine is burning a quart every 800 miles and that’s with the speedometer off by 10mph so it’s worse than it reads,but I had a Honda rep look at it while he was at my local Honda dealer and of course like everone else he said it’s normal and he would make a note that I brought it in.
    I didn’t know they were still makeing 2 strokes (08 cbr 1000rr)
    This is my first and last Honda purchase ever !!!My bike had 2300 miles on it when I told them about the oil problem.

    I am from Turkey. I have a 2011 CBR 1000RR. It burns a quart every 800 miles. Bike was inspected by Honda Turkey factory staff and consumption was verified. They keep silent ever since. I also filed a lawsuit. Apparently Honda did nothing to fix the issue. Inspected Honda parts fiche and saw that not a single part number involving the piston/rings changed since 2008.

    I own a 2009 CBR1000 Repsol and I purchased this bike when it had only 5000 miles and it has burned oil since the day I bought it. I am burning 1qt. every 800 to 1000 mi. When I get off the bike I smell like burnt oil and black residue all over the swingarm. This can not be good for the environment I have had it to the dealer just this weekend and Honda refuses to do anything about it.

    Just read all of you guys post, and i feel bad. I’m not alone. I have a 2008 Honda Cbr1000rr and i have all the issues that has been stated and some. The dealer has had my bike over five months. For starters the dealer called me once out of all this time to tell me something that i already new because i had just came by the day before. Guess what it was? “We are waiting on two gaskets” before that they just said they have been to busy to get to my bike. Its has been months. Now they are tell me that they found that a piston was damage like they have never seen before so they had to stop and call a engineer from Honda to fly out and to see what happen. Right away i thought that this most be a design flaw. Remember they never called to tell me this, i had to go check on it for myself. So i gave them another week before i went back because they never call to give me an upadated you would think that they would know my face by now. Only to find out that the engineer that came out to take a look at it has come and gone already and didn’t call so the Tech. tells me that he could not find a defect so Honda won’t pay for it. I brought the bike brand new in 2010 did everything according to the manual and protection plan, and they tell me this bull. After all these months! No phone calls! Then the Tech. said himself that he thought its was “Bullshit” that the Honda Certified Tech words out his own mouth, and he told me not to tell anybody. Yeah Right! I going to talk to Honda Customer Relations as so as possible to get to the bottom this crap. Then i will know what next step to take. I don’t even want to ride that bike anymore even if they fixed it. I wouldn’t sell it to anyone either because it is not safe. Honda has let me down.

    2008 CBR1000 NEW BIKE OUT THE DOOR. eats oil from the day i purchased new.
    16,000 MILES, 1 1/2 quarts every 500 miles. Engine has now lost compression. In the the garage, worthless.
    HAVE ALREADY SIGNED UP FOR THE CLASS ACTION LAWSUIT.
    HONDA GOT SOME SERIOUS BALLS TO SAY NOTHING IS WRONG WITH THE 2008 CBR1000.

    I bought an 08 cbr1000rr a couple months ago,I’ve put 2k miles on it and I am on my second full refill of oil! Went to the dealership today and the head mechanic said in 30yrs of working there he’s never heard anything about bad piston rings on any of the cbr1000rr k8&k9. What a joke, I love the cbr’s,I sold my 06 and bought my 08. How do you sign up for this class action suit? Its like buying something from a con artist, you’re burnt. No pun intended.

    I have a 2008 Cbr 1000rr having to add a quart of oil every 500 miles. Called Honda America about this and they told me that they have heard nothing of this before. I told them that is clearly a lie because nearly every 2008 cbr 1000rr there is a class action lawsuit against the wrong piston rings and they claimed that anything on the Internet is a lie. I asked for a superior and have a case manager . She told me the same as the customer service. I then called the local Honda dealer which I purchased the bike 2 months ago and talked to
    Them about the problem. They said they have never heard of this happening. How is that possible a honda dealer and Honda America denying this.

    What is the solution here any ideas? Also tried calling that number Dennis keeps posting and its a busy tone anyone else come across this?

    just bought a 08 cbr 1000rr. bike had 3100 miles on. looks and runs like a brand new bike. I was in love with it…
    I checked my oil a week after buying it. Down a little over a quart…
    called Honda America, told him about my problem… n seems there r a ton of people with same problem. also that there is a class action suit against them, he tells me he never heard of a lawsuit, n there r very few bikes that this happens too, n my bike must’ve been abused! lol, my 5th bike never encountered something like this. shame on u Honda!

    Hey congrats Marc! 1 thing though. .. it’s not the rings . It’s the Nikasil coating. Many people do the Rings themselves, but after awhile they burn oil again. I hope your bike is the exception.

    Guys, I have the same issue. The guy up top said file a claim with NHSA. He is right. But he put the wrong number. It’s 1 888 327 4236.
    If we complain here it doesn’t do much. Call them. They will investigate Honda. They just settled a oil burning suit on they’re 6 cyl engines.
    Only 9 people total filed a complaint with the National Highway and Safety Admin.
    It only takes a minute. Please do it. It will help us all

    I get my 08 cbr1000rr brand new, always taking good care of my bike and after 9K miles star with the black smoke and of course oil is going down everytime I checked it. I call the dealership and they told me to bring the bike so they will check it, but reading all this comments it’s unbelievable, I will first talk with the dealership about the problem before let my bike for who knows how many moths just to tell me that it was my fault!
    Shame on Honda, I will switch to Yamaha and for sure call for the lawsuit.
