Ford Windstar Owners File Class Action Lawsuit Against Ford Motor Company Over Alleged Rusting Of Rear Axle.

A class action lawsuit was filed against Ford Motor Company in the United States District Court for the Eastern District of Pennsylvania (styled Aaron D. Martin v. Ford Motor Company, Case No. 2:10-cv-02203-JHS) alleging that the rear axle on Ford Windstar model years 1999, 2000, 2001, 2002 and 2003, because of its unsealed hallow cylinder design, collects and traps water and other corrosive agents causing the rear axle to rust from the inside out, which renders the Windstar’s rear axle susceptible to failing while it is being operated, according to a class action lawsuit news report.

The Ford Windstar Minivan Rear Axle Rust class action lawsuit complaint reportedly alleges two counts against Ford Motor Company: a breach of implied warranty of merchantability and breach of express warranty.

    I had no idea this was going on until my wife was traveling down the road the other day and the rear axle cracked in half. She got it shut down in time but we had to tow the vehicle to the dealership. Can someone post up the info for the lawsuit?

    I want in this Class Actin Suit as well. My axle just broke for the second time, and FORD doesn’t want to do anything about it. They are telling me that they fixed it once so they can’t fix it a second time. They replaced the first one with a defected one before the first recall even came out.

    I had to have my rear axle replaced just before the recall and have been trying to get reimbursed ever since. The first time I was rejected because they said more information was needed on the receipt from the repair shop, so my husband went to the shop and received a new one. The second attempt I was told (by Ford) that it had to be fixed by them. In march of 2013 Ford sent me a reminder notice about the recall so I sent another request for my refund to which they now claim my car is NOT part of the recall. Lol, talk about getting the run around!

    I am one of the newest victim of the 2002 Ford Windstar failing axle. Last week (July 2015)the axle broke while driving. Ford Corp. said that they will not cover the cost of the repair because I brought my car in for the recall and the recall is now closed for me. At the time of the recall I had no visible rust so Ford put on a bracket to support the axle. All this did was prevent the axle from completely falling to the ground at the point the axle snapped. Ford never addressed the actual problem (the axle) and the only put a bandage on the car. My vehicle was well maintained and garage kept.

    Mine cracked on left side, noise alerted me to the danger. In all the garages and two dealerships as well as 3 vocational automotive shops I have worked in I have NEVER seen a rusted out cracked rear axel. I also worked out of my home on cars running my own shop for decades. The first recall was in my opinion only a poor attempt at postponing the axel failure to a later date. Not a normal failure for a supposed name brand leading automotive maker. Ford would not repair the axel on second recall even though severely cracked! Shame on the NTSB, MASS Attorney General and Ford management!!!

    2003 Ford Windstar .107,000 miles…..Never driven on highway!!!!!!! Rear axle broke….Local .Ford dealers won’t even return my calls.We had to bring it in to McMahon Ford, Norwalk CT for a , ” RE-INSPECTION” of the brackets that were reinstalled to ensure the ” integrity” of the rear axle…IT BROKE”…Rear Right Tire is leaning in and this van is a piece of crap and needs FORD TO FIX IT……We had the van in the shop over a week for them to do a one hour inspection of the brackets..and the axle…..IT SNAPPED…AND , this insopection was doen …… recently…
