A class action lawsuit has reportedly been filed against ExxonMobil Oil Corporation and/or Mobil Exploration and Producing North America, Inc. (hereinafter “ExxonMobil” or “Mobil Oil” or “Mobil” or “Defendant”) in the District Court of Custer County, Oklahoma (styled Weber et al v. Mobil et al., Class Action Case No. CJ-2001-53), alleging, among other things, that Mobil Oil made illegal or unauthorized deductions from royalties paid to class members and intentionally concealed the deductions from class members, in violation of their legal duties, according to the Exxon Mobile Oil & Oklahoma Putnam Oswego Unit Royalty Interest class action lawsuit notice.
The Court has reportedly ruled that everyone, unless otherwise excluded, who fits the following description is automatically part of the Exxon Mobile Oil & Oklahoma Putnam Oswego Unit Royalty Interest Class:
All persons or entities who own or have owned a royalty interest in the Putnam Oswego Unit (“POU”), covering parts of Dewey and Custer Counties in west-central Oklahoma, from the effective date of the POU plan, November 1, 1968 to the present, together with their heirs, legatees, beneficiaries, executors, representatives, successors, and assigns. Also to persons or entities owning or who have owned a royalty interest in a tract included within the POU from which Mobil took and received in kind or separately disposed of all or a portion of the unitized substances allocated to said tract, together with their heirs, legatees, beneficiaries, executors, representatives, successors and assigns.
A royalty interest in the Putnam Oswego Unit POU is reportedly included in the Mobile Oil & Oklahoma Putnam Oswego Unit Royalty Interest class action lawsuit if:
- You had a royalty interest or other right to receive royalty payments, other than a production payment, in the POU at any time from November 1, 1968 to the present; or
- You had a royalty interest or other right to receive royalty payments, other than a production payment, at any time from November 1, 1968 to the present from a tract included within the POU from which Mobil took and received in kind or separately disposed of all or a portion of the unitized substances allocated to said tract.
The Court has reportedly scheduled a trial to determine whether: (a) Mobil did anything wrong in calculating or paying royalties and (b) if so, what kind of compensation or benefits Class Members may receive.
