A federal judge in a class action lawsuit filed against eBay in the United States District Court in Detroit Michigan, alleging that eBay forces sellers in its marketplace to use PayPal, its in-house payments system and seeking damages and the right for eBay sellers to accept forms of payment from buyers other than PayPal, has entered a default judgment in the class action lawsuit against eBay for failing to respond to the class action lawsuit complaint, according to class action lawsuit news reports.
eBay has reportedly filed a motion to set aside the default judgment and requested a 14-day extension to respond to the class action complaint.

In essence, EBAY advises buyers to ship back damaged items at their expense, for a full refund, then refuses to honor the refund. This is insurance fraud. Buyers are robbed of their original purchase price and shipping, as well as their return shipping expense, and end up with no merchandise, no compensation for their time, trouble or expense, and dishonest sellers receive their merchandise back, to misrepresent again on EBAY.
My assessment is that EBAY’s Buyer Protection process is designed to fail. The process is tedious, cryptic and far from user-friendly. Obviously, if buyers can’t figure it out, they’ll give up and a certain percentage will simply go away. Others who persevere through the EBAY process encounter invalid tracking numbers, inconsistent communication options (Outlook isn’t one of them) and a system designed to convey “user error” as an excuse for “Sorry it didn’t work out”.
Whether through attrition, technical flaws, or by intentional design, the process fails and EBAY retains its so called “buyer protection” refund revenue. And in so doing, EBAY becomes an accomplice to seller fraud, and an enabler of future misrepresentation. The buyer is ripped off by both the seller and EBAY.
Anyone want to start a class action suit I’m all for it! I been ripped off by their system too many times not to believe there is collusion, antitrust, and many other violations that are at work with eBay and PayPal both!
Please count me in. I am reporting farudlent listings mostly by chinese sellers daily and EBAY simply confirms and ignores. It is time for US and world public to unite against this SCAM called EBAY. Every point by Wil Martindale above is true I have exprienced them all myself for the last 12 years. please let us teach them a lesson same as with Microsoft..
Oh yes me too. They are rip off merchants,who suspend, even close accounts as they please without any redress. Lets have a class action…. what about all those pirated items I was sent in the post through their site? No redress there either. The are crooks.
I would like to join that class action lawsuit. I have had my paypal account frozen. And told that my money will be available after 180 days. Paypal is acting as a bank. And with a bank, they should know that you don’t illegally froze someone accounts without a court order. Much less when a bank decides to end your account. You are given your money back asap. Here they are actually trying to keep money I have earned!! I sold my items have a 100% seller feed back on ebay. No complaints from consumers at all. And yet they freeze my account. What the hell!!!
Ebay is just as bad to its sellers. Here is my recent problem… I have been selling on ebay for 13 years. I have over 8500 positive feedbacks and a 100% rating. I had a fire in my garage, it destroyed my shipping center and supplies, not to mention $1000s in merch. I got about three weeks behind in shipping. I communicated with my 23 outstanding buyers, all but 1 were understanding. They all gave me positive feedback, but ebay has their new star rating system and a number of them gave me a 1 or 2 for shipping time. Ebay has restricted my account because of this and has been holding (through paypal) all of my payments. That can’t be legal! Even after the items have been delivered, still no funds! It is destroying my life! I have thousands of dollars in my Paypal balance with an available balance of $1.73. I can’t pay my rent, I can’t feed my kids, much less go Christmas shopping. How is it that ebay an internet selling site can control Paypal who is essentially my bank? That’s like your consignment shop walking into your bank and freezing your account. Where is the star rating system for ebay? Over the last 2 weeks I have logged almost 7 hours in phone/hold time with morons in the Phillipines. Zero stars for customer service ebay and paypal. I’m down to sue.
They cancelled 73 of my iPhone listings on thanksgiving day 2011 froze up both my eBay and PayPal accounts. They said we thought someone illegally took over your eBay seller account. I have lost around $42,000 dollars and am ready to sue.
I want in! Can’t believe they are gettin away with what they are getting away with! Ebay/Paypal are acting as GOD! Why has there not been a Class Action re: holding of payments brought against them?

Actually it works in reverse for Sellers as well. Once a seller receives an item, they claim they either never received or was not what they expected. Paypal will reverse the transaction, giving your money back to the seller. The seller is able to keep the item and the money they paid for it.
Paypal is just an all around rip-off for everyone but the scammers.
Happened to me also:
I have sold Nikon Zoom-Nikkor DXG [IF] ED 17 mm – 55 mm F/2.8 Lens on eBay for $1100
Buyer asked me through eBay to ship to a different address and paid using PayPal.
I shipped item to buyer using UPS.
A week later buyer sends me a good feedback.
About 3 weeks later buyer reversed payment on his credit card company resulting in chargeback to me.
PayPal took all money away from me.
They said that they will conduct investigation regarding this case.
In the meantime I tried to report this to EBay to no avail.
EBay said that according to them I was paid by Papal.
PayPal took almost 2 month to lose the case to Credit Card Company and I got zilch.
They PayPal did nothing to help me, did not even contacted the buyer.
PayPal argued the case with Cc Company having done any investigation like:
Is the buyer the owner of eBay account?
Was eBay account opened fraudulently?
Did you try contacting buyer?
What was the reason buyer cancelling transaction?
What facts his credit card company had?
Buyer did not return my email.
I lost the lens, shipping fees, and Cc Company even charged me service charge fee that PayPal passed on to me.
I am still waiting for EBay to do something about this case.

If you use eBay’s buyer protection one too many times and you’ll find your account suspended for “RESOLUTION ABUSE” . Not to mention they said the soiled & tattered suit I received that was to be new was “BUYERS REMORSE” I filed an appeal and was swiftly denied even though the seller received more complaints about selling used items as new. After a few more items that were not as described or did not arrive and I used eBay’s buyer protection and was suspended for resolution abuse. Now since I am no longer a member ebay and paypal deny any claims and said to try and get the seller to cooperate. YEAH RIGHT!
And on another note, if a buyer files a claim against a eBay seller, PayPal automatically sides with the buyer because in that way there is a high rate the item will be re-listed on eBay’s site, resold, final value fees charged again on the same item, and guess who else gets to charge fees again….you guessed it…PayPal my friends! Talk about the fox guarding the hen house!. I just had to accept a forced return on a $1000 item because a “bonus” item included worth $5 “smelled of smoke”. PayPal sided with the buyer who filed a “item not as described” claim, and I refused to accept a return on the $1000 item because I paid $125 in “final value fees. PayPal fees, and insured shipping! UPS and other shippers love it, that laptop went from coast to coast 2 times as well!
now ebay has another scheme for the buyers. all the buyer has to do is file a claim with ebay on an item, for any reason. if you escalate it to a claim with ebay in 30 seconds they will side with the buyer. now their site says it will be reviewed by ebay. 30 seconds for the computer to say you lose. then they instantly refund the money to the buyer through your pay pal account and the buyer does not even have to return the item. sounds like another class action suit coming against ebay. ebays policy is that the buyer is always right. i wish some major tv station would do a spot on the crooked policy of ebay.
Ya, now if you want something for FREE, go to ebay, cause, you don’t have to return anything to get a refund, from us poor sellers, and after that, you can leave any feedback you want. AND the new game they are offering, is seller has to refund full shipping amount too, on unreturned items. AND they are now charging for non existant ebay stores and offering “ebay account credits” a month later. what is next?
No protection for sellers in any way shape or form.
The exact same thing happened to me. They forced a refund, and the buyer did not even send the laptop back. It’s ridiculous! E-bay helped the buyer steal from me, and made my PayPal account negative in the process. Now they want to invoice me and ask me to pay my seller fees for the month? Don’t think so. If I don’t get my money or my laptop, they don’t get squat either. This is so completely outrageous it’s unbelievable. How can they do business this way? How can they give a buyer a refund and not make them return an item that is NOT THEIRS?
Exactly what happened to me.
Yes, that just happened to me. Sold a cam corder to a lady, she said she loved the camera,and 2 days short of 30 days later, the buyer decided it didn’t work, so opened a clain with Ebay, and in 4 minutes won the claim. To top it off the buyer has an identical camcorder that doesn’t work (her own words) ,and actually pictured my camcorder with her camcorder. Ebay didn’t find a red flag with that. So Ebay/Paypal took my money, and gave her a full refund including shipping..
Now Ebay is changing the “Buyer Protection” to Buyer Guarnteed Refund. Which buyer has 45 days to open claim..

Hello. You bought an item from me that I wish to send to you. It is right here, and packaged. Ebay (through paypal which they are one and the same ownership-wise) froze my funds. So, I never received payment. I have tried desperately to communicate with ebay/paypal for over the last 72 hours. I have spoken with people in the phillapeanes, latin america, and every other kind of hired-puppet-monkey you can think of. Sorry, no money . . . no item. Please tell ebay so stop with the money freeze!

Careful though. I solicited my buyers for help and all they did was screw me over. If they know your payments are held they know they can easily get their money back (or YOUR money back.) Be careful, friend!

Changes to our dispute resolution process could increase our costs and loss rate.
In April 2009, we announced plans to change the dispute resolution process (which we refer to as “resolutions”) for transactions on eBay.com and eBay.co.uk in which a buyer claims the item was not received or the item they received was different from that described in the listing. We implemented these plans beginning in the fourth quarter of 2009. Previously, buyers with an issue on our eBay.com and eBay.co.uk platform were generally required to contact the seller directly and, if they were unable to resolve the issue, to start the resolutions process online via PayPal’s resolution center. We have transitioned to a new, on-eBay resolutions process provided by eBay customer support, which now serves as the primary entry point for buyers on eBay.com and eBay.co.uk who are unable to resolve their disputes with eBay sellers. Among other things, the new resolutions process provides that eBay will generally reimburse the buyer for the full amount of an item’s purchase price (including original shipping costs), in cases where the item was not received or the item they received was different from that described in the listing, and the seller does not provide adequate resolution to the buyer. eBay then attempts to recoup amounts paid to the buyer from the seller’s PayPal accounts or other payment methods.
Our costs associated with resolutions have increased as a result of these changes to our resolutions policies and process. These changes, together with any further changes that we may make to our resolutions process in the future, may be negatively received by, and lead to dissatisfaction on the part of, some of our sellers. These changes may also result in an increase in buyer fraud and associated transaction losses. In addition, eBay does not have the same level of rights of recoupment against sellers as PayPal, which may result in higher costs to operate the program.
THIS IS EXACTLY WHAT HAPPENED TO ME AS A SELLER, AND YES I LEFT EBAY. I SOLD OVER 10,000 ITEMS SINCE 1997.
How can this rule not be anti-trust:
4.5 No Surcharges. You agree that you will not impose a surcharge or any other fee for accepting PayPal as a payment method. You may charge a handling fee in connection with the sale of goods or services, as long as the handling fee does not operate as a surcharge and is not higher than the handling fee you charge for non-PayPal transactions.
Assume two pay services:
1) PayPal
2) Other
Service 1 charges X
Service 2 charges Y
Y is less than X
However, due to paypal policy, this savings can NOT be passed onto the buyer, for choosing Service 2.
So the buyer has no incentive to choose the cheaper service 2, especially if they already have an established account with PayPal.
If the Sellers were allowed to pass the savings to the Buyer, gradually more buyers would start signing up for alternative services.
Why is paypal allowed to prevent sellers from passing the advantages of competing pay services to their buyers, while still offering paypal as one option?
Do some countries consider this anti-trust? Is that why some countries do not allow paypal to have terms, preventing sellers from charging a fee for using PayPal?
Currently ebay charges final value fees on sold items based on the sale cost of the item. Since PayPal is only accepted, fees are charges on the item and the shipping cost. Now starting in July 2011, Ebay is going to extend the fees to cover the final price and the shipping cost. Since, everyone knows Ebay owns PayPal its a super double whammy. So if your item costs $5.94 for shipping like alot of our items, they take out .65 the first time and then .47 the second time. thats $1.12 off the purchse. add in the listing and its 1.17 total, 20 percen of the total sale. After the item cost and shiiping costs including supplies we make 1.29, only .17 more than ebay. Add in the store monthly fee divided by the total items listing and we just about split 50-50 with Ebay. This is how people with the title of Vice President, Seller and Buyer Experience keep their jobs and bonuses.
Ya, I know, I sold pins that i make for 14 years. had to close ebay store back in feb, and move all my stuff to ebid, which has no sales. The latest is they charged me for an ebay store I do not have, charged my credit card, then state they will issue me a credit to my account in July, I NEVER GET MY MONEY back for a service i do not have.

I have sold for over ten years on the Ebay marketplace. I have 100 % positive feedback and stars that are 5, 5, 4.8 and 4.6. I first received word that I am “underperforming” and that my Top seller status has been taken away, then my power seller status taken away, now I receive emails almost daily that I am still underperforming and Ebay and Paypal will now hold my money for 21 days. Today I received and email which said that if my statistics didn’t improve, I will be limited to how much I sell on Ebay monthy. If I was in college, I would be pretty close to Validictorian at this point. My record is stellar, this is no way to be treated. There HAS to be something we can do to finally put an end to this antitrust machine. I mean, this is my livelihood. Today when I tried to call them, they gave me a pin number that when i put it in, just kept redirecting me to the main menu. It took me two hours to finally get someone to speak with. The associate told me that the company is trying to compete with Amazon.com and WalMart.com-The difference in my opinion is that those companies are funded with their money and staff, not people paying to use their website. One more note- When I asked when my account would be looked at for Top Seller requalification, I was promptly advised (by an Indian customer service agent) that they would look at it in a year. We need to come together on this and put our best foot forward.
ebay is out of control with greed!! What Jason said above is also my story. I am a pioneer on ebay and a former long time Top Ranked PowerSeller who has been stripped of all accolades for no good reason and basically because I do not offer free shipping nor have I opened an ebay store. I believe it is also unfair and not fair trading parctice that ebay can make a profit on my shipping ‘expenses’ now, and I am also petrified of ebay holding my funds until “they’re” satisfied with the transaction. I have happy customers !! (I have not one bad comment out there in over 9 years), who have no idea that when they fill out the buyer feedback pop up after the transaction, that any score less than perfect could potentially be knocking the seller out of business and taking away their livelihood. ebay has been and IS my livelihood, I have done nothing wrong here and I have managed to maintained 100% positive feedback, which any seller knows is not always an easy feat. I am currently going through much of the same as what you all are talking about. I sent an item to a buyer (who, upon researching has a repeated history of negative feedbacks and numerous filing for refunds with paypal and getting them) and he claimed he never got the item and the postal delivery worker who scanned the package as delivered to him even said he remembered delivering the package. Paypal gave this criminal his money back, even after I provided over 40 instances from his feedback profile on Ebay of him ripping others off. creationworks2000 on Ebay . He has learned the loopholes in Ebay, Paypal and the USPS. Non of which are aware of how this guy is scamming all three. How to get my money back from Paypal? Help!
I need to tell everyone here that the sellers aren’t the only ones being stiffed. I bought a 1 ounce american gold eagle from a seller that had 5000+ positive feed backs. After not receiving the item, I filed a claim and I am still waiting. It has been almost 2 months now since I bought the item. The Ebay rep I spoke to said that he thought the sellers account was compromised. The rep also said that it was probably Ebay themselves that closed the account because they knew something was wrong. The sellers account was closed before I could leave negative feedback. The last thing they wanted was a police report. I am done buying coins online. Don’t believe me? I am all for a class action lawsuit against Ebay’s “buyers assurance”. I don’t feel very assured. Ebay does everything they can NOT to pay anything on a claim even when they know exactly what happened.
I want to remind everyone that it is the lawyers that get most of the money and the victims are left with the crumbs in class action lawsuits. It would cost Ebay a bundle though and I am all for that. Ebay needs to know that it costs more to rip people off in the long run.

Yes, I will have to agree with all the ebay sellers that have been selling on ebay for years. I have been selling on Ebay since 2001 and have maintained 100% feedback ratings for 3 to 4 year stretches before some jerk finally comes around to ruin my score for no reason at all. Now with the seller dashboard ratings that 2% group of buyers now have the power to bring sellers down very easily. It seems to me that Ebay is just ridiculously greedy and is looking for any reason possible to make more money off the sellers every month. My premium Store was downgraded to a basic store because of the $3.00 shipping charges I was charging to send out my Sports Cards. Apparently, $3.00 is unacceptable to 2.38% of all the people that have purchased cards from me over the past year. Sometimes I wonder if Ebay just throws up those bad ratings on my DSR shipping column to guarantee me that I will not be able to keep it under that magic number of 2.00% Now I constantly get harrassed by Ebay everytime I login to my account. I basically feel like a scam artist because of my shipping charges. I revised all of my Ebay items to “Free Shipping” over six weeks ago and I still get harrassed by Ebay and have several more warnings and punishments that will take place at the beginning of June. I only sell around $2500 a month out of my Ebay store with Ebay getting around $650 in commissions every month. That does not even include the PayPal transaction fees and the $250 it is now costing me to ship the packages out every month. It looks like for every $100 I sell on Ebay, around $50 disappears in PayPal, Ebay commission and USPS free shipping that I incur….yet I am still a piece of garbage from Ebay’s point of view. Something is seriously wrong. I wish I could sell my baseball cards on a different Internet site. This is so horrible I feel like breaking down.

My grandfather died recently and I received his camera collection. Not much worked in the trunk but I did find a salvageable Leica M3 camera. I tried using the camera but I’m not a photographer and I’m spoiled by my digital. i decided to sell it. I was surprised by how much the camera was worth when I researched it. I stuck the camera on Ebay with a starting price of $500. The auction ended at $1000.
Now I’m not a regular seller on Ebay. I sell maybe 1 or 2 items a year. well because this sale was a substantial sale, Paypal put my account on hold. That was their reasoning. That I don’t usually sell things for that amount of money. So now to get my account off the hold, I had to do 3 things: submit a photo id, submit a utility bill in my name, and provide proof of shipment to the buyer. I provided all 3. I’m awaiting the camera being delivered to the buyer this week. Now I’m terrified that the buyer will say I never mailed the camera. My account is still on hold pending delivery to the buyer. I provided a delivery confirmation number. I hope that is enough.
Should home Depot.com or any legitimate online store skim the market the way paypal and ebay does they would be seating in court .
I would be more than happy to join a class action suit against ebay, for more reasons than would fit in this box, the latest is they billed me for an ebay store I do not have, then said they will issue a credit to my account next month! so i never get my money back that they stole.
How about I sold an item as is,described as used for parts only,no returns per ebay policy “so bid as such” AND I get a return . Ebay and paypal locked up and limited my accounts yanked $$ out and could not explain,after 7 hours on the phone for 6 days..The exact legal reason they could as a 3rd party make a binding contract nul and void on an obviously described as is item. Any competent explanation,that makes sense?

Finally received something back! Just cashed a check from the PyaPal class action lawsuit that was filed a few years ago. PayPal beat me out of about $790US back in 2007. I filed the forms for the class action suit and just cashed a check for $2198! I had to wait over a year to receive the money but it finally showed up, I actually had forgot about it.
The only remorse is it didn’t punish the varmints that were involved in the original rip-off!
Still waiting for a credit on this stupid coin purchase and getting angrier by the minute. I have stopped all Ebay coin purchases. I have been buying coins since 2003 on Ebay before this incident. Ebay has been charging sellers and, by proxy, you and I, for buyers protection that they do not honor.
What is interesting is that Ebay is now losing sales from me because of the way they handled this issue. I no longer trust them.
I bought a gold cross from a seller on e-bay in late May. The cross arrived here in Chicago and looked very nice. I gave him positive feedback. I have been going to the dentist 3 times a week and 2 weeks ago I opened the box and the cross looked dark. Changing colors. Iwent on e-bay and read where he stated the cross was marked 14kt gold. Low and behold I took the cross to the jeweler and he said I was had. After giving him positive feedback I filed a claim with the buyer protection. They said I may not here back for 90 days on this case. I have the cross sitting on my counter. It is brass and was spray painted gold. Believe that one. The seller has sent me e-mails stating he will not refund my money and I had 7 days to contact him. He also said I was doing to die on a cross and other horrible things about me. Can someone please tell me what I can do next besides wait for e-bay to come to a resolution. The man I spoke to was hard english couldn’t unerstnad him. He made a comment that hopefully e-bay would favor me in their decision. Am I going to be out all this money. Is there a class action suit that I can file if this is not favorable. Can someone send me the link please.

Ebay has finally gone to far with FVF’S (final value fee’s) on shipping. Its useless to complain here or to ebay.
I’am asking Sellers to boycott Ebay for 3 month’s.
To not sell anything on ebay!
Realize its hard to do for some do, But if you have VERY LIMITED listings enough to get by. this will help too.
This is the ONLY way Ebay will listen to us sellers!

I too got suspension after only 2 months of selling on Ebay. Ebay will not re open my account. I purchased several items that are not authentic as listed in the Ads. Now I can do nothing about it. Ebay gave me all kinds of reasons to suspend my account and none of them ligimate. I have called them several times about this, and they also have not refunded my listing money. I can do nothning about the items i do not feel are authentic as listed some from Hong Kong.
Ebay should be shut down by law they are not running a ligimate business. I thought we had Freedom of Commerce in the US>

I would like to know WHY? I listed an item on EBAY they said was not authentic. Well I found many many items on EBAY not authentic. I never claimed my item to be authentic. I stated I was unsure of the item on the listing. I have purchased several items that are diffinently not authentic. I need resolution and now I can do Nothing . I spent as a buyer several hundred dollare on Ebay in two months and a buyer and only sold 150.00 and they got a percentage of this. I feel ABUSED.

Have been with ebay 2004. ebay definately not seller friendly either. Had productive account but had a 10 day handling period due to physical handicaps. Even stated this in description to buyers. Using media mail , this means about 15-20 days for shipping. Even told buyersdont buy if in a hurry. Naturally most want priority speed at media price add this to handling period. Natually this means super in all but shipping speed. Have now had shop inventory removed due to speed. Thankyou ebay for your seller support. You remind buyers of shipping speed with media but permit negative when not recieved in 5 days.

I have been selling on e-bay since 1997 and am just about fed up. I recently had ebay force a return on me two weeks after the return period stated in my listing. Now I have another buyer ready to file a “not as described” complaint almost a month after buying the item. If e-bay sides with this buyer I am ready to throw down the gauntlet and start a class action lawsuit as they are violating my return policy clearly listed in my ad. I have a 1287 rating (and only 6 negatives over 14 years) and am a bronze powerseller. I always take care of my customers when there is a legitamate problem and have always done so. I do not need the e-bay nanny to broker my deals. I also should be able to leave negative feedback on buyers like I used to. If I am unhappy as a seller dealing with a buyer, I should have the same rights to leave negative feedback as the buyer. That is the way it used to be but this politically correct BS e-bay is going through is beyond comprehension.
I think I am done with the e-bay nanny role. If they are just going to take my money and not work with me, then they are out one great, honest seller, my revenue and everything that I had worked so hard to do right. I will focus that energy elsewhere.
It is a shame that many bad sellers have almost forced this upon e-bay. I understand that they are trying to weed out bad sellers, but the recent buyer protection program (which violates some basice laws as I see it) and the policy updates coming in the next year forcing buyers into a 14 day return period do not bode well for honest sellers like me selling used items.

So disheartening to hear so many stories similar to my own. There has to be SOMETHING we can to let everyone else know about this before it’s too late and they are in debt like the rest of us.
There certainly is – what we need is an organized course of action. I think making this viral is an excellent idea – this will allow us to gather up many more people to whom this has happened. I think the more people involved as a collective unit, the better our chance of success in putting this in the ground. Because so far I haven’t seen a singular group of more than a few hundred people at best, when this has happened to countless others (I’d venture to say hundreds of thousands, if not millions) – I don’t think a few hundred is big enough to cause the uproar it’d take to make this a more relevant matter in the public eye. Even thousands would be a better number, but folks need to decide that they are SERIOUS about bringing these guys to justice – mere complaints and emotional vents mean jackcrap to reaching a real resolution and is EXACTLY the reason why we’re in this mess in the first place. Too many of us are too complacent when this kind of thing happens, and guess what? At the end of the day we usually end up giving in or doing nothing to stand up for ourselves (for one reason or another), which means the culprit’s pockets keep filling with money from their dirty tactics, so they have no reason in their eyes to give a great goddamn. As far as we’re concerned, these people have no compassion for anything but their money, so ideally what we’d need to do is strike back there. Going viral = more dropouts, less customer opt-ins; Lawsuits = potentially HUGE blow directly to the funds AND negative publicity, meaning even less customer backing. If we’re to strike back, we’re to prepare for the possibility that they will not back down so long as they have money. That means we also need to be able to act outside of relying on just a lawsuit, although it’d help greatly (however a class-action lawsuit was already launched against them, but the presiding lawyers were somewhat bought off – it was settled out of court for some 10mil., 3 of which went to the lawyers. Even worse, the claims against them in the previous case cannot be reused in a future suit against them, making a solid case even more difficult). Personally, I’d just want to see this brought to a close as soon as possible because at this point, the way i see it, it’s over for them. The only thing we can influence is how many people they do this to before their time comes. So in term of a first course of action, I suggest folks with social media accounts get the word out and join with related movements (i.e. the FB Class Action page mentioned above) afaik word spreads the quickest through these mediums. Any and all suggestions on putting this whole fiasco to a permanent close are welcome.
Ebay and PayPal are a disgrace to America. And shame on our goverment for allowing coporations to operate in an obviouse fraud. How is PayPal not a bank? PayPal is now saying that eBay is forcing the hold. eBay has in their list of ways to resolve the hold issue is to purchase shipping services through the eBay site, this is almost like holding a gun to your head and forcing you to use services that make them more money! 8 1/2 years I have been selling in eBay, 100% feedback, good DSR’s, 1550 positive feedbacks, selling the same type of items over and over and all of a sudden they are holding funds and trying to force me into doing things to make them more money, while their sister company makes interest profits on my money inthe process. Worse than the mob. I’m done, once my final funds are realeased I’m walking away. eBay and PayPal have jumped the shark.
I am so angry with Ebay and Paypal, I feel cheated and would gladly join a class action against them. How sad for Ireland and the innovators of what was a brilliant idea, and turned out to be awful.
sign me up for action against the fraudulent sellers on ebay. I feel like i have to physically go see an item in person and have it tested for authenticity. Too many fakers and doctored pictures on ebay. and ebay does nothing about them. they say its our, the buyers, responsibility to authenticate something we can only get a picture and written description of. they should be shut down. after this last incident, i am done with ebay. i finally learned my lesson, there is just nothing i can do to be sure i am getting what i pay for on ebay.
Ebay is a law breaking joke (see Sherman Antitrust Act). What other retailer has a policy which mandates you use its charge-card / finance system only, when buying goods?
Would you go to a restaurant which only took the Steakhouse charge card? What about a grocery store demanding the Big Foods Card be utilized? I gave up on Ebay after the PayPal only rule went into affect. My purchasing record was 100%, and I always used USPS money orders, understanding that sellers waited till they cleared before shipping goods. Whoever thinks “government regulation” is unnecessary is an idiot.

There is something wrong with this…this is a serious matter.
eBay list other options for payment,IF you can muddle through and find it and then you do a little research and find that one option they list you must be a Power seller to use, the next option is yet another eBay company and the next option most small sellers couldn’t afford after the monthly fee, fees for accepting payments and then nearly 3% added to that for them to convert the currency. Final option is having your own merchant account which most small sellers wouldn’t benefit from , so you are left with Paypal shoved down your throat and no way to swallow because they continue to place holds for extended periods of time. I seriously hope there is an ethical Judge out there that will put an end to the unethical practices of eBay & Paypal.
If any Buyer has any complaint, true or false, against an eBay Seller then ebay holds the Buyers pay-pal payment for up to 5 days. Buyers filed against me saying my shipping too high when it was not.
When the shipping cost was $2.50 I charged $2.00. I went to Free Shipping as ebay suggested three months ago but eBay continues to hold my pay-pal money.
I ship in two days, notify the Buyer, pay for delivery confirmation, and give Free Shipping. Ebay contines to hold my pay-pal without offering any help and I have called them 5 or 6 times over the three months.

I just want my money. I called Paypal to ask for the funds to be taken off hold as my buyer on ebay had already received the item I sold to them and left positive feedback. The guy at Paypal told me too bad I will have to wait 21 days for my funds anyway since I don’t have a tracking number. He also told me they are not even affiliated with eBay and I should be happy I’m getting my money at all and hung up on me. Not affiliated with EBAY?????

Hi, I sold a used DSI on Ebay. Described it totally. Buyer had it for 5 days. Now filed a “not as described” and is totally not telling the truth. Photo’s show working condition.I have 100% feedback. Two days ago PayPal took the funds from my account until it’s resolved. Don’t look to good for me from what I’m reading on here. If they refund, I’m leaving Ebay and Paypal. I totally agree with above comments regarding ebay/paypal. I’m a 100% positive feedback seller–and 6 people out of 500 reported slow shipping (BS–they chose Media Mail–which is SLOW) , EBAY claims I am below their standards (still 100% positive feedback mind you) and has Paypal hold all funds for 21 days. I’ve been selling on Ebay for 12 years at 100% positive–and they do this to me. It forces extreme hardship. They hold all funds in Paypal INCLUDING my shipping fees–so I have to pay that out of pocket!
I am totally on board for a class action lawsuit. I see their practice of holding funds as an illegal plan for profit on the interest they make in that 3 weeks !!

Ebay and Paypal are in bed with each other. Its one same company I believe but everytime I contact paypal and ask this quesiton, they seem to have a script to dodge the question. After selling on ebay since 2000, it seems like day after day, they come up with new ways to screw the seller. My account was suspended last year for refunding sellers for an item I never mailed because my container was seized at customs. My wife who has a completely different account both on ebay and paypal had a limitation hold put on her account. When I called paypal to see what this was all about, the guy said because my account was suspended 2 years ago and because we are married, she is now linked to my account status. These guys are class A phone actors who make you feel like a criminal. In all honesty, I could have screwed over 200 people 2 years ago by bailing out and not refunding them, but I did what is moral and right and I got punished by ebay and paypal and now 2 years later, my wife (because we got married) is getting punished as well. These guys are the criminals who hold money for 180 days without any interest.
I too have been victimized by eBay.. A good seller for over ten years..Problem…eBay believes the sellers even though they are lying and even help the buyer to scam the seller…I have had a USPS insured package…Buyer says package is empty… Ebay starts a resolution… Takes 1000.00 of my money.. This could have been settled by the USPS… But buyer did not cooperate. Now I am out the money as well as the merchandise… I never signed anything that says I wanted to cooperate in the buyer protection plan.. What can be done… I will never sell or buy on eBay and I tell anyone thinking of doing so, that they are unfair, liars and cheats. /I really hope a class action will be stated soon on this topic.

Just had the same thing happen to me. I’ve been on eBay since 1997, with 100% positive feedback, not so much as 1 neutral. There have been a couple less than stellar encounters (non paying bidders) over the years, but never experienced intentional, organized fraud until just this week.
This is what I sent to eBay via the appeal option;
“Buyer did not return the items that they received. Item claimed to be “not working” is not the same item this buyer sent back. The base phone returned is filthy, looks to have years of wear including scuffs and worn paint, and most notably, has a chunk missing out of it. Buyer didn’t say it was in different physical condition than pictured or listed, but that it was “not working.” I am more than happy to furnish date/time stamped pictures of the tested & working items we sold/sent and the contents of the box that was returned to us today.
Buyer also failed to return; 4 AC adapters, 1 cordless handset cradle, and the original item/manufacturer box that was included in the original listing.
Please investigate this. They buy high end phone systems, return garbage to sellers, get refunded by PayPal, then essentially sell stolen items on their website (101phonesdotcom.) I have already contacted the BBB in New York, The Federal Trade Commission, and filed a complaint with econsumer.gov but none of these outlets can replace what was stolen from us. ”

According to many states is the US this is illegal but this act goes on globally, and there is not one class action lawsuit anywhere in world that cannot stop this blatant misrepresentation???

I am in favor of a class action lawsuit. Ebay and PayPal are out of control. I recently used PayPal to join a website. PayPal was listed as one type of payment on the main page of the website. I had money in a PayPal account so I used it to join. PayPal processes the payment and then 30 days later suspended my account permanently . They took all money in my account and refuses to even return a phone call or email. I had a 100% rating at EBAY and now I cant purchase anything because they suspended my account. PayPal had no right to touch my money. They simply stole it and refused to discuss it. I look forward to another site to visit to purchase items from and wish EBAY and PayPal a painful death.

I too am being burned by the “Paypal Holding Funds” ordeal. I have excellent feedback and Ebay claims they are holding it because in December, one person put 1 star for my shipping and handling charges. I have been shipping everything free for months and have no reason to be punished. I have called ebay and paypal back and forth, over and over and nothing changes. Are you still having issues? Apparently eBay has not been putting these “held funds” in a trust account (which is required by law when funds are being held that do NOT belong to the company)…also the antitrust laws are beyond being broken. I, too, have had funds held for the last few months because of “below standard performance”. I have had to completely stop my online selling business due to having to pay ebay’s outrageous fees which were taken out before I even got my money back….and not being able to buy inventory because my turn-around took too long. My “below standard performance” apparently comes from ONE person in December saying my shipping and handling charges were high…for the last at least 5 months, I’ve shipped everything FREE….so I’m not too sure why they’re still punishing me. Am now prohibited from posting more than 25 items per month. I am ebay seller since 1997, 99% good feedback. No reason given by ebay except “not up to our standards ! For all of you sellers who have been burned by eBay and unjust negative feedback and low dsr ratings, if this doesn’t chap your hide, I don’t know what will. I bought a phone from Alltechwholesale which just happens to be the seller that eBay allows to sell all of the items they get from their eBay Instant Sale program. The phone was suppose to be in good working order, but the camera would not function. I left neutral feedback but did not ding them on dsr as they said they would refund. I went and looked the next day, and eBay has deleted my neutral feedback comment! Do they ever do that for other sellers? Or is it just the ones they are incahoots with? Alltechwholesale’s feedback always use to hover around 98.4% but recently shot up to 99% so I have been watching, and sure enough, negative and neutral comments left by other buyers are routinely deleted! And no, as far as my feedback left for them, there was no just cause for eBay to delete the comment. And I never even received any notice from them that they did it.

I had one user give me all 2* or less back in July, yet a positive feedback, which has now dashed my star record. I am 97% or better with either 1-3 2* votes in the last 168 transactions. And I’m below standards, amazing. I’m a 4.0 student that has gotten 97% or better on all his tests and am performing below standards.
When talking to the CSR at eBay, they said that they wanted me to get back to my previous standards….. wow, what a spit in the face. They take their sellers as trash and believe everything a buyer has to say, even when they give a positive feedback.
I never charge more on shipping and pack ever package of mine with care. If put up against any other eBayer, I’d be one of the better at turnaround time and packaging.
They are currently holding funds from me and I can’t imagine how many other people are having their funds withheld. Multiply that out, add interest or earnings to their holds and you’ve got some shady business activities.
I’ve been having issues with ebay for the past 15 months in regards to the product I sell. I sell “Team Group Breaks” with baseball cards. Back in May 2011, they removed my listings saying that they were “Chance” items. I contacted Trust and Safety and discussed the item I was selling and explained that it was not a “chance” item. They agreed and removed the infractions from my account and said promised I would never have an issue again. This was all done through “chat” back then. I was supposed to receive a copy of the chat after it ended, but never did. 3 months later, my listings were removed again. When I contacted ebay, they said they changed their policy, which according to the customer service agreement they are allowed to do at any time. I had $10,000 worth of product on order that I no longer had a venue for selling it. I tried 3 times to get a copy of the transcript from the conversation back in May, but they never sent it to me. Even stating that they had it and even read part of it to me and would send it to my email. They knew it would hurt them if I got my hands on it. Currently, I am still no longer allowed to sell the product that I created back in 2007 and was the first to ever sell it on ebay, yet they allow others to sell the same product. I called them about it and they told me to report the items. I reported 50 items and kept track of them, none were removed. So I started listing again, sure enough, my items were removed with the same “don’t do it again” warning, yet they still allow others to sell the product I sell. Need help as I now have $40,000 worth of product on order with only a small group of people to sell it to. They shouldn’t be allowed to prevent one person to sell while allowing others.
my issue is my daughter at age 25 and living in my basement had an ebay account that she never paid! i have been suspended as a seller because of her outstanding balance! they told me her account name and the amount she owes. they claim that our accounts are linked together, but i ask for an invoice to review those charges and they won’t produce anything. my daughter insists they scamed her and refuses to pay. me i’m done unless i pay her account $253 they’ve told me.
ebay has told me they track and attach any computer that i sign in on to my account! they attached a link to my brothers account after i logged in there once.
Here’s my thoughts here. I’ve been on Ebay for over 14 years. I stopped selling on Ebay over two years ago and the reason is this. I’ve NEVER charged more for shipping than what the PO asks. Just over two years ago Ebay started this shipping fee, hence I have to charge more for shipping to cover what they take out of what I’m charging for shipping . Ebay has no right to interfere and make any seller charge more for shipping in order to cover the fees that Ebay is embezzling out of the seller.
My next point is this. Their so called Ebay Buyer Protection Program is a pile of crap. I filed a complaint stating that the 80 GB hard drive that I received in a used computer was about to die. It rattled and gave the sound of a dying drive. Ebay sided with the seller after I filed a case and I was out money. I found their so called protection a complete farce. If a lawsuit is filed in either of the above points, I’m all in. I’ve read hundreds and hundreds of complaints on line regarding Paypal (which is owned by Ebay) and its withholding and freezing money for weeks at a time.
Its about time a class action lawsuit was filed against this greedy uncaring giant.
I have recently been mishandled by them, my clients left without communication, they violated their own terms and agreement then threaten not to open my accounts back up. I ended up paying Paypal twice (to refund all items). Still going to ship a few items and account is all locked up. I had to purchase my own products so I wouldn’t go under on the bids with shipping the way it is (even though gas is 2$ a gallon?). I’m in on any recent class action suits. They accessed my accounts and restricted my access without recourse or reasonable explanation. I am tasked with following up with them next month to see if they will change their minds about my accounts.

If anybody is honestly looking into a lawsuit, I definitely want to be part of it!! I’ve been selling for 22 years and they NEVER side with the seller, always the buyer!! I sold a scuba mask and the buyer ‘claimed’ they received it damaged which was NOT the case!! This was a brand new item I had never used due to a trip cancellation because of COVID. The buyer clearly had the same item that was damaged, bought my brand new item, and returned hers saying it’s the one I shipped. eBay informed that I had to go ahead and issue the refund but could file an appeal after I received the returned item. I called at least 8-10 times and explained that the item that was returned to me was NOT the item that was shipped and they never did let me file an appeal. Not I have a damaged item that I can’t resell and am out $150. I am not happy about this at all!!
The second, most recent incident, was them removing a product I had listed saying it went against their ‘counterfeit’ policy. It was clearly an authentic item that was in original box and had never been opened. I had 3 different customer service associates tell me that there’s no reason it can’t be listed and to go ahead and re-list it. Each time it got removed again. Only to find out that every time I re-listed the item (even though they were the ones telling me to do so), I was getting a mark against me and my account was in jeopardy of being suspended. To top off the whole scenario, there are multiple other listings currently on eBays website for the EXACT same items but they can’t explain to me how these others are ‘okay’ and mine got removed. I am beyond frustrated and pissed off with them and something needs to be done!!
