Deaf Woman Who Tried To Register To Sell Items On eBay Files Class Action Lawsuit Against eBay Over eBay’s Alleged Discriminatory Telephone Registration Process

A deaf woman has filed a class action lawsuit in U.S. District Court in the Western District of of Missouri against eBay over eBay’s telephone registration process that allegedly discriminates against deaf and hard of hearing persons, according to a class action news report.

The eBay class action lawsuit reportedly alleges that eBay requires persons registering to sell items to be called over the phone, listen to auditory PINs, and then enter those PINs online to verify their identities.

The eBay class action complaint reportedly alleges claims for violation of, among other things, the Americans With Disabilities Act (ADA) and the California Disabled Persons Act and seeks, inter alia, declaratory and injunctive relief and statutory damages.

    I have been a seller on ebay since Dec. last year.

    I worked very on ebay to become silver power seller.

    One day when it was time to get my discount , poof , my power seller account was gone, due to new DSR system.

    With this new system, you can never be on top.

    ALL DSR is a scam and bs. it is all based on opinion of a buyer, that not one seller can win. within time sellers will lose so called “top rated” seller status. Top rated seller is also part of power seller discount program.

    All the sudden i receive 14 low dsr out of 1500 transaction, ebay lowered my search, which caused me to lose $1200 a week. It costed me over 800 unsold items in 4 days time. Total lost was unbelievable.

    Seller protection is ZERO. even after i reported 7 fraudulent buyers, ebay still did not remove negative feedbacks and instead warned me about it.

    I want to file a detailed lawsuit against EBAY, epic failure company.

      I am on board any DSR law suit … been doing biz with ebay for 12 years with only 4 negative marks on standard feedback. 4 negatives on shipping and i am limited what I can sell … can’t get my money until the item is delivered … it’s a joke and costing me money .. I am qualified to be a power seller if they would release this DSR BS … that they cannot justify or explain.

    have taken quite some time to review my account suspension. I believe that my suspension is in error for the following reasons. 1- My 12 month DSR is in the green (in good standing) for all aspects except for the shipping time category were we are at 4.38 2- My 3 month DSR is good in all aspects except for shipping time it at 4.39 3- In 2009 I was a gold power seller going towards platinum as we were in the process of adding new inventory and a (TOP rated seller). We can get back to that level. 4- We had some shipping speed problems that caused lots of undeceived item cases. Almost all items are now received except a few that we can reship and we know how to avoid this in the future. 5- We had our account restricted and were unable to sell on EBay since March. We were waiting for our DSR shipping time to get back up and were resolving shipping issues. Our DSR was improving as you can see we did not generate any new 1s and 2s in the last 30 days DRR rating. On May 10th our account was blocked even if improvements did occur. 6- All the negative feedbacks we received 10 in total out of more that 3500 positives are in a 60 day period indicating that we were great sellers before and can be great sellers again. We have the ability to do it. 7- Since we started selling on EBay we generated more than a million $ in sales in total. We are restructuring our shipping department and understand what caused our low shipping time DSR. It will not happen again. We want to continue to resolve remaining issues and start selling on EBay again. Please do not let our shipping time problems kill our EBay account. Max

      not to mention the ebay dsr program taking money from me
      basicaly “fired” from my job “only” personal income !.shame,ebay dsr ! This is real bad, Please lets all get on this and stop this “DSR” ebay idea, program policy, just not doing postive results with bussenness people (work on line)..ME and others I know of..

    I hope ebay goes out of business. They refuse to take away an unfair system. They are getting rid of sellers they don’t want by a fraudulent system. I passed all the dsr #’s but they say i failed a secret dsr # system on the dashboard that I believe they made up. Why the hell do people say love the item then shave stars down to 1 & 2 stars. It should be illegal. The buyers shaving the stars are probably big expensive sellers that knows how easy it is to squash the small guy. Don’t take a rocket scientist to figure that one out. If the system was working so well then why did ebay take over the shipping time as long as you put down 1 day handling time. Also they took over the shipping price dsr as long as you give free shipping cause people that were giving free or low shipping were still failing the system. Doesn’t this in itself prove the system is fraudulent? Please lets look into this & why it is happening. No news reports ever talks about ebay anymore which is strange also cause they used to talk about them all the time. Why won’t a CEO fix a broken system unless he is stuck on stupid which most of them are & have never sold general items to see how ignorant the buyers really are. Oh yea ebay insists all people are good. Is that why the prisons are filled to capacity & so many are on parole. Just watch the news & you’ll see how good people are. Wake up ebay before it’s too late.

    Buyer left me negative feedback 3/21/11 and said “item not received”. I ship through Ebay shipping and supply a tracking number. The item was delivered 3/22/11! He jumped the gun! I dont understand why ebay wont remove this when the item has been delivered and his feedback he left has everything to do with that. Im just mad that ebay doesnt protect there seller AT ALL!

      I have a better one for you. I shipped out an item via Priority Mail. I received a return receipt from the USPS showing my customer received his package and signed for it in under a week. I received negative feedback saying my buyer neither purchased or paid for this item AND a notcie from PayPal saying that he is having his bank reverse the transaction. Called PayPal and despite me having proof to the contrary, PayPal says I have less than a 50% chance of winning the dispute and Ebay won’t do anything to interfere period! Instead I am told Ebay needs a COURT ORDER to reverse the fees for the item and the negative feedback. And to top it off, I AM NOT ALLOWED to file a complaint against the buyer because to them I have no grounds to do so. Does anyone else see the major problems here besides me?! I have to contact an attorney to take on Ebay, PayPal and the people that are ripping me off. Anyone care to take this case pro bono? Feel free to reply to this listing and I will respond promptly.

    The thing that will ultimately make the DSR dissolve due to legal issues is the fact that many sellers do this for a LIVING. You take away a person’s right to feed a child or make a house payment and you’re breaking the law.

    Who at Ebay decided to punish their sellers by cutting down their ability to list items? Let’s just say a seller normally does $1,500 a month and pays their bills on that. If a low DSR-rating causes them to suddenly only be allowed to make $750 a month, you can’t get by on that. CRUEL.

    Keep in mind the people who work at Ebay alsot have accounts!
    What a great way to take control of getting ride of you if you are underselling them. Why would they help you they look up your account and are working with their family and other friends as well to get ride of you if you undersell them. They will purchase from you to leave you bad feedback and give you lower DSR so you will not get benifiets saves Ebay $$$ and then you try again to work hard to bring it back up. Have you ever listened to the back ground how other Ebay employees are laughing while you are on the phone with them?

    Save all your negative feedback and print out the items and all emails and any information and get ready for the Lawsuits! Be prepared!

    What a shame. Ebay is a disgrace to mankind. But then again people like me learned to exploit their IDOITic system to earn money by spending nothing.

    A word of advice. Why not invest a bit more to create your own selling site? A software engineer won’t take more than 2-3K to set a site up for you. Perhaps you need to learn a few computer language before that.

    I will join a class action lawsuit RIGHT NOW!! There are attorneys who drool over these types of lawsuits. We just need to know what information that is needed. I received my first negative FB because I opened an unpaid item case SEVEN DAYS after payment was due, as they refused to communicate with me. It was finally paid on the last day allowable. I sent it & I PAID THE EXTRA $8 in shipping myself….then they left ME negative FB. Too bad says eBay. They have a “right to their opinion”. One guy emailed me over 20 times, including one that said, “This is your LAST warning”, because I refused to pay his return shipping FROM England. EBay told me to contact Gmail! It took ne 3 weeks to get him to bribe me for positive FB, before they would do ANYTHING about it. Just got my SECOND one today….THREE WEEKS before I would be Top Rated. Guy wanted a discount & made up BS about restoration to a 1778 English Sterling Basket. I told him to take it to a jeweler & if they agreed, he could return it. HELL NO, he wouldn’t do it, because It’s NOT true. He doesn’t want to return it ..he just thinks he paid too much. So, I get negative FB, because I asked him to get a professional opinion. EBay won’t remove it, because he didn’t open a case!!! He couldn’t. He knew he’d lose. I spend hours on EVERY listing & am about to have a nervous breakdown, because I am losing so much money. WE are eBay’s customers, NOT the buyers. It is fraud & collusion & deceit. I count my feedback as it comes in & 2 weren’t even counted this week from 2 different buyers. We have GOT to do something!!!!

    I would join a lawsuit right now. I am so tired of being responsible for an item until it reaches its destination. This is impossible selling internationally. I have lost so much money from buyers who buy and say they never get the item. Ebay wants to tell me that a customs form which they can look up and says the item was shipped is not proof of anything. I would be happy to take down Ebay any day.

    I would join a lawsuit too. I have just had two weeks of hell with eBay and PayPal and to be honest I have even had my account at PayPal frozen for 180 days even though I was told my account was in good stead my credibility has been extinguished due to eBay’s crooked ways. They take your fees rather quickly you work your guts out and in turn they boot you in the teeth. One thing here though there policies are not normal, if you are a heavy seller and refuse your offers to be a store offer beware they will find a policy against you

    I have been working with ebay since it first came out but have only really fell into it the last year when I got the opportunity to sell for a good company. I’m only 21 so the money i’m making right now kind of seems surreal in a way. I enjoy Ebay and I try and go out of my way to please my customers. The problem I have is I’m constantly striving to please the customer and I still end up with the short end of the stick,sometimes just because of someone’s ignorance. I got my first negative feedback the other day over a personal mistake, but at the same time they don’t even wan’t to work with you to fix it. I’m sorry, as much as I try to be, I’m not perfect. The worst part about things is I feel on edge at all times because I don’t wanna loose my Top Rated seller status but yet I have to worry about hooligans destroying that for me even though ebay is getting huge sums of money every month when I pay my bill. It’s ridiculous, I can’t imagine how much they profit each year. It bothers me that I’m paying them so much money but yet they won’t even stick up for you. At one point I was thinking of making a career out of this but now i’m realizing that it’s time to hit the books again and keep this as a nice side job. Ebay, you’re slowly disappointing me more and more.

    I have been a respectable Ebay seller and buyer and have honestly earned my 100% feedback. I recently had an issue with a buyer who refuses to communicate regarding the late shipping on there item. Instead they have decided to leave negative feedback twice but I have no option as a seller to leave my choice of feedback, “Positive Only” I have tried to get Ebay to help with the issue but they declined to help and I have followed all there recommendations. Then I receive a buyer protection email, that was sent to my personal email instead of my Ebay message account Ebay insists that its “Spoof” but I know the difference between real and spoof. I am concerned with my account due to the fact there is some personal information and just so happens to be information pertaining to the item in dispute. I asked for assistance with verifying the email especially since the buyer has been so uncooperative. I spent 2 1/2 hrs on the phone with Ebay, explained my issues 5 times and still no help. The resolution to removing the negative feedback was providing Ebay with proof my medical surgery that delayed the shipping. I tried every possible means to work with the buyer but they refuse, but as a seller I have no options to prove myself through responding to the negative feedback twice. I will not play a stupid game like this theirs no resolution. An Ebay representative guarantees that the negative feedback will not affect any of my future sales, and that I should just keep replying to the buyers negative comments, and the email that was sent was definitely not from Ebay so just regard it. What bull crap!!

    EBAY changes your site preferences to allow buyers to alter your invoice. Trust and safety will give you false information pull a listing tell you it’s ok to list then pull it again then suspend your account, just to avoid discounts on future invoice and gain income from listing fees. The trust and safety team will tell you lies and never correct the situation. Ebay promotes fraud and allow buyers to pay partial invoice by going thru pay pal and all buyers to leave Lies for feedback that affect you status. Shame on you ebay and the crooks you employe and the ginny pigs that they use to allow the deceitful behavior . I wonder how many of the employees are the culprits to the internet fraud and theft they promote. Contact me if there is ever a class action suit for any of these reasons. PROOF!

    Follow the money . . . eBay Corporate is always looking for ways to show more revenue. It’s not about being fair. It’s about showing their investors profits. If they can hold funds and justify charging fees on shipping charges, they can make more. Just think of the amount in interest they make every day that they don’t release funds??!! Yes, a class-action suit is totally in order on this one.

    I have spent the last five hours on Ebay asking for a feedback that was a straight up lie be removed. I got no where. I will be suing ebay and sending the cost of my attorney to them as well. I work so hard and just because a person wants to return an item they don’t want, have worn or whatever other dumb reason they come up with, us sellers have to pay the price. This should not be allowed. I am so exhausted.

    ebay has become a communist run company. The feedback and DSR ratings are TOTAL BULLSHIT..!! Back in 2006 the feedback system was fair when a seller could leave NEGATIVE FEEDBACK for a problem buyer.!!
    Having anonymous DSR ratings is illegal. Ebay is scamming sellers out
    of $$$$$$$$$$$ by not letting them keep their Above Average ratings. ebay does everything they can to screw the small seller.
    They hold your money for 3 weeks..!!! I need to pay bills.. that is why I have been on ebay for 7 years.!! Even after 7 years ebay does not TRUST ME..!!!
    Even their PATHETIC customer service in Manila is a HUGE WASTE Of TIME..!! They don’t speak english that well and don’t understand what is really going on.
    ebay makes you jump thru hoops but you can NEVER win to keep your ratings Above Average..!
    They need to be in a HUGE CLASS ACTION LAW SUIT for $5 Billion
