City National Bank Debit Card Customers File Class Action Lawsuit Against City National Bank Over Overdraft Fees.
A class action lawsuit has been filed against City National Bank in Kanawha Circuit Court, West Virginia alleging that City National Bank unfairly assessed overdraft fees due to the way debit card transactions were posted, according to a class action lawsuit news report.
The City National Bank overdraft fee class action complaint reportedly alleges, among other things, that City National re-orders debit card transactions from the highest to lowest dollar amount so as to deplete the customer’s available funds as quickly as possible while maximizing the number of overdraft fees, charges overdraft fees even where a customer has not overdrawn his checking account, and charges overdraft fees even where City National did not pay out more funds than were in the customer’s City National checking account.

Happened to me just yesterday. If City National would have listed transactions as performed I would have only incurred one NSF charge but they reordered the transactions from highest to lowest and as a result 2 NSF charges were levied. I’m sure this is not the first time they have done this on my account.

I was wondering if anyone ever had $500 misplaced from their account three different times. It happened to me durring the same time frame as this re-sequencing thing and I was assesed several overdraft fees. The rep. that I spoke to over the phone had no explaination and could not see why it was transfered or where it went, but they could only refund half of the overdraft fees that were charged. That, as she put it, is company policy. So has anyone else ever had this happen.
It happened to us as well. We were low on funds and we knew it so we were watching out account. At the end of the day we were ok, then we saw that a large check cleared and we thought….not a big deal….one overdraft. NOPE….they took that last check of the day and drained our account and then chrage us something close to $400 in overdraft fees for every little debit on our account. Their reeasoning was “we feel the larger transactions are more important”.
They managed to assess close to $ 600. in less than a week for me I just walked in the managers office handed her the money for one check that was not accounted for and told her to consider the account closed. She said they couldn’t do that I replied as far as I’m concerned it’s done and left. I never heard from them after that.
Who do you get ahold of to find out information on this i had an account and was overcharged several times hundreds of dollars at a time because instead of taking one thing and over drawing my account it would overdraw it three or four times.
If you qualify for the suit you should get a card in the mail. 12 million was granted in the suit. They should start sending out checks in late July…
Hey I was 19 when I inherited quite a bit of money, i was young and they took advantage, almost making it to where they were elevating my debits so i would overdraft.. i probably paid them 1,200.00 in overdraft fees even havinig money in my savings ! you would think it would have automatically trandfered over with a small fee, ! i went into banckruptcy with them and thier rules- clearing large amounts and hitting you overdraft fees for 0.50,4.30.2.00 dollar amounts.
5,000 dollars of over drafies – couldnot pay bills and rent and car note – filed banckrupcy .

My husband and I were lied to by the bank. When we received our fed refund check we took it to the bank and deposited it. We point blank asked the teller when is the money available? She says to us well now of course! So we went out to dinner and did a little shopping. Well wouldn’t you know it when we got home that night all the charges that we made on our debit card where showing up, but not the deposit we had made. This was on Sat night so we had to wait until Mon to goto the bank. By then our account was OD by over $500 and still no deposit, but of course NOW there were also some lovely OD fees applied to account! Imagine that! So we complained and asked where our money was that we deposited and their response to us was that if you deposit a check it doesn’t show up in your account for at least 2 business days and Sat doesn’t count so now your money will NOT be available until Tues afternoon, however if you would not have deposited the money we would have just given you cash…WTF!!! I was soooo angry my husband had to make me leave the bank. OK so I guess it doesn’t even matter that we were lied to. All the branch manger could say was ” The rules are stated in paperwork that we gave you when you signed up for your account.” OK how many people in the free world can even understand the crap that is printed in that stuff? These people are liars and out to bleed people dry of their hard earned money!
I can so relate.. ! I have had that very same thing happen to me. I did learn a little trick to get aroungd that. HERE IT IS I HOPE EVERYONE CAN SEE THIS- Step# 1,Go through the drive through or to the teller, Syep#2- Cash that check! Step#3- then tell them you want to deposit it. (I have good friends/we all do this) they have caught on to this and say its not allowed, but m friend the xustomer is always right in a case like that- Step# 5 if they say they won’t do it-say you changed your mind. if they still won’t do it move to Step#6- GO TO THE MANAGER AND TELL HIM/HER THAT THE TELLER WON”T CASH YOUR CHECK! Then the teller will look like an idiot! Ya see they have to allow you to use money that is cash-checks do cause a dilema.
Hi I have a serious isssue with City. I received a check from a company for $2,950.00. They deposited the check nad I had access immediately.
However, 4 or 5 days later they stated putting fees on my account, because they had returned the check to the company, ststing that it was no good. They immediatly started addingfees to my account and charged the check back to me which caused an overdraft fee.s Once I saw what was happening, I called. My paycheck went into my account and they are holdingmy pay check toward the fees and other items associated with the account. When I called them they said there was nothing they could do. I called several times and left messages for their collections. With no return call. We just had memorial day 3 day weekend. So I called them yesterday and the supervisor in collection was mean and rude. And told me this was my fault. I should have known the check was no good. I ask them how could I know. He told me I was lying and that I should have know the check was no any good.
They are holding my entire paycheck that was deposited int the account. Now I have no money to pay my rent, to buy groceries or anything else. Can anyone tell me if they can do this legally.

They have charged me overdraft fee’s for money that has been fruadulantly taken out of my account with just a debit card number ! No Card, No Pin, No Signature Against O.C.C regulations. They did nothing to help they were even supeoned to the hearings and didn’t show up. We are talking thousands not hundreds. I am going to court with them as soon as the continuing of the hearings are are done they keep continuing this hearing in front of the Magistrate Stricklin. Heck the person whom did this will be out of prison before it gets to court ?????? Wish I had an Attorney. Anyone know one whom will help ?
I would go to an attorney for a free consultation. I did this for something completely different and they directed me right where I needed to go. I would get the police to pull videos. You can also file a civil suit against each vender that allowed this “idiot” to utilize your card without verification. The law suits may take from months to a few years.But in the end it will be worth it. That is why there is a place for your signature on the back of the card. And I usually don’t sign mine then when it is being used they (If they have any common sense) should say Its not signed on the back I need to see some identification. This makes me angry for you. I know this feeling way to well I have been with city simce 2002 & still am but I have been in fresh start this my 3d time now because of the overdraft scam I had my morgage of 500 a month taken out of my account for 8 years I was makeing about 2000 twice a month but I was always over drafted and nost months they bounced my morgage & I would set there for hours trying to find my money so I would not get forclosed on needless to say I lost my house I feel it is citys fault because my morgage should have been payed last year or earlyer.

I used to have city national but i changed banks because of their overdraft fees. I was charged several times for stupid purchases of $1-$2.00. Their was no way to even know that you were over-drawing b/c all they would do would send you a letter in the mail so it would be 2-3 days before you knew. I hate how it always took them 2 business days for any purchases to post to your account. Plus if you did try to correct it you had to have the money in the bank before 1:00 or your deposit wouldn’t post until the following day!!! I also paid another $5 a month b/c I thought that I wasn’t supposed to get charged if I used my card at ANY atm but I’m pretty sure that was just another scam. I don’t think they waived those fees at all. I know I paid several $1oo dollars for small charges that occurred in one day. City National is the worse bank EVER and I banked with them for 4-5 years!!! Chase seems to be the best bank ever!!!! Does anyone know if you can still join in the class-action lawsuit and how if it’s not too late?
another thing I hate about city national is that i deposited a check for $200 that someone had wrote me and then I went out shopping. It wasn’t until a couple days later that city national said that the check was bad VIA MAIL. By then I had already blown through the whole check. They then wanted to charge me overdraft fees. I told them that I was unaware that it was a bad check and why would they have deposited it in my bank and allowed me to have access to it if it wasn’t good. Well they said that they could automatically withdraw the money from this guys bank when he got paid but it had to be paid in 30 days or they would close out my account. Well the guy gets paid once a month but my account ended up getting closed and i had calls every day and sometimes twice a day from a collection agency. WTF. I had to pay the 200 plus fees!!!
We, Husband, and two sons, have had so many issues with City National Bank that we have moved all of our accounts. I sure hope I will recoup the fees that were taken from us with this settlement.

city national bank charged me a 1000 dollars worth of fees. i wired them 150 dollars from another bank and they put me -55o dollars in the negative with my other bank
There was over $1400 in overdraft fees charged to my account when it closed. There would have only been one, but they took the money for the large item that should have posted last then caused several small dollar items to cause the overdraft. It was also during this time, at Christmas that $500 had become displaced from my account; and they refused to work with me. As a result I refused to work with them on anything and they had a judgement filed against me. I am so happy that I held out and this is going to be reversed now.
If you received a card in the mail, you are already included in the lawsuit and settlement. The card has information on our to opt out of the lawsuit if you desire but you cannot sue City National if you opt out. The final hearing is scheduled for January 9th and since it’s a settlement, there’s no reason to think everything will not go through ok. Once it’s settled, City National has 60 days to provide refunds to people who suffered from their practices. However, if your account was closed with a negative balance that was not paid, those customers will get debt forgiveness on those accounts but will not received any actual funds.
Hmm! Well what if I had an account and they jacked it up with fees and “corporate nonsense” so I payed it off and closed it? Will I still get a settlement for that old account that was closed? It wasn’t in the negative. Soon after I closed that account, that little devil on my shoulder convinced me to open another account with City National Theives. Didn’t learn my lesson – they did the same thing, making little “oopsies” on my account. I can’t wait for settlement day! Payback!
I also am a victim. I miss added and instead of paying one of the 3 checks, they returned them all ,which I had enough funds in my account, but after the overdraft charges, I was in deeper than I was in the beginning. May end up switchng banks!!!
You will absolutley get reimbursed for your closed account. I had gotten a letter in the mail about it and it said that you will be given only what you were wronged with the overdraft.. But if you opened another account (I had two for a long time) Im unsure of how they will handle that. If its the same account number then you may get all the benefits I would think. Hope this helps? I have been with City National Bank since 2000-2001 and I currently still bank with them. I have been in there offices countless times due to their Overdraft “system” the high to low transaction.I can remember them helping me with it only 2 times. I constantly keep tabs on my account. I have always appreciated their kindness but I sure don’t appreciate them ,basically, stealing money from me. when I was in college I was neglegant, however City National I believe took advantage of that. I want my money back! And I want it now! I have recently been placed into unemployement for the 1st time in my life, they are aware of this.. City National its time for you to open your walllet and overdraft to pay back all the money you have taken not from just me, but others as we all fight against these difficult times. When will “we” the City National Bank customers get justice? Is there something I need to fill out, a form, a complaint.Everytime I ask a representative they never have any answers! I have tried to “settle” on a closed checking acct with City. On several occasions I have been informed that the acct was closed with a negative balance and that they would not cash a check until that balance was satisfied. So I called the bank, asked for a breakdown of the last transactions so i could pay the $38 they said I owe. Never received anything. I know that City closed my account when they processes checks/debits prior to my deposit, thus overdrafting me $1300. I didn’t want something negative on my credit so I paid it. Would I still be eligible?
I also was charged alot of over-draft fees, but that was not the worst of it. My fiance was on my account and she was on her elderly mothers acount. Her mother only income was social security. City National closed my account and transfered funds from my fiance’s account to pay my account, which inturn over-drafted her account. They did this without any permission from any involved party. My fiance was not a primary account holder on either account.

You don’t have to do anything. It could be a year or longer. Call the number on your card. It makes more sense than the card.

Well not sure what is happening with the lawsuit but I just had them rearrange my debits and pay a large check first .. Charged me 3 return item fees instead of 1!!!!!!!! The 2 that we charged to me were for $0.50 and $2.00!!!! When I had over $500 in my account and the check I wrote was for $537!!! Come on City National!!!!! I am seriously thinking of switching all of my accounts to a different bank .. I have 5 accounts with them and have been with them since 2004. This is really sad that they treat people this way in today economy especially .. Really really upset!!!

City National Bank has done this to me for too lonh.. in the last couple of weeks they put a fraudelant check through and bounced it, losing my paycheck due to fees applied and when I called the bank they told me there was nothing they could do, so then about a week later they put that same check back through and put the smaller things that were supposed to come out of my paycheck last and all of them bounced. In the last 2 weeks I have added to my account between 300-400 dollars in bounce fees for items as low as 5 dollars. This is ridiculous what the bank is doing and when I called them again yesterday because they keep rearranging my account around, they told me they would call me back and never did and when I asked for the main corporations number they wouldnt give it me.. somebody really needs to do something because I live on widows and survivors benefits from my husband passing away and I have 2 special needs kids and I am disabled and we have to scrimp and eat minimal all the time or beg and borow to make sure the kids get fed… City National should be ashamed of themselves
I am sorry I was wrong in the amount city national has charged me in bounced check fees, since March 12th I have been charged 504 dollars in bounced fees, how ignorant is that?
This happened to us numerous times. I would pay bills and they would always hold back taking the smaller amounts out first. They would take out the larger bills first to cause an overdraft. If they would have taken them out in the order that I had paid them I and that they had received them I would not have bounced any checks. I asked them about it and they told me that they ASSUMED I would want the larger more important bills paid first. Bull Crap. It’s not their decision to choose who I paid first. I hope I get paid back.

We canceled our banking account and got a different bank. It’s a shame that they refused to make things right with us after taking hundreds of dollars from us… I’m glad someone spoke up because if they didn’t we would have never known they were oing it to others as well….
I experienced this many times when I was with City National. Also, I was double charged at an ATM. I took out 45 dollars, and was charged 2 45 dollar charges. I filed a grievance, and they “investigated” and concluded that I had received the money. That made me angry.

Check came today. No where near the amount of the highest month of overdraft fees they said they would pay out on the settlement. Called to find out how much was supposed to go to customers from the lawsuit and how many people were paid out in the lawsuit. They did not have that information. They did say any money left over would go to a non-profit. Everyone knows about how most of those are run. $56 million raised to help home coming vets and not $1 given any of them because it cost 56 million to raise the money.

Are they going to pay us or what, the 10th has came and gone and I have not heard a word the message on the call line has not changed this is a lot of bull, if they faled let us know if they won let us know. The web page has a new page with a signed award on it but know word of what it was.

I was sent a letter on this lawsuit. However since I did not pay back the overdraft fees. Years later I have to go on my elderly 75 year olds bank account in case he was unable to pay for things on his own. Little did I know he says something is wrong there is 1500.00 missing from my account. Call the bank for me. Well to my horror because my name was on his account they garnished 1500.00 for the overdrafts I owed due to this unfair way of posting things. I had no way to pay him back. The banks simply says well at least your in good standings now. How humiliating for me and for my poor dad to have some of his hard earned money taken from him. Has this happened to anyone else. It is sickening. I was hoping for a little money back to at least pay a few dollars back to my fathers account. Innocent people hurt because of their practices. Sickening. I am in good standings now…woo hoo but I can darn sure say I would never put even a penny in that darn bank.

My son recieced a letter today saying that he was awarded $90.00. BUT HE LEFT WIYH A BALANCE AND IT WENT TO DEBT FORGIVENESS. SO HOPEFULLY CHECKS WILL COME SOON.

I was identified as a class member in the settlement about the overdraft fees, this last letter you sent me said the records provided by city national indicate that I had one (1) overdrafts, For the sum of $30.95 I am here to say, that is not true by a long shot. I think we are all getting ripped off. Some info say they will pay late July but if people are already getting e-mail and letters, what about the rest of us? I have not heard a thing from anyone other than receiving the card in the mail saying a class action suit has been filed against them. I had nearly 6000.00 in 2 years of overdrafts fees. The way I understand it, it has to be paid back from withdrawing money from an ATM and if checks hit previously written AFTER the ATM transaction – this is what they owe you for (those fees). only.
Hey Kelly, from what I have read it looks like you have 60 days from the final order to pay us. By my calculations that would mean we should be paid by July 10th.
the only people that have benefitted from this class action suit are the lawyers and the original claimant. city is not hurting as the money probably gained in interest what they had to originally pay out as it sat in the bank for a year – they never had to admit any wrong doing anyway so I wish that someone would see if this was a big scam in itself as they found out about previous banks doing this to customers and decided they would get together and do this. I have not recieved any notification of this until the past january with the card saying i do not have to do anything either and I emailed the lawyers to find out what the final outcome was. there is no organization to this or formal notification and I don’t understand except it causes me to feel there is another scam here by the lawyers themselves.

From what I hear, checks or debt forgiveness “should” be mailed by July 31st. But the key word is “should” which really means, maybe but probably not. The court did approve the settlement. It never went to trial probably because regular people are on jury’s and the bank knew they would lose big time if they went to trial. I know if I was on the jury, I would take every dime those bastards have. I hate banks. People should get together and truly do something about these banks. It all basically boils down to good ole boy politics and the banks friends in offices of power letting them do whatever the hell they want to regular people who work for a living and are doing the best they can with everything going up but our paychecks. There are some days I feel like just crying and never stopping and some days I feel like taking a A-K to the local branch. (Just for the “officials” our there) I’m not really going to take a A-K to the bank justs feel like it sometimes. Anyway, I guess I’m through griping for today but I don’t expect to be paid back much and certainly not nearly as much as those bastards stole from all of us. Mattie if you work or worked for a liveing then you know the money dont run down hill only pennies that fall out of the pockets of the rich is what a person is given for a hards day work,( with out unions we would not get that ) . We will only get what the lawers have left over from their payday, so they will keep the money as long as they can so they can charge more for the handeling of it. As for the bank , We the Pepole Of the U.S.A. can and should take them back everyone with draw their money for two mounths and stop payments for 2 mounths and banks would be more helpfull to all of use. Mark – I do work for a living and I work very hard. Your right, we do need to take back OUR country. It’s like looking at a giant mountain and wondering how are you ever going to get to the top. I guess we could all start by taking the first step. I agree, if there were never any unions, we would all be living in company houses and our paychecks would be script only redeemable at the company store. It’s so bad, we don’t even have a decent person to vote for this year to lead our nation. One is so far to the left and one to the right and nobody seems to know how to meet in the middle anymore. Congress is so screwed up they can’t get together to agree what to have for lunch. I see a great nation falling further into the “big black hole” everyday. We have got to do something. And Amber, I haven’t heard of anyone receiving a check yet, so don’t hold your breath.
In my opinion this is still occurring.
If you have funds in your account they will take out all the ACH’s first and let a bigger check or such be RT and then it has to be processed again.
They should refuse the ACH’s after your limit/especially if they are gooing to pick and choose what to pay first.
I’m beginning to think its cheaper to get Money Orders, I’d have money left over. Anyway we will only get one months worth of OD fees returned. What about all the rest??? Slap on the wrist and keep raising the fees to cover their losses.

Did you get a letter saying you were getting debt forgivness by mistake? I haven’t received anything from them as of yet not even a “we’ll get to you by the end of the month” letter. The website was saying people who received letters in error about the debt forgiveness would receive corrected letters this week. I was wondering if that is what you received. All I have received is notification that I am part of the class.
I had a joint account with my EX WIFE, Brenda Thomas (Hutzler) for 28 years. She has never left me know anything about this account as far as how the money was spent, deposits, balances. I do know there were a lot of overdrafts. She has a severe gambling addiction and cannot manage money at all. I have never received anything regard myself being included. She may have received a letter, I have no way of knowing. I called 1-888-632-0710 and was told 2 months ago that I would be added to the suit. Once again I have never received anything. Nothing yet – I e-mailed the Administrator in the class action site twice and no reply. Has anyone received anything yet. Even though they say end of July or by July31 – surely we should have received a letter about what we may be getting. The 750 million stimulus money after Bush left office (most of that went to the banks) – Chase received 28 billion! Not sure about City National. Then when people tried to refinance their homes or get loans – the banks who got the stimulus would NOT give people those loans or refinancing. It is a sham all the way around! The President should have dividied the 750 million stimulus and gave each household a check – it would have averaged around 3500.00 for each person (not family) in the US.
received class action card but have not gotten any response from anyone. Only know what I’ve read online about payment by July 31. Doubt if I’ll get a dime even though they hit me for Hundreds of dollars. The shame is I’m on disability, they would have done me better if they would have just come by and chopped my legs off. My son received a letter yesterday July 24th. Saying that they had made a mistake that he did not have debt forgiveness and that he should receive a check by the end of July. Now I wonder the first letter said that he would get $90 plus change for debt forgiveness so I wonder if the check will be for the same amount?
Do you know how many bounced check fees your son was charged? It may give us a idea of what the rest of us should expect. Thanks!

You can sure bet that if you owed City National a few bucks that you would have to tell them the exact minute they would get their money. Come on….cut a check!
I think we’re all beating a dead horse here. The Lawyers made their money, as for us, end of story. I was involved in a class suit a few years back after a 2 year wait I received a check for $9. the attorney’s got over $ 33,000,000. This a shell game and we are the suckers.
Do Not bother writing the Administrator. I have on a few occasions and have yet to receive a reply.
Back before May of 2012 I received two letters stating that I was apart of a class action settlement. I had read in the letter about a court date in May and after the court date I had started keeping up with the court stuff online. On or around July 1st I emailed the website and around three weeks later they answered and said that had to evaluate whom would be receiving funds and whom ever would should receive funds by July 31.

Hum, maybe someone should consider a class action lawsuit against the lawyers who keep beating around the bush about the settlement money? Seems to me that someone somewhere is just pulling in the cash on the intrest to this money that SHOULD be sent to the settlement members, and at the end of the day some of us who shelled out thousands of dollars due to these evil acts will wind up with a few dollars.
I know after all this bull, next time I will be opting OUT of class action lawsuits, if all of American started banding together and opting out, these blood sucking lawyers who only do this for themselves might change their OWN ways!!

My sons got the first letter that said he owed $90 and some change. then he got the second letter on the 24 saying that was a mistake and that they owed him and he would recieve a check. I would assume it would be for the same amount. I am not sure how many overdraft fees he had. I know I had a lot on my account which was closed in good standing so I am hoping for a bigger check. Tomorrow is the last day of the month so hopefully we will have a check in hand soon. I will be happy to just recover some of my fees. I had a debit card stollen and did not realize it was gone until the theive racked up several thousand dollars in OD fees I was out of town and discovered it after the 30 days so the bank did not give me anything back so I would love to just recover some of that. Sons letter said it would be mailed end of July so hope to see smilies on here in the next few days. 🙂

No info at all. I am not expecting anything here. I have not heard from one person who received anything on this settlement.

I have gotten the same 2 letters that most got, and today is the 31st, i still have a account with them and yet i have not received no deposit. so i feel that we all have been lied too. what a complete waste of time, if they knew they wasn’t going to take care of us why even bring it to our attention??? to call the bank and ask they don’t know nothing..
