Dentists File Class Action Lawsuit Against Align Technology Over Alleged Quota or Proficiency Requirement For Prescriptions of Medical Orthodonic Device Invisalign.
A class action lawsuit was filed against Align Technology, Inc. in the United States District Court for the Northern District of California (captioned Christopher J. Leiszler DDS v. Align Technology, Inc., Case No. 10-cv-2046-PVT) alleging that Align Technology charged dentists approximately $2,000 for a training course in order to prescribe the Invisalign teeth-straightening medical device, but then implemented a quota system that required the prescribing dentist to initiate 10 new Invisalign cases per year which, if not met, resulted in termination or suspension of the prescribing dentists’ right to initiate new Invisalign cases, according to a class action lawsuit news report.
