Similac Consumer Files Class Action Lawsuit Complaint Against Abbott Laboratories Over Recall of Similac Powder Baby Formula That Allegedly May Contain Beetles or Beetle Larvae.
A class action lawsuit has been filed against Abbott Laboratories, Inc. (“Abbott Laboratories” or “Abbott Labs” or “Abbott”), in federal district court in New Orleans, Louisiana (styled Kathleen A. Brandner v. Abbott Laboratories, Inc. and Sam’s East d/b/a Sam’s Club, Civil Action Case No. 2:10cv03242), alleging, among other things, that Defendant Abbott Labs announced a recall of Similac powder products on Sept. 22, 2010 since the Similac powder allegedly could contain pieces of beetles and beetle larvae and that Abbott Labs allegedly failed to properly exert quality control measures to ensure that the Similac formula was safe for consumption and that it did not contain beetle particles, according to a class action lawsuit news report.
According to reports, the U.S. Food and Drug Administration (F”DA”) determined that while the formula containing these beetles poses no immediate health risk, there is a possibility that infants who consume formula containing the beetles or their larvae, could experience symptoms of gastrointestinal discomfort and refusal to eat as a result of small insect parts irritating the GI tract.
The recall of Similac powder infant formulas reportedly includes:
- Certain Similac powder product lines offered in plastic containers.
- Certain Similac powder product lines offered in 8-ounce, 12.4-ounce and 12.9-ounce cans.

I would like to join this class action lawsuit! My newborn son was seriously ill for the first 1 1/2 months of his now 3 month life and i complain to the doctor, they didnt know that his fromula had been tainted!! i had saved 7 cans that i returned to the store when i heard of the recall and switched his formula immeridatly. he is now just fine. no more constipation and sicknes.. i was scared for him and it caused major depression for me and his father, as we had no lcue why our son was so sick. i want to persue a lawsuit but havent known who to contact. i have no money for a lawyer. please contact me if you have any clue as to what i should do about this!!!
There was a class action suit filed the day after Abbott announced the Similac recall. http://brandnerlawfirm.com/ is a lawfirm in Louisianna. I talked to them today and all you need to do is fill out the questionaire you can find on their site. The lawyer’s own child was affected.
I got the questionaire and am going to filling it out and sending it off on monday. i am so glad that there will some justice from this. my poor son was in absolute hell for what seemed like forever. i am so appriciative that someone is recognizing what a huge deal this is and i am happy to be a part of it! unfortunate that my son had to suffer and they need to own up to their mistake. thank you!

i sent out my questionaire on the 18th, i sent it certified mail. i am so glad that this is actually gonna go somewhere. well hopefully. i ams o upset over what happened to my poor little angel. he is just now finally getting over being sick and getting used to his new formula. thats hard for a newborn to go through!! i feel terrible for all the other parents who went through what i did! it is aweful.
My daughter was born on June 2010. She’s is affected by server
symptoms including stomach cramps, vomiting and diarrhea! She also has swelling in two lymph nodes under her arms. After several visits to her pediatrician she is still suffering with stomach cramps! After many sleepless nights my husband and I are extreamly frustrated due to fact
of we thought we were giving our daughter a healthy start on life. As a Mother we try to keep a safe and clean environment for your New Born to learn the Company you trust to provide MILK CLOSEST TO THE MOTHERS BREST!!!! HAS INSECT FECES AND LARVA . I want to join this Class Action Suit. They should be held accountable to the many Mother’s who trusted them.

My Son is going to be 7 months old Nov 9, 2010 and he was sick from the time he was 2 and a half months old till I took him off of the Similac formula at months. He was at the doctors, after hours pediatrics more then I can count, regarding his constant screaming and crying for no reason, throwing up, diarrhea, stomach problems, and acid reflux got so bad I had to feed him more frequently and he was on Similac Formula, So my poor, helppless baby was ingesting a nasty, unsafe formula. I am disgusted and sad at the same time, I as his mother had fed him an unsafe Formula that was suppose to be safe, caused my son so much agony along with sleepless days and night. He was so miserable, I want to know how to be involved in this Class action Lawsuit and I want answers. please send me info ASAP!!!
I am wanting to file a lawsuit agains Abbott Similac. The FDA knew about the complaints of the bugs and beetle stuff for 2 whole weeks before they even put out the recall, bugs in formula?? Babies are suppost to be the most taken care of people in this world, and all products should be taken care of the same. We want our babies to grow healthy and strong, but not with beetle and larve bullshit! Even though this was a while ago, I am still mad and I always think about the recall, I still have a plastic can of formula recalled and there was a bug in it and my daughter drank more than half of the fourmla before the recall. She was fussy and didnt want her bottle, and I wondered why she didnt want her bottle, now I know why!!!!!!! That is gross. Why wouldnt Abbott call the recall when there was the 1st complaint of the bug.
We want to join class action too. Our son was born January 2010 and he was on similac. He is still suffering from vomitting, gas and other issues. He used to be so fussy and eventually spit up all his milk. We talked to his pediatrician but they couldn’t figure it out. We are so glad that this class action will go somewhere. Abbott needs to be accountable for their actions.
