Maytag Centennial Washing Machines Purchasers File Class Action Lawsuit Against Whirlpool, Lowe’s & Sears Over Alleged Energy Star Efficiency Claims.

A class action lawsuit has reportedly been filed against Whirlpool Corporation (“Whirlpool”), Lowe’s Companies, Inc. (“Lowe’s”) and Sears Holdings Corporation (“Sears”) (collectively “Defendants”) in the United States District Court for the District of New Jersey (styled Charlene Dzielak and Shelley Baker v. Whirlpool Corporation, Lowe’s Companies, Inc. and Sears Holdings Corporation) alleging, among other things, that Whirlpool, Lowe’s & Sears misrepresented the the energy efficiency of Maytag Centennial washing machines, model numbers MVWC6ESWW0, MVWC6ESWW1, and MVWC7ESWW0 by promoting them as ENERGY STAR®-qualified and labeling them with the ENERGY STAR® logo, according to the Whirlpool, Lowe’s & Sears Maytag Centennial Washing Machine & Energy Star class action lawsuit complaint.

The Whirlpool, Lowe’s & Sears Maytag Centennial Washing Machine & Energy Star class action lawsuit is reportedly brought on behalf of the following proposed class:

All persons in the United States who purchased a Maytag Centennial washing machine, model numbers MVWC6ESWW0, MVWC6ESWW1, and MVWC7ESWW0.

The Whirlpool, Lowe’s & Sears Maytag Centennial Washing Machine & Energy Star class action lawsuit is also reportedly brought on behalf of a California and New Jersey subclass.

According to the complaint, ENERGY STAR®-qualified washing machines are required by the U.S. Department of Energy (“DOE”) to exceed minimum standards for energy and water efficiency, use approximately 37% less energy and 50% less water than standard models, are more expensive than standard models, but come with the promise of reduced energy and water bills that, over time, will generate enough savings to recoup the higher price.

The Whirlpool, Lowe’s & Sears Maytag Centennial Washing Machine & Energy Star class action lawsuit complaint reportedly asserts claims for alleged violation of the Magnuson-Moss Warranty Act, 15 U.S.C. § 2301, et seq.), Breach Of Express Warranty, Breach of Implied Warranty of Merchantability, Unjust Enrichment, violation of the New Jersey Consumer Fraud Act, N.J.S.A. § 56:8-1, et seq, violation of the Consumers Legal Remedies Act (“CLRA”), Civil Code §§ 1750, et. seq.), violation of the Unfair Competition Law, Bus. & Prof. Code §§ 17200 et seq and False Advertising Law, Business & Professions Code § 17500 et seq and violation of the Consumer Fraud Laws Of Various States.

    Is there a class action suit against Maytag/Whirpool for the Maytag 300 Quiet Series Dishwasher? There should be. Go to http://www.consumeraffairs.com under Maytag dishwasher complaints. There is obviously a design flaw in the control panel causing it to break and when you replace the part that breaks too. Maytag does not have any interest in taking care of this problem. Spoke to them today and their representative, Lisa, supervisor of customer service, informed me that she is the only person I could talk to about getting my concerns addressed. And, she followed that with saying that she could not address my concerns. The president of this company, Jeff Fettig, makes something like $14,000,000 a year according to Forbes. Surely he could help out the customers that bought his product!

    Is there a class action lawsuit involving the Maytag Neptune Washer FAV6800AWW. Purchased in 2005; 3 yrs later had major problems with spinning cycle not removing water from tub, having to manually wring water out of clothes. Took 4 trips of service repairs to correct the problem. Now, 4 yrs later, same problem reoccurs. This time, warranty serviceman said it was not cost effective to repair. Maytag service plan rep said I would receive $282 to purchase another washing machine for the one I paid over $1,000. I was willing to pay this much money because I believed in Maytag’s reputation for quality having owed previous washers that lasted over 15 yrs. I would not have purchased a $1,000+ washer that lasts only 7 yrs (actually 3 yrs for 1st major repair). After learning about the meager am’t Maytag is offering in lieu of replacement, I’ve found there are huge numbers of blogs commenting on the same problem and the refusal of Maytag to correct the problem and/or replace the washer. Are there any options for us frustrated owners who are now out of $1,000 and a working machine after just 7 yrs.

    Kind of funny that I have google searched my Maytag washermvwc6esww0 several times a year to look up recalls, to get manuals, and read reviews. Two and a half years after you post this Class Action Lawsuit on Maytag Centennial washers. I have one of these, model #: mvwc6esww0. I haven’t seen any savings with this washer. I had a front loafer HE before this Maytag, which I saved a lot of money, and my clothes came out cleaner and not sopping wet. I liked the features , that it was a Top Loader, nd that it was supposed to save on water and electricity. If I had known about this lawsuit, I would of definitely got my name on the list. False advertisement is completely wrong, especially for a big corporation who just wants to fill there pockets from consumers looking for a product to save on utilities and be more efficient. Shame on Whirlpool! I’m not happy that I got had, and missed out on this. I bet there are 100’s more people in this same situation, that didn’t even know there washer was in a class action lawsuit. So what is a person to do who has one of these washers? Is Whirlpool still replacing them when the consumer contacts them, or have parts to make them efficient? Someone please answer my post, please.

    Agree with Shelly H. I have the may tag mvwc6ESWW1 . never had the money to repair so I pay more on water and electric because it refills at the end of spin cycle so I have to respin for half a cycle and stop it before refilling again. It also agitates before filling at start up. Have always felt cheated and deserve to have it fixed by the company! I don’t want money, just fixed or a replacement. Fair is fair.
