Twilio & GroupMe Text Message Recipients File TCPA Class Action Lawsuit Complaint Against Twilio & GroupMe.
A class action lawsuit has been filed against Twilio, Inc. (“Twilio”) and Groupme, Inc. (“Groupme”) (collectively “Defendants”) in the United States District Court for the Northern District of California (styled Brian Glauser v. Twilio, Inc. and Groupme, Inc., Class Action Case No. 11-CV-2584) alleging, among other things, that Twilio & GroupMe make unsolicited text message calls to cellular telephones, purportedly in violation of the Telephone Consumer Protection Act (“TCPA”), 47 U.S.C. section 227, according to the Twilio & GroupMe text messaging class action lawsuit complaint.
The Twilio & GroupMe text message class action lawsuit complaint is reportedly brought on behalf of the following putative class of persons, unless otherwise excluded:
All persons who received one or more text messages from GroupMe who were automatically unsubscribed from a GroupMe group because they never opted-in. (the “Automatic Opt-Out Class”); and
All persons who received the GroupMe Mobile App Text, or a substantially similar text from GroupMe, that advertised GroupMe’s mobile application. (the “GroupMe Mobile App Text Class”).
